    Can\u27t You Smell That Smell? Clean Air Act Fixes for Factory Farm Air Pollution

    Massive facilities that keep large numbers of livestock have overtaken small, independent farms as the primary source of meat, eggs, and dairy in the United States. These concentrated animal feeding operations ( CAFOs) compare more to industrial manufacturing operations than to traditional farms, and emit huge quantities of air pollutants that are harmful to public health, sickening people and damaging the environment. The Environmental Protection Agency ( EPA ) possesses statutorily provided tools under the Clean Air Act that it uses to regular other polluting industries. However, this article - after reviewing the rise of CAFOs, examining the threats they pose, and surveying current regulation - suggests that the EPA\u27s approach to CAFOs is grossly inadequate. The article argues that the agency, under the Clean Air Act, should regulate the emissions of hydrogen sulfide and ammonia, two pollutants for which factory farms are major sources. This approach is incomplete, however. Pollutant-based regulation is both overbroad in that it will regulate other sources of these pollutants and underbroad because CAFO air pollution includes more than just these pollutants. The EPA should therefore additionally or alternatively rely on a more thorough and flexible pollution source-specific tool, the New Source Performance Standards ( NSPS ). NSPS are analogous to the rigorous source-specific approach used to regulate CAFO water pollution under the Clean Water Act, and will provide a comprehensive antidote to the ills of modern, industrial animal agriculture

    Environmental Justice in Indian Country: Using Equity Assessments to Evaluate Impacts to Trust Resources, Watersheds and Eco-cultural Landscapes

    Native American cultures, genetics, nutrition, and ways of life co-evolved with their natural systems through thousands of years. This process has resulted in seamless eco-cultural systems of humans, plants, animals, rivers, landforms, and air sheds. These eco-cultural systems have also provided its peoples with unique and valid environmental management science that has sustained the peoples and their resources for thousands of years. This resource-based perspective could form the basis of environmental justice risk assessment methodology in Indian Country. Cumulative impacts to tribal cultures are a combination of pre-existing stressors (existing conditions or co-risk factors) and any other contamination or new activity that affects environmental quality. Characterizing risks or impacts in Indian Country entails telling the cumulative story about risks to trust resources and a cultural way of life. Equity assessments could also be performed in a way that describes these systems-level cumulative risks/impacts. This requires improvements in metrics based on an understanding of the unbreakable ties between people, their cultures, and their resources. Specific recommendations are presented for performing equity assessments in Indian Country and for developing a Risk Ethics discipline

    Evaluating health risks from occupational exposure to pesticides and the regulatory response.

    In this study, we used measurements of occupational exposures to pesticides in agriculture to evaluate health risks and analyzed how the federal regulatory program is addressing these risks. Dose estimates developed by the State of California from measured occupational exposures to 41 pesticides were compared to standard indices of acute toxicity (LD50) and chronic effects (reference dose). Lifetime cancer risks were estimated using cancer potencies. Estimated absorbed daily doses for mixers, loaders, and applicators of pesticides ranged from less than 0.0001% to 48% of the estimated human LD50 values, and doses for 10 of 40 pesticides exceeded 1% of the estimated human LD50 values. Estimated lifetime absorbed daily doses ranged from 0.1% to 114,000% of the reference doses developed by the U.S. Environmental Protection Agency, and doses for 13 of 25 pesticides were above them. Lifetime cancer risks ranged from 1 per million to 1700 per million, and estimates for 12 of 13 pesticides were above 1 per million. Similar results were obtained for field workers and flaggers. For the pesticides examined, exposures pose greater risks of chronic effects than acute effects. Exposure reduction measures, including use of closed mixing systems and personal protective equipment, significantly reduced exposures. Proposed regulations rely primarily on requirements for personal protective equipment and use restrictions to protect workers. Chronic health risks are not considered in setting these requirements. Reviews of pesticides by the federal pesticide regulatory program have had little effect on occupational risks. Policy strategies that offer immediate protection for workers and that are not dependent on extensive review of individual pesticides should be pursued
