Ad Tech & the Future of Legal Ethics

Privacy scholars have extensively studied online behavioral advertising, which uses Big Data to target individuals based on their characteristics and behaviors. This literature identifies several new risks presented by online behavioral advertising and theorizes about how consumer protection law should respond. A new wave of this scholarship contemplates applying fiduciary duties to information-collecting entities like Facebook and Google.Meanwhile, lawyers—quintessential fiduciaries—already use online behavioral advertising to find clients. For example, a medical malpractice firm directs its advertising to Facebook users who are near nursing homes with bad reviews. And, in 2020, New York became the first jurisdiction to approve lawyers’ use of retargeting, one form of online behavioral advertising. But the professional responsibility scholarship has not yet considered these developments.The Article describes the rise of online behavioral advertising and lawyers’ nascent use. It draws on modern privacy scholarship to explain how this advertising method can lead to privacy invasions and manipulation. It then explores the specific case of lawyer advertising. And it critiques the existing regulations, which do not prohibit tactics involving privacy invasions or manipulation even though they undermine client autonomy—a key concern for the law of lawyer marketing.In addition to this descriptive and doctrinal work, the Article makes two other contributions. First, the examination of online behavioral advertising helps explain why the legal profession struggles to integrate new technological innovations more generally. AI tools and similar products are driven by informational capitalism’s focus on exploiting knowledge advantages, its speed, and its scale. But these features all are in tension with traditional aspects of the fiduciary relationship between lawyers and their clients. Second, as privacy scholars begin to think about how the duty of loyalty might provide a principle to limit abuses of Big Data in other contexts, the Article proposes that lawyers—who already have this duty—make good subjects for a case study

The Global Environmental Novel And The Politics Of Food

Consumption drives both global capitalism and the lives of literary texts, which may be consumed in two senses: they are purchased and they are read. Most literally, consumption means ingesting food. To consume is also to use environmental resources. In this dissertation, I scrutinize the entanglement of these several modes of consumption. I focus on food systems in an emergent literary genre, the “global environmental novel”: the contemporary novel that illuminates the intertwining of globalization and the environment. Such fictions come from both global South and North. I discuss contemporary authors from South Africa (Zakes Mda and Zoë Wicomb), South Asia (Amitav Ghosh and Arundhati Roy), and the US (Ruth Ozeki), as well as predecessors from South Asia (Tarashankar Bandyopadhyay) and Ghana (Ama Ata Aidoo). Operating at the intersection of postcolonial studies, environmental humanities, and food studies, I situate novels in relation to social movements that invoke food, globalization, and environment. I also engage with ecofeminism, queer theory, modernist studies, and theories of the contemporary novel. The project explores the multifaceted social and environmental injustices, as well as possibilities for resistance, that are encapsulated or indexed by food. Food politics, I argue, are key to the global environmental novel: both in the realist sense that environmental justice struggles cluster around food, and in informing novelistic strategies to manage the scalar challenges of globalization and global environment. Such mammoth objects provoke a representational crisis: how can we picture (let alone save) something as large as the globe? To resort to abstraction or generalization is to universalize, to flatten out the unevenness of contributions and vulnerabilities to environmental catastrophe among different populations. To instead keep local particularity present while representing globality, global environmental novels synthesize the polyscalar facility of narrative fiction with the polyscalar nature of food politics. Food is immediate, somatic, quotidian, and intimate. Eating cultures and food access are also key to community and cultural identity. And food systems are expressions of power under global capitalism. Resonating across all these scales, food politics are an avenue to global yet specific narratives of entanglement between globalization and the environment

Because these statutes were collected and edited, the collection is necessarily incomplete. The criteria and process used by the editors in selecting statutes of interest to our target audiences were thoughtfully conceived. A Gift We Can\u27t Keep Giving: An Analysis of the Prevalence and Consequence of Educators\u27 Unpaid Labor

Unpaid labor by educators is an important topic of social inquiry. With over half of all urban teachers leaving the profession within five years, it is of vital importance to examine the current U.S. educational system and take steps in minimizing the teacher burnout and attrition that is so costly to both students and the educational institutions. Most of the previous literature on unpaid labor focuses on domestic labor in the home rather than work performed by an employee above and beyond their ordinary contractual obligations - either by arriving early, staying late, or bringing work into the home. With over 7 million educators in the U.S., even small amounts of unpaid labor add up to very significant issues affecting the teachers, educational institutions, and the students. Education is among a class of occupations of human transformation where the work is, in principle, limitless. I am investigating a more effective method of measuring educators\u27 unpaid labor. National survey-based quantitative methods of measuring educators\u27 reported working hours have consistently underestimated the actual amount of unpaid labor being worked. I performed semi-structured interviews with a sample of primarily New York City educators to more accurately assess the actual amounts of labor that educators are performing unpaid. I also examined the motivations and justifications educators offered to explain the significant hours of labor worked unpaid each week. Using classical and neo-classical economic theory and Marxist political economic theory to frame the phenomenon of unpaid labor was not sufficient. The theoretical perspective of gift and gift giving proved more fruitful. Educators misrecognize employer-employee labor relationships as having elements of gift relationships and frequently discussed a sense of gratitude after having been hired to their teaching positions. Educators reciprocate this misrecognized gift of employment through their performance of unpaid labor to meet their professional obligations and administrations\u27 expectations. The gratitude reported by educators fades over time, hastened by the structural deficiencies in the U.S. educational system. When faced with such systemic obstacles and administrative and parental performance expectations, educators frequently rationalized their unpaid labor by invoking a standard of professionalism. However, the rates of burnout and attrition among educators call into question the limits of professionalism as a practice rather than as pure ideology. Increasing occupational requirements, decreasing institutional support, and recent media accounts characterizing teachers as entitled bureaucrats that are coasting off an out-dated tenure system are poisoning the gift of an educational career. This poisoned gift de-motivates educators and contributes to increasing teacher attrition, especially among less-experienced teachers in urban school systems. With a more complete understanding of the explanations, motivations, and rationalizations of unpaid educational labor it is possible to better address educators\u27 work conditions and overall educational policy to increase teacher retention and effectiveness
