    IMPACT OF THE 2002 BIOTERRORISM ACT ON THE NEW JERSEY FOOD INDUSTRY

    This paper provides an overview of the four key sections of the Public Health Security and Bioterrorism Preparedness and Response Act of 2002, with regard to Administrative Detention (Section 303), Facilities Registration (Section 305), Records and Maintenance (Section 306), and Prior Notice of Food Imports (Section 307). The potential impacts of the Bioterrorism Act on the food industry are examined through qualitative analysis of industry submissions to the Food and Drug Administration (FDA) docket for each provision, and quantitatively through survey results, which were administered online by the Food Institute (FI) of Woodbridge, NJ and analyzed by Rutgers, Food Policy Institute (FPI). Of the four key sections from the Bioterrorism Act that most affect the food industry, stakeholders were surveyed on two sections, Prior notice of Food Imports and Facilities Registration. While survey responses reveal that many food firms are aware of pending Bioterrorism Act policies, few however, have taken action towards compliance. Facilities registration is touted as the least cumbersome in terms of compliance. Results indicate that 50 percent of food industry professionals surveyed were not aware that many food firms must register with the FDA by the 12 December 2003 deadline; and, 20 percent, while aware of the facilities registration deadline, have done nothing to prepare. Being unprepared for and subsequently complying with Bioterrorism Act rules is an overarching concern, which is apparent in both the survey results and docket summaries. Moreover, upon review of docket submissions to the FDA, it seems that food firms are generally sympathetic towards the need for increased food system security; however, the impact of the Bioterrorism Act can be both daunting and costly.     The Bioterrorism Act of the USA and international food trade: Evaluating WTO conformity and effects on bilateral imports

    The September 11th event focused the world's attention on the threat of bioterrorism to the food chain. As a consequence, the U.S. implemented the Bioterrorism Act (BTA). These new administrative import rules will be evaluated regarding WTO conformity and trade impact. This analysis is based on an inventory approach systematizing the BTA, and a trade flow analysis. The BTA do not significantly deviate from WTO rules, however, the findings are driven by existing flexibility in international administrative import guidelines.     Maize is the most widely grown crop in the United States. The crop has a variety of applications being used for food, fuel, and in some industries. Maize is heavily integrated into the fabric of billions of lives across the world. The United States has encouraged the growth of a massive maize monoculture through the usage of government subsidies. However, this presents issues for the United States since it has created a large monoculture that is threatened by natural disasters, pest infestation, and bioterrorism attacks. Additionally, the cheap nature of the monoculture has additional externalities. Examples include decimated maize production in Mexico, Central America, and developing countries, which has led to dependence on the United States crop and decreasing international food security

    The Bioterrorism Act of the USA and international food trade: evaluating WTO conformity and effects on bilateral imports

    The September 11th event focused the world’s attention on the threat of bioterrorism on the food chain. As a consequence, the USA implemented the Bioterrorism Act (BTA) containing new import requirements that can be classified as non-tariff barriers (NTBs). This paper analyses these NTBs by performing an assessment of WTO conformity and trade impact: hereby general problems in the analysis of bioterrorist risks are explored as for this new and unknown threat explicit WTO rules are still missing. Additionally, in exploring the BTA relevant process standard rules laid out by the WTO, the analysis indicates the extensive flexibility provided in this framework. This leads to larger scope for national polices on process standards compared to product standards (e.g. residua levels). The empirical trade flow analysis illustrates differences in the compliance costs between countries. This differentiation can be caused by learning costs that may differ among countries.     Due to the dynamic nature of human conflict, non-traditional terror tactics have evolved to undermine the socioeconomic stability of targeted societies. Considering the landscape in which terrorists operate, emphasis on more subversive methods of biological terror have become prominent in recent decades. Agroterrorism, or the use of plant pathogens to infect a nation’s cultivated crops, is an emerging topic due to its threat to global food security and economic stability. Although emergency preparedness objectives have been enacted at national, state, and even local levels, preemptive measures can no longer remain the sole responsibility of intelligence and law enforcement agencies. The agricultural and scientific communities are responsible for collaboration to improve security and pioneer new methods of disease resistance in susceptible crops. Plant immunology is an expanding field which explores the molecular defense mechanisms innately present within the plant kingdom and provides insight concerning novel methods of boosting the immunity of susceptible crops to existing and emerging pathogenic agents. This thesis serves to define the threat of agroterrorism from a national security and scientific perspective, identify notable plant pathogens, provide a brief survey of plant immunology, and discuss topics which can aid scientists, policymakers, and growers in efforts to secure the global food supply from those who would cause harm

    Agro-terrorism and the Grain Handling Systems in Canada and the United States

    The grain handling sector in Canada and the United States is vital to agriculture and trade. In a typical year on the Canadian prairies, about 140,000 producers deliver some 20 to 30 mmt of grain for export to primary elevators. In the United States, about 2.1 million producers deliver about 300 mmt of grain to primary elevators. Canadian grain is moved to export position using more than 400,000 hopper cars and marine containers, where about 1,200 ships per year are loaded. In the United States, about 1.08 million rail carloads of grain are originated per year, and about 23 mmt of grain are shipped on barges per year. These U.S. figures are in addition to trucks, which, more so than in Canada, are also used to deliver grain to primary processors and to terminal and export markets. The volume of grain trade gives rise to concern about risks of terrorism in the sector.(1) From a security perspective, the grain, pulse and oilseed supply chain is noteworthy because much of it is characterized by relatively long-term, insecure, bulky storage (particularly on farms) along with numerous modal and inter-modal product transfers. These factors suggest there are many places where chemical or biological contaminants could be introduced into this supply chain. From the perspective of the United States, security throughout the Canadian system as well as the U.S. system is a concern, since cross-border traffic in these products is significant, with an average of about six million tonnes of grain products alone imported into the U.S. each year (USDA-FAS, 2003). Numerous interventions to enhance food safety and mitigate the risk of terrorism have been adopted or are in the process of being developed. Some of these are private initiatives and voluntary, as a component of firm-level security processes. Others are being adopted in response to legislated initiatives.     NATIONAL SECURITY AND BIOTERRORISM: A U.S. PERSPECTIVE

    My purpose is to consider how the events of September 11, 2001 have changed how we think about the world food system and the possibilities for agro-bioterrorism. I will divide them into three categories: direct threats to the world food system from agro-bioterrorism; market and development assistance disruptions arising from terrorist and anti-terrorist activity; and broader and longer term shifts in the political economy of international agriculture due to the emergence of a recognized global terrorist threat. I conclude that agro-bioterrorism is a real threat, but more to markets than to human health. Moreover, responses to this threat are likely to reinforce ongoing improvements in food inspection, identity preservation, and safety measures.Food Consumption/Nutrition/Food Safety,
