    Encouraging Corporate Innovation for Our Homeland During the Best of Times for the Worst of Times: Extending Safety Act Protections to Natural Disasters’

    This article first analyzes the innovative tort reform of the SAFETY Act and then argues for expansion of SAFETY Act type risk protection to natural disasters such as hurricanes, earthquakes and wildfires. The SAFETY Act was drafted to stimulate the development and deployment of technologies that combat terrorism by providing liability protection. Applying the same type of legislation to natural disasters will provide a commensurate benefit of encouraging preparedness and development of technologies that could mitigate harms resulting from natural disasters. The Department of Homeland Security voiced a desire to increase the use of the SAFETY Act by private industry. This article argues that one way to increase the utility of the SAFETY Act and provide more value for the American public is for Congress to extend SAFETY Act protections, by amendment or new legislation, to cover risk related to national catastrophes

    A comparison of the domestic satellite communications forecast to the year 2000

    The methodologies and results of three NASA-sponsored market demand assessment studies are presented and compared. Forecasts of future satellite addressable traffic (both trunking and customer premises services) were developed for the three main service categories of voice, data and video and subcategories thereof for the benchmark years of 1980, 1990 and 2000. The contractor results are presented on a service by service basis in two formats: equivalent 36 MHz transponders and basic transmission units (voice: half-voice circuits, data: megabits per second and video: video channels). It is shown that while considerable differences exist at the service category level, the overall forecasts by the two contractors are quite similar. ITT estimates the total potential satellite market to be 3594 transponders in the year 2000 with data service comprising 54 percent of this total. The WU outlook for the same time period is 2779 transponders with voice services accounting for 66 percent of the total

    Construction costs and value management: study of multinational practices in Nigeria

    The practice of multinational construction corporations (MCC) in Nigeria construction industry has been viewed as a value for money approach through construction cost management. Assessment of the opportunity cost of the initiatives is equally important in order to gauge the progress of millennium development goals (MDGs), set up by the United Nations in 2000 on human development in developing countries. The study is aimed at the evaluation of current infrastructure procurement framework, introducing novel sustainable infrastructure delivery (SID) model as a holistic value management methodology and a decision making technique. Key components of the model are Checkland’s soft system methodology (SSM) and analytic network process (ANP) by Saaty. SID input data is collected from the pilot questionnaire with the professionals in Nigeria’s construction industry, reinforced by a thorough literature review. Questions sought paired comparison judgements on key aspects of project management and implications on sustainable infrastructure procurement. The concept is discussed in the methodology section. Preliminary findings reveal that current practice lacks a holistic decision making technique, reflected in divergent value interests among stakeholders on infrastructure procurement through different views on the constitution of values. Though there is practical evidence regarding the growth in the construction sector, quantification of the implications on local economy and human development are less visible and require further investigations

    Performance-Based Specifications: Exploring When They Work and Why

    There is extensive research and attention on innovation and sustainable public procurement (SPP) in the European Union at present, with the 2014 revision of the Procurement Directives, the Innovation Union strategy and other European Union policy initiatives. This report seeks to contribute to this discussion through the investigation of the use of performance based specifications (PBSs) in public procurement in the European Union and the United States. The report outlines the benefits and limitations of the use of PBSs, even in the most "progressive" public procurement environments, such as the Netherlands, particularly around their ability to support sustainable development goals and deliver environmental benefits for a procuring authority, such as energy and resource efficiency. Additionally, this report aims to identify the sectors in which the enabling conditions for the successful use of PBSs in public procurement are in place and to understand what policies and regulations are needed to promote the use of PBSs in public tenders and public procurement framework agreements

    Mapping the Australian Regulatory Environment: Implications for Construction Firms

    As regulators, governments are often criticised for over‐regulating industries. This research project seeks to examine the regulation affecting the construction industry in a federal system of government. It uses a case study of the Australian system of government to focus on the question of the implications of regulation in the construction industry. Having established the extent of the regulatory environment, the research project considers the costs associated with this environment. Consequently, ways in which the regulatory burden on industry can be reduced are evaluated. The Construction Industry Business Environment project is working with industry and government agencies to improve regulatory harmonisation in Australia, and thereby reduce the regulatory burden on industry. It is found that while taxation and compliance costs are not likely to be reduced in the short term, costs arising from having to adapt to variation between regulatory regimes in a federal system of government, seem the most promising way of reducing regulatory costs.     Contractors’ Strategic Approaches to Risk Assessment Techniques at Project Planning Stage

    Abstract — The construction industry is still plagued by poor quality, poor workmanship, poor safety and health environment, and poor practices. The current main problem in the Malaysian Construction Industry is delayed projects under the Ninth Malaysia Plan. The idea of introducing formal risk assessment among Malaysian contractors during the project planning stage is a proactive approach to achieve project objectives. Therefore, this research intends to achieve the following objectives: (1) to investigate the contractors’ approaches of risk assessment techniques at the project planning stage, (2) to investigate the consequences of risk assessment techniques at the project planning stage, and (3) to determine the appropriate risk assessment techniques in dealing with the potential risk factors at the project planning stage. The research methodology applied for this research includes literature reviews and questionnaires. Findings from this research show that the application of risk assessment techniques in the Malaysian Construction Industry is still moderate. Hence, it is suggested that these contractors should try to implement formal risk assessment techniques during the project planning stage in order to achieve the project objectives.Keywords - Risk; Risk Assessment; Contractors; Project Planning Stage; Construction Industry
