Multidisciplinary perspectives on Artificial Intelligence and the law
This open access book presents an interdisciplinary, multi-authored, edited collection of chapters on Artificial Intelligence (‘AI’) and the Law. AI technology has come to play a central role in the modern data economy. Through a combination of increased computing power, the growing availability of data and the advancement of algorithms, AI has now become an umbrella term for some of the most transformational technological breakthroughs of this age. The importance of AI stems from both the opportunities that it offers and the challenges that it entails. While AI applications hold the promise of economic growth and efficiency gains, they also create significant risks and uncertainty. The potential and perils of AI have thus come to dominate modern discussions of technology and ethics – and although AI was initially allowed to largely develop without guidelines or rules, few would deny that the law is set to play a fundamental role in shaping the future of AI. As the debate over AI is far from over, the need for rigorous analysis has never been greater. This book thus brings together contributors from different fields and backgrounds to explore how the law might provide answers to some of the most pressing questions raised by AI. Climate Change and Critical Agrarian Studies
Climate change is perhaps the greatest threat to humanity today and plays out as a cruel engine of myriad forms of injustice, violence and destruction. The effects of climate change from human-made emissions of greenhouse gases are devastating and accelerating; yet are uncertain and uneven both in terms of geography and socio-economic impacts. Emerging from the dynamics of capitalism since the industrial revolution — as well as industrialisation under state-led socialism — the consequences of climate change are especially profound for the countryside and its inhabitants. The book interrogates the narratives and strategies that frame climate change and examines the institutionalised responses in agrarian settings, highlighting what exclusions and inclusions result. It explores how different people — in relation to class and other co-constituted axes of social difference such as gender, race, ethnicity, age and occupation — are affected by climate change, as well as the climate adaptation and mitigation responses being implemented in rural areas. The book in turn explores how climate change – and the responses to it - affect processes of social differentiation, trajectories of accumulation and in turn agrarian politics. Finally, the book examines what strategies are required to confront climate change, and the underlying political-economic dynamics that cause it, reflecting on what this means for agrarian struggles across the world. The 26 chapters in this volume explore how the relationship between capitalism and climate change plays out in the rural world and, in particular, the way agrarian struggles connect with the huge challenge of climate change. Through a huge variety of case studies alongside more conceptual chapters, the book makes the often-missing connection between climate change and critical agrarian studies. Protecting Privacy in Indian Schools: Regulating AI-based Technologies' Design, Development and Deployment
Education is one of the priority areas for the Indian government, where Artificial Intelligence (AI) technologies are touted to bring digital transformation. Several Indian states have also started deploying facial recognition-enabled CCTV cameras, emotion recognition technologies, fingerprint scanners, and Radio frequency identification tags in their schools to provide personalised recommendations, ensure student security, and predict the drop-out rate of students but also provide 360-degree information of a student. Further, Integrating Aadhaar (digital identity card that works on biometric data) across AI technologies and learning and management systems (LMS) renders schools a ‘panopticon’.
Certain technologies or systems like Aadhaar, CCTV cameras, GPS Systems, RFID tags, and learning management systems are used primarily for continuous data collection, storage, and retention purposes. Though they cannot be termed AI technologies per se, they are fundamental for designing and developing AI systems like facial, fingerprint, and emotion recognition technologies. The large amount of student data collected speedily through the former technologies is used to create an algorithm for the latter-stated AI systems. Once algorithms are processed using machine learning (ML) techniques, they learn correlations between multiple datasets predicting each student’s identity, decisions, grades, learning growth, tendency to drop out, and other behavioural characteristics. Such autonomous and repetitive collection, processing, storage, and retention of student data without effective data protection legislation endangers student privacy.
The algorithmic predictions by AI technologies are an avatar of the data fed into the system. An AI technology is as good as the person collecting the data, processing it for a relevant and valuable output, and regularly evaluating the inputs going inside an AI model. An AI model can produce inaccurate predictions if the person overlooks any relevant data. However, the state, school administrations and parents’ belief in AI technologies as a panacea to student security and educational development overlooks the context in which ‘data practices’ are conducted. A right to privacy in an AI age is inextricably connected to data practices where data gets ‘cooked’. Thus, data protection legislation operating without understanding and regulating such data practices will remain ineffective in safeguarding privacy.
The thesis undergoes interdisciplinary research that enables a better understanding of the interplay of data practices of AI technologies with social practices of an Indian school, which the present Indian data protection legislation overlooks, endangering students’ privacy from designing and developing to deploying stages of an AI model. The thesis recommends the Indian legislature frame better legislation equipped for the AI/ML age and the Indian judiciary on evaluating the legality and reasonability of designing, developing, and deploying such technologies in schools

Policy options for food system transformation in Africa and the role of science, technology and innovation
As recognized by the Science, Technology and Innovation Strategy for Africa – 2024 (STISA-2024), science, technology and innovation (STI) offer many opportunities for addressing the main constraints to embracing transformation in Africa, while important lessons can be learned from successful interventions, including policy and institutional innovations, from those African countries that have already made significant progress towards food system transformation. This chapter identifies opportunities for African countries and the region to take proactive steps to harness the potential of the food and agriculture sector so as to ensure future food and nutrition security by applying STI solutions and by drawing on transformational policy and institutional innovations across the continent. Potential game-changing solutions and innovations for food system transformation serving people and ecology apply to (a) raising production efficiency and restoring and sustainably managing degraded resources; (b) finding innovation in the storage, processing and packaging of foods; (c) improving human nutrition and health; (d) addressing equity and vulnerability at the community and ecosystem levels; and (e) establishing preparedness and accountability systems. To be effective in these areas will require institutional coordination; clear, food safety and health-conscious regulatory environments; greater and timely access to information; and transparent monitoring and accountability systems

Alternative Power: The Politics of Denmark\u27s Renewable Energy Transition
Global climate change is one of the defining political challenges and opportunities of the current era. Experts widely agree that technical means already exist for making the necessary transition from fossil fuels to renewable energy; the obstacles to doing so are primarily political. Careful observers also recognize that this period of transition creates an opening for political innovation and development. How can the political will be generated to take action to prevent climate catastrophe? And what will the process of transitioning mean for the political systems that have been built on cheap and abundant oil? Political scientists have largely ignored technological development as a lever for political development, or feared that technology could only be a force of domination. Yet renewable energy enthusiasts have often seen democratizing potential in these technologies. What can be accomplished politically by building a wind turbine? As countries like Denmark accumulate decades of experience with renewable energy, it is becoming possible to give such questions close empirical consideration. Denmark generates more of its electricity from renewable sources, and has been doing so longer, than any other industrialized nation, making it a uniquely valuable case for studying an advanced renewable energy transition in progress. This dissertation draws on novel qualitative and quantitative data to present the first comprehensive history of Denmark’s energy transition from its roots in the 1970s until the present, aiming to explain how this tiny nation emerged as the world’s leading wind power producer, and assess whether this process has yielded any democratic dividends. The multi-method analysis sheds new light on internal dynamics of Denmark’s energy transition, and, more generally, on late-stage evolutionary processes in mature technological systems. Many studies have shown an interest in the Danish case, which is usually presented as a relatively unqualified success story, but few have provided the empirical resolution to identify these complicating factors. This dissertation employs an explanatory strategy adapted from the ecological sciences to construct a more holistic and integrative portrait, resulting in a more thorough and accurate account of how Denmark jumped out to such a significant lead in the energy transition, and why that momentum might be flagging today, with implications for other countries hoping to chart a path toward a sustainable future
Concurrent Product and Supply Chain Architecture Design Considering Modularity and Sustainability
Since sustainability is a growing concern, businesses aim to integrate sustainability principles and practices into product and supply chain (SC) architecture (SCA) design. Modular product architecture (MPA) is essential for meeting sustainability demands, as it defines detachable modules by selecting appropriate components from various potential combinations. However, the prevailing practice of MPA emphasizes architectural aspects over interface complexity and design production processes for the structural dimension, potentially impending manufacturing, assembly/disassembly, and recovery efficiency. Most MPA has been developed assuming equal and/or fixed relations among modules rather than configuring for SC effectiveness. Therefore, such methods cannot offer guidance on modular granularity and its impact on product and SCA sustainability. Additionally, there is no comparative assessment of MPA to determine whether the components within the configured modules could share multiple facilities to achieve economic benefits and be effective for modular manufacture and upgrade. Therefore, existing modular configuration fails to link modularization drivers and metrics with SCA, hampering economic design, modular recycling, and efficient assembly/disassembly for enhancing sustainability.
This study focuses on the study of design fundamentals and implementation of sustainable modular drivers in coordination with SCA by developing a mathematical model. Here, the architectural and interface relations between components are quantified and captured in a decision structure matrix which acts as the foundation of modular clustering for MPA. Again, unlike previous design approaches focused only on cost, the proposed work considers facility sharing through a competitive analysis of commonality and cost. It also evaluates MPA's ease of disassembly and upgradeability by a comparative assessment of different MPA to enhance SCA sustainability. The primary focus is concurrently managing the interdependency between MPA and SCA by developing mathematical models. Consistent with the mathematical model, this thesis also proposes better solution approaches.
In summary, the proposed methods provide a foundation for modeling the link between product design and SC to 1) demonstrate how sustainable modular drivers affect the sustainability performance, 2) evaluate the contribution of modularity to the reduction of assembly/disassembly complexity and cost, 3) develop MPA in coordination with SC modularity by trading off modular granularity, commonality, and cost, and 4) identify a sustainable product family for combined modularity considering the similarity of operations, ease of disassembly and upgradability in SCA.
Using metaheuristic algorithms, case studies on refrigerators showed that MPA and its methodology profoundly impact SCA sustainability. It reveals that interactions between components with levels based on sustainable modular drivers should be linked with modular granularity for SCA sustainability. Another key takeaway is that instead of solely focusing on cost, facility sharing and ensuring ease of disassembly and upgradeability can help to reap sustainability benefits

Copyright as a constraint on creating technological value

This work tackles the question from the perspective of copyright, analysing the judicial practice emerging from case law on new uses of intellectual property resulting from technological change. Starting off by comparing results of actual innovation-related cases decided in jurisdictions with and without the fair use defence available, it delves deeper into the pathways of judicial reasoning and doctrinal debate arising in the two copyright realities, describing the dark sides of legal flexibility, the attempts to ‘bring order into chaos’ on one side and, on the other, the effort of judges actively looking for ways not to close the door on valuable innovation where inflexible legislation was about to become an impassable choke point. The analysis then moves away from the high-budget, large-scale innovation projects financed by the giants of the Internet era. Instead, building upon the findings of Yochai Benkler on the subject of networked creativity, it brings forth a type of innovation that brings together networked individuals, sharing and building upon each other’s results instead of competing, while often working for non-economic motivations. It is seemingly the same type of innovation, deeply rooted in the so-called ‘nerd culture’, that powered the early years of the 20th century digital revolution. As this culture was put on trial when Oracle famously sued Google for reuse of Java in the Android mobile operating system, the commentary emerging from the surrounding debate allowed to draw more general conclusions about what powers the digital evolution in a networked environment. Lastly, analysing the current trends in European cases, the analysis concludes by offering a rationale as to why a transformative use exception would allow courts to openly engage in the types of reasoning that seem to have become a necessity in cases on the fringes of copyright
