    A importância de se proceder à análise dos principais desafios jurídicos que a economia colaborativa coloca – pelas implicações que as mudanças de paradigma dos modelos de negócios e dos sujeitos envolvidos suscitam − é indiscutível, correspondendo à necessidade de se fomentar a segurança jurídica destas práticas, potenciadoras de crescimento económico e bem-estar social. O Centro de Investigação em Justiça e Governação (JusGov) constituiu uma equipa multidisciplinar que, além de juristas, integra investigadores de outras áreas, como a economia e a gestão, dos vários grupos do JusGov – embora com especial participação dos investigadores que integram o grupo E-TEC (Estado, Empresa e Tecnologia) – e de outras prestigiadas instituições nacionais e internacionais, para desenvolver um projeto neste domínio, com o objetivo de identificar os problemas jurídicos que a economia colaborativa suscita e avaliar se já existem soluções para aqueles, refletindo igualmente sobre a conveniência de serem introduzidas alterações ou se será mesmo necessário criar nova regulamentação.     Factors that affect English proficiency in students of advanced English courses of the undergraduate program in English at Universidad Nacional Abierta y a Distancia (UNAD)

Este estudio de investigación reunió como participantes a estudiantes activos de los cursos de inglés del último periodo académico que voluntariamente formaron parte del mismo, el análisis de datos de este estudio se basó en información cuantitativa y cualitativa obtenida a través de dos instrumentos creados específicamente para la población objeto, e implementados durante el desarrollo de este estudio de investigación, los datos cuantitativos fueron recolectados mediante el instrumento "Cuestionario Socioeconómico" y se utilizó el Cambridge English Placement test (CEPTO) para analizar el nivel de inglés de los estudiantes, mientras que los datos cualitativos se obtuvieron a través de una encuesta de caracterización, como resultado del análisis de datos mencionado anteriormente se identificaron tres (3) categorías, estratificación socioeconómica, estudios de Pregrado en línea y antecedentes económicos del hogar, las observaciones y conclusiones logradas durante este proceso abren un espacio de reflexión frente a la posibilidad de implementar estrategias de cara a las necesidades de la población especifica de la UNAD concerniente al aprendizaje del inglés como lengua extranjera.This paper establishes and analyzes the relationship between different variables related to English as a foreign language learning for undergraduate students of the Bachelor in English program from the advanced English courses at UNAD. It has been observed that for some students of the undergraduate program the low language performance is related to their socioeconomic context, as well as engagement. This research study invited students enrolled in the advanced English courses at UNAD to participate, the data analysis of this study is based on quantitative and qualitative information obtained through means of two instruments specifically created for the target population, and implemented during the development of this research study, quantitative data was gathered by the instrument “Socioeconomic Questionnaire” and the Cambridge English Placement test (CEPTO) was used to analyze the English level of the students, while qualitative data was obtained through a characterization survey, after thorough analysis it was found that the learners´ socioeconomic status is a fundamental factor that contributes to English acquisition in the target population and has correlation with their language performance, it was also found that although their level of engagement was high the majority did not obtain the B2 English level expected to graduate in the program. The angles explored were: students’ financial status, parents’ background, English language performance, and engagement towards the language. It is expected that the findings of this study can pave the way for other researchers to undertake further investigations and find solutions on the basis of the discerned results

    Norsk rå kumelk, en kilde til zoonotiske patogener?

    The worldwide emerging trend of eating “natural” foods, that has not been processed, also applies for beverages. According to Norwegian legislation, all milk must be pasteurized before commercial sale but drinking milk that has not been heat-treated, is gaining increasing popularity. Scientist are warning against this trend and highlights the risk of contracting disease from milkborne microorganisms. To examine potential risks associated with drinking unpasteurized milk in Norway, milk- and environmental samples were collected from dairy farms located in south-east of Norway. The samples were analyzed for the presence of specific zoonotic pathogens; Listeria monocytogenes, Campylobacter spp., and Shiga toxin-producing Escherichia coli (STEC). Cattle are known to be healthy carriers of these pathogens, and Campylobacter spp. and STEC have a low infectious dose, meaning that infection can be established by ingesting a low number of bacterial cells. L. monocytogenes causes one of the most severe foodborne zoonotic diseases, listeriosis, that has a high fatality rate. All three pathogens have caused milk borne disease outbreaks all over the world, also in Norway. During this work, we observed that the prevalence of the three examined bacteria were high in the environment at the examined farms. In addition, 7% of the milk filters were contaminated by STEC, 13% by L. monocytogenes and 4% by Campylobacter spp. Four of the STEC isolates detected were eaepositive, which is associated with the capability to cause severe human disease. One of the eae-positive STEC isolates were collected from a milk filter, which strongly indicate that Norwegian raw milk may contain potential pathogenic STEC. To further assess the possibilities of getting ill by STEC after consuming raw milk, we examined the growth of the four eae-positive STEC isolates in raw milk at different temperatures. All four isolates seemed to have ability to multiply in raw milk at 8°C, and one isolate had significant growth after 72 hours. Incubation at 6°C seemed to reduce the number of bacteria during the first 24 hours before cell death stopped. These findings highlight the importance of stable refrigerator temperatures, preferable < 4°C, for storage of raw milk. The L. monocytogenes isolates collected during this study show genetic similarities to isolates collected from urban and rural environmental locations, but different clones were predominant in agricultural environments compared to clinical and food environments. However, the results indicate that the same clone can persist in a farm over time, and that milk can be contaminated by L. monocytogenes clones present in farm environment. Despite testing small volumes (25 mL) of milk, we were able to isolate both STEC and Campylobacter spp. directly from raw milk. A proportion of 3% of the bulk tank milk and teat milk samples were contaminated by Campylobacter spp. and one STEC was isolated from bulk tank milk. L monocytogenes was not detected in bulk tank milk, nor in teat milk samples. The agricultural evolvement during the past decades have led to larger production units and new food safety challenges. Dairy cattle production in Norway is in a current transition from tie-stall housing with conventional pipeline milking systems, to modern loose housing systems with robotic milking. The occurrence of the three pathogens in this project were higher in samples collected from farms with loose housing compared to those with tiestall housing. Pasteurization of cow’s milk is a risk reducing procedure to protect consumers from microbial pathogens and in most EU countries, commercial distribution of unpasteurized milk is legally restricted. Together, the results presented in this thesis show that the animal housing may influence the level of pathogenic bacteria in the raw milk and that ingestion of Norwegian raw cow’s milk may expose consumers to pathogenic bacteria which can cause severe disease, especially in children, elderly and in persons with underlying diseases. The results also highlight the importance of storing raw milk at low temperatures between milking and consumption.Å spise mat som er mindre prosessert og mer «naturlig» er en pågående trend i Norge og i andre deler av verden. Interessen for å drikke melk som ikke er varmebehandlet, såkalt rå melk, er også økende. I Norge er det påbudt å pasteurisere melk før kommersielt salg for å beskytte forbrukeren mot sykdomsfremkallende mikroorganismer. Fagfolk advarer mot å drikke rå melk, og påpeker risikoen for å bli syk av patogene bakterier som kan finnes i melken. I denne avhandlingen undersøker vi den potensielle risikoen det medfører å drikke upasteurisert melk fra Norge. I tillegg til å samle inn tankmelk- og speneprøver fra melkegårder i sørøst Norge, samlet vi også miljøprøver fra de samme gårdene for å kartlegge forekomst og for å identifisere potensielle mattrygghetsrisikoer i melkeproduksjonen. Alle prøvene ble analysert for de zoonotiske sykdomsfremkallende bakteriene Listeria monocytogenes, Campylobacter spp., og Shiga toksin-produserende Escherichia coli (STEC). Kyr kan være friske smittebærere av disse bakteriene, som dermed kan etablere et reservoar på gårdene. Bakteriene kan overføres fra gårdsmiljøet til melkekjeden og dermed utfordre mattryggheten. Disse bakteriene har forårsaket melkebårne sykdomsutbrudd over hele verden, også i Norge. Campylobacter spp. og STEC har lav infeksiøs dose, som vil si at man kan bli syk selv om man bare inntar et lavt antall bakterieceller. L. monocytogenes kan gi sykdommen listeriose, en av de mest alvorlige matbårne zoonotiske sykdommene vi har i den vestlige verden. Resultater fra denne oppgaven viser en høy forekomst av de tre patogenene i gårdsmiljøet. I tillegg var 7% av melkefiltrene vi testet positive for STEC, 13% positive for L. monocytogenes og 4% positive for Campylobacter spp.. Fire av STEC isolatene bar genet for Intimin, eae, som er ansett som en viktig virulensfaktor som øker sjansen for alvorlig sykdom. Ett av de eae-positive isolatene ble funnet i et melkefilter, noe som indikerer at norsk rå melk kan inneholde patogene STEC. For å videre vurdere risikoen for å bli syk av STEC fra rå melk undersøkte vi hvordan de fire eae-positive isolatene vokste i rå melk lagret ved forskjellige temperaturer. For alle isolatene økte antall bakterier etter lagring ved 8°C, og for et isolat var veksten signifikant. Etter lagring ved 6°C ble antallet bakterier redusert de første 24 timene, deretter stoppet reduksjonen i antall bakterier. Disse resultatene viser hvor viktig det er å ha stabil lav lagringstemperatur for rå melk, helst < 4°C. L. monocytogenes isolatene som ble samlet inn fra melkegårdene viste genetiske likheter med isolater samlet inn fra urbane og rurale miljøer rundt omkring i Norge. Derimot var kloner som dominerte i landbruksmiljøet forskjellige fra kliniske isolater og isolater fra matproduksjonslokaler. Videre så man at en klone kan persistere på en gård over tid og at melk kan kontamineres av L. monocytogenes kloner som er til stede i gårdsmiljøet. Til tross for små testvolum av tankmelken (25 mL) fant vi både STEC og Campylobacter spp. i melkeprøvene. 3% av tankmelkprøvene og speneprøvene var positive for Campylobacter spp. og ett STEC isolat ble funnet i tankmelk. L. monocytogenes ble ikke funnet direkte i melkeprøvene. Landbruket i Norge er i stadig utvikling der besetningene blir større, men færre. Melkebesetningene er midt i en overgang der tradisjonell oppstalling med melking på bås byttes ut med løsdriftssystemer og melkeroboter. Forekomsten av de tre patogenene funnet i denne studien var høyere i besetningene med løsdrift sammenliknet med besetningene som hadde melkekyrne oppstallet på bås. Pasteurisering er et viktig forebyggende tiltak for å beskytte konsumenter fra mikrobielle patogener, og i de fleste EU-land er kommersielt salg av rå melk juridisk begrenset. Denne studien viser at oppstallingstype kan påvirke nivåene av patogene bakterier i gårdsmiljøet og i rå melk. Inntak av rå melk kan eksponere forbruker for patogene bakterier som kan gi alvorlig sykdom, spesielt hos barn, eldre og personer med underliggende sykdommer. Resultatene underbygger viktigheten av å pasteurisere melk for å sikre mattryggheten, og at det er avgjørende å lagre rå melk ved kontinuerlig lave temperaturer for å forebygge vekst av zoonotiske patogener

    Investigating critical thinking in higher education in Latin America: Acknowledging an epistemic disjuncture

    Critical thinking (CT) in higher education (HE) has been widely investigated in Western countries. Most of the research on CT has conceived it as a higher order thinking skill with implications for learning processes. CT has also been connected with critical pedagogies, an approach that seems particularly attuned with the Latin American region. Through a systematic literature review, this article maps the scholarship on CT in HE in Latin America (LATAM). Findings point to a local character of the research on CT that heavily relies on cognitive psychology traditions. It is proposed that the scholarship on CT in LATAM is characterised by an epistemic disjuncture that favours theories and methodologies produced in the Global North overshadowing well-recognised traditions of critical pedagogies in the region. We conclude that research on CT in the region is missing an opportunity to develop powerful features that are especially fitting for LATAM’s geo-historic context

    A Decision Support System for Economic Viability and Environmental Impact Assessment of Vertical Farms

    Vertical farming (VF) is the practice of growing crops or animals using the vertical dimension via multi-tier racks or vertically inclined surfaces. In this thesis, I focus on the emerging industry of plant-specific VF. Vertical plant farming (VPF) is a promising and relatively novel practice that can be conducted in buildings with environmental control and artificial lighting. However, the nascent sector has experienced challenges in economic viability, standardisation, and environmental sustainability. Practitioners and academics call for a comprehensive financial analysis of VPF, but efforts are stifled by a lack of valid and available data. A review of economic estimation and horticultural software identifies a need for a decision support system (DSS) that facilitates risk-empowered business planning for vertical farmers. This thesis proposes an open-source DSS framework to evaluate business sustainability through financial risk and environmental impact assessments. Data from the literature, alongside lessons learned from industry practitioners, would be centralised in the proposed DSS using imprecise data techniques. These techniques have been applied in engineering but are seldom used in financial forecasting. This could benefit complex sectors which only have scarce data to predict business viability. To begin the execution of the DSS framework, VPF practitioners were interviewed using a mixed-methods approach. Learnings from over 19 shuttered and operational VPF projects provide insights into the barriers inhibiting scalability and identifying risks to form a risk taxonomy. Labour was the most commonly reported top challenge. Therefore, research was conducted to explore lean principles to improve productivity. A probabilistic model representing a spectrum of variables and their associated uncertainty was built according to the DSS framework to evaluate the financial risk for VF projects. This enabled flexible computation without precise production or financial data to improve economic estimation accuracy. The model assessed two VPF cases (one in the UK and another in Japan), demonstrating the first risk and uncertainty quantification of VPF business models in the literature. The results highlighted measures to improve economic viability and the viability of the UK and Japan case. The environmental impact assessment model was developed, allowing VPF operators to evaluate their carbon footprint compared to traditional agriculture using life-cycle assessment. I explore strategies for net-zero carbon production through sensitivity analysis. Renewable energies, especially solar, geothermal, and tidal power, show promise for reducing the carbon emissions of indoor VPF. Results show that renewably-powered VPF can reduce carbon emissions compared to field-based agriculture when considering the land-use change. The drivers for DSS adoption have been researched, showing a pathway of compliance and design thinking to overcome the ‘problem of implementation’ and enable commercialisation. Further work is suggested to standardise VF equipment, collect benchmarking data, and characterise risks. This work will reduce risk and uncertainty and accelerate the sector’s emergence

Por lo tanto, el análisis de los factores básicos de los juegos se convierte en algo esencial a la hora de definir y utilizar la gamificación como estrategia de mediación del inglés como lengua extranjera para fortalecer rasgos específicos de pronunciación en los estudiantes de pregrado de la UPTC Sogamoso. El procedimiento de estudio se basa en la investigación acción mediante la implementación de la estrategia de gamificación para la mediación en la pronunciación del inglés, orientada a treinta estudiantes de diferentes programas de ingeniería, administración y tecnología con niveles heterogéneos de dominio del inglés. Las actividades se centran principalmente en la producción de sonidos, el ritmo, el acento y la entonación, los rasgos de pronunciación segmental y suprasegmental. Los resultados arrojaron una evidente mejora en las características segméntales y suprasegmentales de la percepción en la pronunciación de los participantes así como la contribución del objetivo de los juegos a la instrucción fonética y fonológica, la sensación en el juego a la motivación para mejorar la pronunciación, el reto establecido en los juegos a la actitud positiva de los participantes, y la sociabilidad a la exposición practica de la pronunciación inglesa.Gamification is a relatively new term that often denotes the use of game components in situations unrelated to the game itself to create enjoyable, fun, and motivating learning experiences for students (Werbach and Hunter, 2012). Therefore, analyzing the games' basic factors becomes essential when defining and using gamification as a strategy for English as Foreign Language mediation to strengthen specific pronunciation features in UPTC Sogamoso undergraduate students. The study procedure is based on action research by implementing the gamification strategy for mediation in English pronunciation, oriented to thirty students from different engineering, management, and technology programs at heterogeneous levels of English proficiency. The activities mainly focus on sound production, rhythm, stress, and intonation, segmental and suprasegmental pronunciation features. The results showed an evident improvement in the segmental and suprasegmental features of the participants' pronunciation perception as well as the contribution of game goals to phonetics and phonological instruction, the game sensation to the motivation for pronunciation improvement, the game challenge to the participants' positive attitude, and the sociality to the English pronunciation exposure practice

    Coloniality and the Courtroom: Understanding Pre-trial Judicial Decision Making in Brazil

    This thesis focuses on judicial decision making during custody hearings in Rio de Janeiro, Brazil. The impetus for the study is that while national and international protocols mandate the use of pre-trial detention only as a last resort, judges continue to detain people pre-trial in large numbers. Custody hearings were introduced in 2015, but the initiative has not produced the reduction in pre-trial detention that was hoped. This study aims to understand what informs judicial decision making at this stage. The research is approached through a decolonial lens to foreground legacies of colonialism, overlooked in mainstream criminological scholarship. This is an interview-based study, where key court actors (judges, prosecutors, and public defenders) and subject matter specialists were asked about influences on judicial decision making. Interview data is complemented by non-participatory observation of custody hearings. The research responds directly to Aliverti et al.'s (2021) call to ‘decolonize the criminal question’ by exposing and explaining how colonialism informs criminal justice practices. Answering the call in relation to judicial decision making, findings provide evidence that colonial-era assumptions, dynamics, and hierarchies were evident in the practice of custody hearings and continue to inform judges’ decisions, thus demonstrating the coloniality of justice. This study is significant for the new empirical data presented and theoretical innovation is also offered via the introduction of the ‘anticitizen’. The concept builds on Souza’s (2007) ‘subcitizen’ to account for the active pursuit of dangerous Others by judges casting themselves as crime fighters in a modern moral crusade. The findings point to the limited utility of human rights discourse – the normative approach to influencing judicial decision making around pre-trial detention – as a plurality of conceptualisations compete for dominance. This study has important implications for all actors aiming to reduce pre-trial detention in Brazil because unless underpinning colonial logics are addressed, every innovation risks becoming the next lei para inglês ver (law [just] for the English to see)
