    Organization theory and military metaphor: time for a reappraisal?

    A ‘conventional’ use of military metaphor would use it to convey attributes such as hierarchical organization, vertical communication and limited autonomy. This is often used in contrast to a looser form of organization based on the metaphor of the network. However, this article argues that military practice is more complex, with examples of considerable autonomy within the constraints of central direction. It is suggested that not only might this be a more useful metaphor for many contemporary organizations, but also that simplistic uses of military metaphor divert our attention away from the functions that management hierarchies play. The discussion is embedded within a critical realist account of metaphor, arguing for both its value and the need for its further development

    The impact of women’s lives and experiences on the law forms an essential part of the feminist legal movement. This article evaluates the existence of feminist ideologies in a hitherto unexplored area of the law, namely insolvency law and more specifically insolvency theory. Some main ideologies of the feminist movement are identified and contrasted with the views of the main insolvency theories. It aims to establish whether insolvency theories may also be categorised in relation to ideologies expressed in feminist legal theory

    Constructing 'the anti-globalisation movement'

    This article interrogates the claim that a transnational anti-globalisation social movement has emerged. I draw on constructivist social movement theory, globalisation studies, feminist praxis and activist websites to make two main arguments, mapping on to the two parts of the article. First, a movement has indeed emerged, albeit in a highly contested and complex form with activists, opponents and commentators constructing competing movement identities. This article is itself complicit in such a process – and seeks to further a particular construction of the movement as a site of radical-democratic politics. Second, the movement is not anti-globalisation in any straightforward sense. Focusing their opposition on globalised neoliberalism and corporate power, activists represent their movement either as anti-capitalist or as constructing alternative kinds of globalised relationships. Threading through both my arguments is a normative plea to confront the diverse relations of power involved in both globalisation and movement construction in order that globalised solidarities be truly democratic. This is to challenge hierarchical visions of how best to construct ‘the anti-globalisation movement’

    Cultural Paradigms in Property Institutions

    Do “cultural factors” substantively influence the creation and evolution of property institutions? For the past several decades, few legal scholars have answered affirmatively. Those inclined towards a law and economics methodology tend to see property institutions as the outcome of self-interested and utilitarian bargaining, and therefore often question the analytical usefulness of “culture.” The major emerging alternative, a progressive literature that emphasizes the social embeddedness of property institutions and individuals, is theoretically more accommodating of cultural analysis but has done very little of it. This Article develops a “cultural” theory of how property institutions are created and demonstrates that such a theory is particularly powerful in explaining large-scale institutional differences between societies. Empirically, it argues that, in the two centuries before large-scale industrialization, China, England, and Japan displayed systematic and fundamental differences in their regulation of property use and transfer. It further argues that these legal and institutional differences are best explained by certain aspects of social culture, specifically by the criteria for sociopolitical status distribution. Some of these criteria are distinctly “cultural” in the sense that they were probably generated by the widespread social internalization of moral values, rather than by utilitarian bargaining. Cultural paradigms can exist, therefore, in property institutions. If we assume, as conventional law and economics urges, that individuals generally approach property use and regulation through a self-interested and utilitarian mindset, their pursuit of personal utility can nonetheless be constrained or empowered by cultural norms of status distribution that determine their relative bargaining power

    Over the last decades, network-based approaches have become highly popular in diverse fields of biology, including neuroscience, ecology, molecular biology and genetics. While these approaches continue to grow very rapidly, some of their conceptual and methodological aspects still require a programmatic foundation. This challenge particularly concerns the question of whether a generalized account of explanatory, organisational and descriptive levels of networks can be applied universally across biological sciences. To this end, this highly interdisciplinary theme issue focuses on the definition, motivation and application of key concepts in biological network science, such as explanatory power of distinctively network explanations, network levels, and network hierarchies

    Consistency in Organization

    Internal organization relies heavily on psychological consistency requirements. This perspective has been emphasized in modern compensation theory, but has not been extended to organization theory. The idea is developed by starting from Williamson's discussion of idiosyncratic exchange. The perspective sheds new light on several topics in the theory of the firm, like the boundaries of the firm (“Williamson's puzzle”), the importance of fairness concerns within firms, the attenuation of incentives, or the role of routines. It implies a “perceptional” theory of the firm that is “realistic” in the sense advocated by Coase (1937)
