    Cotton, Clemency, and Control: United States v. Klein and the Juridical Legacy of Executive Pardon

    When the guns of war fell silent in 1865, Americans throughout the reunited states grappled with the logistics of peace. At virtually every turn lay nebulous but critical questions of race, class, allegiance, and identity. More pragmatic legal stumbling blocks could also be found strewn across the path to Reconstruction; some of them would ensnare the healing nation for decades to come. Among their number was notorious Supreme Court decision United States v. Klein (1872). Born on July 22, 1865 out of a small debate over the wartime seizure of Vicksburg cotton stores, Klein quickly evolved into a legal behemoth. In its tangles with the separation of powers, the presidential power of pardon, and the supremacy of the executive in judicial matters, United States v. Klein would ultimately amount to the very poster child of the snowball effect at work in Reconstruction law. Widely forgotten or overlooked today, the decision of United States v. Klein nonetheless stands as one of the most crucial battles of the American Civil War era

    Competition and Financial Stability in European Cooperative Banks

    Cooperative banks are a driving force for socially committed business at the local level, accounting for around one fifth of the European Union (EU) bank deposits and loans. Despite their importance, little is known about the relationship between bank stability and competition for these small credit institutions. Does competition affect the stability of cooperative banks? Does the financial stability of banks increase/decrease when competition is higher? We assess the dynamic relationship between competition and bank soundness (both in the short and long run) among European cooperative banks between 1998 and 2009. We obtain three main results. First, we provide evidence in line with the competition-stability view proposed by Boyd and De Nicolò (2005). Bank market power negatively “Granger-causes” banks’soundness, meaning that there is a positive relationship between competition and stability. Second, we find that this fundamental relationship does not change during the 2007–2009 financial crisis. Third, we show that increased homogeneity in the cooperative banking sector positively affects bank soundness. Our findings have important policy implications for designing and implementing regulations that enhance the overall stability of the financial system and in particular of the cooperative banking sector

    The effect of transmucosal 0.2mg/kg Midazolam premedication on dental anxiety, anaesthetic induction and psychological morbidity in children undergoing general anaesthesia for tooth extraction

    <b>Background:</b> The project aims were to evaluate the benefit of transmucosal Midazolam 0.2mg/kg pre-medication on anxiety, induction behaviour and psychological morbidity in children undergoing general anaesthesia (GA) extractions. <b>Method:</b> 179 children aged 5-10 years (mean 6.53 years) participated in this randomised, double blind, placebo controlled trial. Ninety children had Midazolam placed in the buccal pouch. Dental anxiety was recorded pre operatively and 48 hours later using a child reported MCDAS-FIS scale. Behaviour at anaesthetic induction was recorded and psychological morbidity was scored by the parent using the Rutter Scale pre-operatively and again one-week later. Subsequent dental attendance was recorded at one, three and six months after GA. <b>Results:</b> Whilst levels of mental anxiety did not reduce overall, the most anxious patients demonstrated a reduction in anxiety after receiving midazolam premedicationmay (p=0.01). Neither induction behaviour nor psychological morbidity improved. Irrespective of group, parents reported less hyperactive (p= 0.002) and more prosocial behaviour (p=0.002) after the procedure:;, older children improved most (p=0.048), Post GA Dental attendance was poor and unrelated to after the procedure and unaffected by premedication. <b>Conclusion:</b> 0.2mg/kg buccal Midazolam provided some evidence for reducing anxiety in the most dentally anxious patients. However, induction behaviour, psychological morbidity and subsequent dental attendance were not found to alter between the premedication groups

    In Pfaff v. Wells Electronics, Inc., the Supreme Court established a two-part test to determine when an invention is on sale for purposes of Title 35 U.S.C. §102(b). In addition to being the subject of a commercial offer for sale, an invention must be ready for patenting in order to be considered on sale. Since Pfaff, the Court of Appeals for the Federal Circuit has had numerous opportunities to expound upon how inventors can fulfill the latter condition.     Mutation Testing as a Safety Net for Test Code Refactoring

    Refactoring is an activity that improves the internal structure of the code without altering its external behavior. When performed on the production code, the tests can be used to verify that the external behavior of the production code is preserved. However, when the refactoring is performed on test code, there is no safety net that assures that the external behavior of the test code is preserved. In this paper, we propose to adopt mutation testing as a means to verify if the behavior of the test code is preserved after refactoring. Moreover, we also show how this approach can be used to identify the part of the test code which is improperly refactored

    Shared talent: an exploration of the potential of the 'Shared Talent' collaborative and hands on educational experience for enhanced learning around sustainability in fashion practice

    Shared Talent is a fashion for sustainability framework, developed by Dilys Williams to facilitate a means for fashion designers to exchange expertise with other protagonists across the supply chain, transcending traditional divisions, be they linguistic, geographic, or discipline based. In 2009, Shared Talent India brought together a diverse group of like-minded designers to share their ideas about fashion, challenge their motivations as designers, and question how they create collections. Equipped with research carried out through Shared Talent 1 and 2, and geographically specific research in a number of locations across India, their collaborative concepts were realised with beautiful results. Through partnership between Defra’s led Sustainable Clothing Roadmap and the Indian Government under the UK:India Sustainable Development Dialogue, Shared Talent India explored and shared knowledge on sustainable design practice with established and emerging designers, makers and NGOs. Participants included twelve designers, based both in the UK and India, suppliers and communities of Indian textile producers, buyers and undergraduates from London College of Fashion, Pearl Academy of Fashion Delhi, and Amsterdam Fashion Institute. The research outcomes aim to innovate towards improved ecological, ethical and cultural criteria in selecting and creating collections, and a means to connect designers and buyers to more sustainable textiles in India. Outputs are available as an open-source online resource to help fashion designers, researchers, students, entrepreneurs and businesses to establish strategies for sourcing sustainability from India; the resource is a culmination of the collaboration and includes contribution by key project team members, project managed by Alex McIntosh and led by Dilys Williams

    This feasibility study looks at how community supported agriculture (CSA) can help in the development of local and sustainable food economies. It investigates community involvement in farming around the globe and in a number of established and planned CSA initiatives in England. Eleven case studies provide the basis of discussion, along with relevant policy recommendations and areas for future research. The benefits of CSA include a more secure income and higher returns for farmers. Consumers have access to fresh food from an accountable source with an opportunity to reconnect with the land and influence the landscape they live in. CSA delivers environmental benefits of fewer food miles, less packaging and ecologically sensitive farming and sees the return of local distinctiveness and regional food production with higher employment, more local processing, local consumption and circulation of money in the community enhancing local economies

    Understanding requirements engineering process: a challenge for practice and education

    Reviews of the state of the professional practice in Requirements Engineering (RE) stress that the RE process is both complex and hard to describe, and suggest there is a significant difference between competent and "approved" practice. "Approved" practice is reflected by (in all likelihood, in fact, has its genesis in) RE education, so that the knowledge and skills taught to students do not match the knowledge and skills required and applied by competent practitioners. A new understanding of the RE process has emerged from our recent study. RE is revealed as inherently creative, involving cycles of building and major reconstruction of the models developed, significantly different from the systematic and smoothly incremental process generally described in the literature. The process is better characterised as highly creative, opportunistic and insight driven. This mismatch between approved and actual practice provides a challenge to RE education - RE requires insight and creativity as well as technical knowledge. Traditional learning models applied to RE focus, however, on notation and prescribed processes acquired through repetition. We argue that traditional learning models fail to support the learning required for RE and propose both a new model based on cognitive flexibility and a framework for RE education to support this model
