    Scaling Up Deliberative Democracy as Dispute Resolution in Healthcare Reform: A Work in Progress

    Simultaneous Localisation and Mapping (SLAM) denotes the problem of jointly localizing a moving platform and mapping the environment. This work studies the SLAM problem using a combination of inertial sensors, measuring the platform's accelerations and angular velocities, and a monocular camera observing the environment. We formulate the SLAM problem on a nonlinear least squares (NLS) batch form, whose solution provides a smoothed estimate of the motion and map. The NLS problem is highly nonconvex in practice, so a good initial estimate is required. We propose a multi-stage iterative procedure, that utilises the fact that the SLAM problem is linear if the platform's rotations are known. The map is initialised with camera feature detections only, by utilising feature tracking and clustering of  feature tracks. In this way, loop closures are automatically detected. The initialization method and subsequent NLS refinement is demonstrated on both simulated and real data

    New Prospects for Organizational Democracy? How the Joint Pursuit of Social and Financial Goals Challenges Traditional Organizational Designs

    Some interesting exceptions notwithstanding, the traditional logic of economic efficiency has long favored hierarchical forms of organization and disfavored democracy in business. What does the balance of arguments look like, however, when values besides efficient revenue production are brought into the picture? The question is not hypothetical: In recent years, an ever increasing number of corporations have developed and adopted socially responsible behaviors, thereby hybridizing aspects of corporate businesses and social organizations. We argue that the joint pursuit of financial and social objectives warrants significant rethinking of organizational democracy’s merits compared both to hierarchy and to non-democratic alternatives to hierarchy. In making this argument, we draw on an extensive literature review to document the relative lack of substantive discussion of organizational democracy since 1960. And we draw lessons from political theory, suggesting that the success of political democracy in integrating diverse values offers some grounds for asserting parallel virtues in the business case

    Ethics and OR: Operationalising Discourse Ethics

    Operational researchers help managers decide what they ought to do and yet this is generally evaluated in terms of efficiency or effectiveness, not ethicality. However, the combination of the tremendous power of global corporations and the financial markets, and the problems the world faces in terms of economic and environmental sustainability, has led to a revival of interest in ethical approaches. This paper explores a relatively recent and innovative process called discourse ethics. This is very different from traditional ethical systems in taking ethical decisions away from individuals or committees and putting them in the hands of the actual people who are involved and affected through processes of debate and deliberation. The paper demonstrates that discourse ethics has strong connections to OR, especially in the areas of soft and critical systems, and that OR can actually contribute to the practical operationalisation of discourse ethics. At the same time, discourse ethics can provide a rigorous discursive framework for “ethics beyond the model"

    Democratizing deliberative systems

    A co-original approach towards law-making in the internet age

    There is an increasing interest in incorporating significant citizen participation into the law-making process by developing the use of the internet in the public sphere. However, no well-accepted e-participation model has prevailed. This article points out that, to be successful, we need critical reflection of legal theory and we also need further institutional construction based on the theoretical reflection. Contemporary dominant legal theories demonstrate too strong an internal legal point of view to empower the informal, social normative development on the internet. Regardless of whether we see the law as a body of rules or principles, the social aspect is always part of people’s background and attracts little attention. In this article, it is advocated that the procedural legal paradigm advanced by Jürgen Habermas represents an important breakthrough in this regard. Further, Habermas’s co-originality thesis reveals a neglected internal relationship between public autonomy and private autonomy. I believe the co-originality theory provides the essential basis on which a connecting infrastructure between the legal and the social could be developed. In terms of the development of the internet to include the public sphere, co-originality can also help us direct the emphasis on the formation of public opinion away from the national legislative level towards the local level; that is, the network of governance.1 This article is divided into two sections. The focus of Part One is to reconstruct the co-originality thesis (section 2, 3). This paper uses the application of discourse in the adjudication theory of Habermas as an example. It argues that Habermas would be more coherent, in terms of his insistence on real communication in his discourse theory, if he allowed his judges to initiate improved interaction with the society. This change is essential if the internal connection between public autonomy and private autonomy in the sense of court adjudication is to be truly enabled. In order to demonstrate such improved co-original relationships, the empowering character of the state-made law is instrumental in initiating the mobilization of legal intermediaries, both individual and institutional. A mutually enhanced relationship is thus formed; between the formal, official organization and its governance counterpart aided by its associated ‘local’ public sphere. Referring to Susan Sturm, the Harris v Forklift Systems Inc. (1930) decision of the Supreme Court of the United States in the field of sexual harassment is used as an example. Using only one institutional example to illustrate how the co-originality thesis can be improved is not sufficient to rebuild the thesis but this is as much as can be achieved in this article. In Part Two, the paper examines, still at the institutional level, how Sturm develops an overlooked sense of impartiality, especially in the derivation of social norms; i.e. multi-partiality instead of neutral detachment (section 4). These two ideas should be combined as the criterion for impartiality to evaluate the legitimacy of the joint decision-making processes of both the formal official organization and ‘local’ public sphere. Sturm’s emphasis on the deployment of intermediaries, both institutional and individual, can also enlighten the discourse theory. Intermediaries are essential for connecting the disassociated social networks, especially when a breakdown of communication occurs due to a lack of data, information, knowledge, or disparity of value orientation, all of which can affect social networks. If intermediaries are used, further communication will not be blocked as a result of the lack of critical data, information, knowledge or misunderstandings due to disparity of value orientation or other causes. The institutional impact of the newly constructed co-originality thesis is also discussed in Part Two. Landwehr’s work on institutional design and assessment for deliberative interaction is first discussed. This article concludes with an indication of how the ‘local’ public sphere, through e-rulemaking or online dispute resolution, for example, can be constructed in light of the discussion of this article

    How and why deliberative democracy enables co-intelligence and brings wisdom to governance

    Over the past decade, state and local governments throughout Australia have focused on how to improve community consultation. Government consultation processes, regulated with the best of intentions to involve the public, have come under heavy criticism as being DEAD (Decide, Educate, Announce and Defend). It has become apparent that the problem community consultation was supposed to fix – including the voice of the community in developing policy and plans – has remained problematic. Worse, the fix has often backfired. Rather than achieving community engagement, consultation has frequently resulted in the unintended consequence of community frustration and anger at tokenism and increased citizen disaffection. Traditional community consultation has become a “fix that failed”, resulting in a “vicious cycle” of ever-decreasing social capital1 (Hartz-Karp 2002). Ordinary citizens are less and less interested in participating, evidenced by the generally low turn-out at government community consultation initiatives. When the community does attend in larger numbers, it is most often because the issue has already sparked community outrage, inspiring those with local interests to attend and protest. In their endeavour to change this situation, government agencies have created and disseminated ‘how to’ community consultation manuals, conducted conferences and run training sessions for staff. Issues of focus have included project planning, risk analysis, stakeholder mapping, economic analysis, value assurance, standardisation and so forth. Implementation models have illustrated a desired shift from informing, educating and gaining input from citizens, to collaboration, empowerment and delegated decision-making. Although new engagement techniques have been outlined, it has not been clarified how agencies can achieve such a radical change from eliciting community input to collaborative decision-making. Regardless, to reassure the public that improvements have been made, community consultation has been ‘re-badged’ to ‘community engagement’. A new vocabulary has developed around this nomenclature. However, the community has remained unconvinced that anything much has changed. The question is: Why hasn’t the community accepted these efforts with enthusiasm? The most optimistic response is that there will be a lag time between the announcement of improvements and actual improvements, and an even longer time lag between seeing the results and a resumption of the community’s trust in government. The more pessimistic response (one that also has resonance with many public sector staff) is that in essence, not a lot has changed. The ‘re-badging’ and management improvements have not resulted in the public feeling more engaged or empowered

    Representation through deliberation-The European case

    This article shows that the main pattern of European democratization has unfolded along the lines of an EU organized as a multilevel system of representative parliamentary government and not as a system of deliberative governance as the transnationalists propound. But the multilevel EU has developed a structure of representation that is theoretically challenging. In order to come to grips with this we present an institutional variant of deliberative theory, which understands democracy as the combination of a principle of justification and an organizational form. It comes with the following explanatory mechanisms: claimsmaking, justification and learning which in the EU also program institutional copying and emulation mechanisms. We show that the EU has established an incomplete system of representative democracy steeped in a distinct representation-deliberation interface, which has emerged through a particular and distinct configuration of democratization mechanisms

    Responsible Innovation for Decent Nonliberal Peoples: A Dilemma?

    It is hard to disagree with the idea of responsible innovation (henceforth, RI), as it enables policy-makers, scientists, technology developers, and the public to better understand and respond to the social, ethical, and policy challenges raised by new and emerging technologies. RI has gained prominence in policy agenda in Europe and the United States over the last few years. And, along with its rising importance in policy-making, there is also a burgeoning research literature on the topic. Given the historical context of which RI emerges, it should not be surprising that the current discourse on RI is predominantly based on liberal democratic values. Yet, the bias towards liberal democratic values will inevitably limit the discussion of RI, especially in the cases where liberal democratic values are not taken for granted. As such, there is an urgent need to return to the normative foundation of RI, and to explore the notion of ‘responsible innovation’ from nonliberal democratic perspectives. Against this background, this paper seeks to demonstrate the problematic consequences of RI solely grounded on or justified by liberal democratic values. This paper will cast the argument in the form of a dilemma to be labelled as The Decent Nonliberal Peoples’ Dilemma and use it to illustrate the problems of the Western bias

    Democracy and Legitimacy in the European Union Revisited - Input, Output and Throughput

    Whether their analytic frameworks focus on institutional form and practices or on its interactive construction, scholars have analyzed the EU’s democratic legitimacy mainly in terms of the trade-offs between the output effectiveness of EU’s policies outcomes for the people and the input participation by and representation of the people. Missing is theorization of the throughput efficiency, accountability, transparency, and openness to consultation with the people of the EU’s internal governance processes. The paper argues that adding this analytic category facilitates assessment of these legitimizing mechanisms’ interdependencies and facilitates consideration of reforms that could turn this democratic trilemma into a virtuous circle.democracy; legitimacy; Europeanization; Europeanization
