    Clause-Type, Force, and Normative Judgment in the Semantics of Imperatives

    I argue that imperatives express contents that are both cognitively and semantically related to, but nevertheless distinct from, modal propositions. Imperatives, on this analysis, semantically encode features of planning that are modally specified. Uttering an imperative amounts to tokening this feature in discourse, and thereby proffering it for adoption by the audience. This analysis deals smoothly with the problems afflicting Portner's Dynamic Pragmatic account and Kaufmann's Modal account. It also suggests an appealing reorientation of clause-type theorizing, in which the cognitive act of updating on a typed sentence plays a central role in theorizing about both its semantics and role in discourse

    Inferential Expressivism and the Negation Problem

    We develop a novel solution to the negation version of the Frege-Geach problem by taking up recent insights from the bilateral programme in logic. Bilateralists derive the meaning of negation from a primitive *B-type* inconsistency involving the attitudes of assent and dissent. Some may demand an explanation of this inconsistency in simpler terms, but we argue that bilateralism’s assumptions are no less explanatory than those of *A-type* semantics that only require a single primitive attitude, but must stipulate inconsistency elsewhere. Based on these insights, we develop a version of B-type expressivism called *inferential expressivism*. This is a novel semantic framework that characterises meanings by inferential roles that define which *attitudes* one can *infer* from the use of terms. We apply this framework to normative vocabulary, thereby solving the Frege-Geach problem generally and comprehensively. Our account moreover includes a semantics for epistemic modals, thereby also explaining normative terms under epistemic modals

    Creationism and evolution

    In Tower of Babel, Robert Pennock wrote that “defenders of evolution would help their case immeasurably if they would reassure their audience that morality, purpose, and meaning are not lost by accepting the truth of evolution.” We first consider the thesis that the creationists’ movement exploits moral concerns to spread its ideas against the theory of evolution. We analyze their arguments and possible reasons why they are easily accepted. Creationists usually employ two contradictive strategies to expose the purported moral degradation that comes with accepting the theory of evolution. On the one hand they claim that evolutionary theory is immoral. On the other hand creationists think of evolutionary theory as amoral. Both objections come naturally in a monotheistic view. But we can find similar conclusions about the supposed moral aspects of evolution in non-religiously inspired discussions. Meanwhile, the creationism-evolution debate mainly focuses — understandably — on what constitutes good science. We consider the need for moral reassurance and analyze reassuring arguments from philosophers. Philosophers may stress that science does not prescribe and is therefore not immoral, but this reaction opens the door for the objection of amorality that evolution — as a naturalistic world view at least — supposedly endorses. We consider that the topic of morality and its relation to the acceptance of evolution may need more empirical research

    Discounting Credibility: Doubting the Stories of Women Survivors of Sexual Harassment

    For decades, federal and state laws have prohibited sexual harassment on the job; despite this fact, extraordinarily high rates of gender-based workplace harassment still permeate virtually every sector of the American workforce. Public awareness of the seriousness and scope of the problem increased astronomically in the wake of the #MeToo movement, as women began to publicly share countless stories of harassment and abuse. In 2015, the Equal Employment Opportunity Commission’s Task Force on the Study of Harassment in the Workplace published an important study analyzing a wide range of factors contributing to this phenomenon. But the study devotes only limited attention to a factor that goes straight to the heart of the problem: our reflexive inclination to discount the credibility of women, especially when those women are recounting experiences of abuse perpetrated by more powerful men. We will not succeed in ending gender-based workplace discrimination until we can understand and resist this tendency and begin to appropriately credit survivors’ stories. How does gender-based credibility discounting operate? First, those charged with responding to workplace harassment--managers, supervisors, union representatives, human resource officers, and judges—improperly discount as implausible women’s stories of harassment, due to a failure to understand either the psychological trauma caused by abusive treatment or the practical realities that constrain women’s options in its aftermath. Second, gatekeepers unjustly discount women’s personal trustworthiness, based on their demeanor (as affected by the trauma they often have suffered); on negative cultural stereotypes about women’s motives for seeking redress for harms; and on our deep-rooted cultural belief that women as a group are inherently less than fully trustworthy. The impact of such unjust and discriminatory treatment of women survivors of workplace harassment is exacerbated by the larger “credibility economy”—the credibility discounts imposed on many women-victims can only be fully understood in the context of the credibility inflations afforded to many male harassers. Moreover, discounting women’s credibility results in a particular and virulent set of harms, which can be measured as both an additional psychic injury to survivors, and as an institutional betrayal that echoes the harm initially inflicted by harassers themselves. It is time—long past time--to adopt practical, concrete reforms to combat the widespread, automatic tendency to discount women and the stories they tell. We must embark on a path toward allowing women who share their experiences of male abuses of workplace power to trust the responsiveness of their employers, judges, and our larger society

    A Default-Logic Paradigm for Legal Reasoning and Factfinding

    Unlike research in linguistics and artificial intelligence, legal research has not used advances in logical theory very effectively. This article uses default logic to develop a paradigm for analyzing all aspects of legal reasoning, including factfinding. The article provides a formal model that integrates legal rules and policies with the evaluation of both expert and non-expert evidence – whether the reasoning occurs in courts or administrative agencies, and whether in domestic, foreign, or international legal systems. This paradigm can standardize the representation of legal reasoning, guide empirical research into the dynamics of such reasoning, and put the representations and research results to immediate use through artificial intelligence software. This new model therefore has the potential to transform legal practice and legal education, as well as legal theory

    Legal Transitions: Some Welfarist Remarks

    This essay offers a sympathetic, utilitarian critique of Louis Kaplow\u27s famous argument for legal retroactivity in his 1986 article, An Economic Analysis of Legal Transitions. The argument, very roughly, is that the prospect of retroactivity is desirable if citizens are rational because it gives them a desirable incentive to anticipate legal change. My central claim is that this argument trades upon a dubious, objective view of probability that assumes rational citizens assign the same probabilities to states as rational governmental officials. But it is subjective, not objective probabilities that bear on rational choice, and the subjective probabilities of rational citizens can diverge from rational officials\u27. I imagine a simple case in which a single Social Planner structures both transition policy and substantive law in some domain. The legal change that the Planner anticipates she would enact in response to a given set of events, and the legal change that the Planner believes one or another citizen believes she (the Planner) will enact in response to those events, can differ. And this means, in turn, that there can be incentive costs to a retroactivity regime as well as a prospectivity regime, even if all actors are fully rational. The utilitarian case for retroactivity is more contingent than Kaplow thinks

    The LIOn's share: How the Liberal International Order Contributes to its Own Legitimacy Crisis. Harvard CES Open Forum Series2019-2020

    The liberal international order (LIO) is experiencing a legitimacy crisis in its Western heartland. What causes this crisis? Existing approaches focus on the LIO’s unequal allocation of wealth and values that produces losers and thus breeds dissatisfaction. Yet, why this dissatisfaction translates into a delegitimation of the order rather than a contestation over policies remains unaccounted for. Complementing the cultural and economic backlash hypotheses, this paper advances an institutionalist explanationfor the current crisis of the LIO, which accounts for the growing resistance to the LIO with a political backlash hypothesis. Our argument is that the institutional characteristics of the LIO’s political order trigger self-undermining processes by inciting opposition that cannot be politically accommodated and is thus bound to turn into polity contestation. In particular, we hold that IOs’ predominantly technocratic legitimation rationale on the one hand, and their increasing political authority with distributional effects on the other, create a democracy gap. It implies that avenues to absorb opposition through input channels are largely missing and thus incite the erosion of the LIO’s general acceptance. We illustrate the plausibility of this argument with evidence from the European Union (EU) as well as the international regimes on trade and human rights
