    From the local level to international politics, deliberation helps to increase mutual understanding and trust, in order to arrive at political decisions of high epistemic value and legitimacy. This book gives deliberation a dynamic dimension, analysing how levels of deliberation rise and fall in group discussions, and introducing the concept of 'deliberative transformative moments' and how they can be applied to deeply divided societies, where deliberation is most needed but also most difficult to work. Discussions between ex-guerrillas and ex-paramilitaries in Colombia, Serbs and Bosnjaks in Bosnia-Herzegovina, and police officers and locals in Brazilian favelas are used as case studies, with participants addressing how peace can be attained in their countries. Allowing access to the records and transcripts of the discussions opens an opportunity for practitioners of conflict resolution to apply this research to their work in trouble spots of the world, creating a link between the theory and practice of deliberation

    Breaking the Constitutional Deadlock: Lessons from Deliberative Experiments in Constitutional Change

    This work provides comparative insights into how deliberation on proposed constitutional amendments might be more effectively pursued. It reports on a new nationwide survey of public attitudes to constitutional reform, examining the potential in Australia of innovative Canadian models of reform led by Citizens' Assemblies. Assembly members are selected at random and are demographically representative of the wider public. They deliberate over reforms for several months while receiving instruction from experts in relevant fields. Members thus become 'public-experts': citizens who stand in for the wider public but are versed in constitutional fundamentals. The author finds striking empirical evidence that, if applied in the Australian context, public trust would be substantially greater for Citizens' Assemblies compared with traditional processes of change. The article sets these results in context, reading the Assemblies against theories of deliberative democracy and public trust. One reason for greater public trust in the Assemblies' may be an ability to accommodate key values that are otherwise in conflict: majoritarian democratic legitimacy, on the one hand, and fair and well-informed (or 'deliberatively rational') decision-making, on the other. Previously, almost no other poll had asked exactly how much Australians trust in constitutional change. However, by resolving trust into a set of discrete public values, the polling and analysis in this work provide evidence that constitutional reform might only succeed when it expresses, at once, the values of both majoritarian and deliberative democracy

    Citizen Participation in Rulemaking: Past, Present, and Future

    Administrative law scholars and governmental reformers argue that advances in information technology will greatly expand public participation in regulatory policymaking. They claim that e-rulemaking, or the application of new technology to administrative rulemaking, promises to transform a previously insulated process into one in which ordinary citizens regularly provide input. With the federal government having implemented several e-rulemaking initiatives in recent years, we can now begin to assess whether such a transformation is in the works-or even on the horizon. This paper compares empirical observations on citizen participation in the past, before e-rulemaking, with more recent data on citizen participation after the introduction of various types of technological innovations. Contrary to prevailing predictions, empirical research shows that e-rulemaking makes little difference: citizen input remains typically sparse, notwithstanding the relative ease with which individuals can now learn about and comment on regulatory proposals. These findings indicate that the more significant barriers to citizen participation are cognitive and motivational. Even with e-rulemaking, it takes a high level of technical sophistication to understand and comment on regulatory proceedings. Moreover, even though information technology lowers the absolute cost of submitting comments to regulatory agencies, it also dramatically decreases the costs of a wide variety of entertainment and commercial activities that are much more appealing to most citizens. Given persistent opportunity costs and other barriers to citizen participation, even future e-rulemaking efforts appear unlikely to lead to a participatory revolution, but instead can be expected generally to deliver much the same level of citizen involvement in the regulatory process

    Discourses of Educational Rights in Philosophy for Children: On the Theoretical and Practical Merits of Philosophical Education for Children

    This article aims to put into dialogue Philosophy for Children (P4C) and education rights. Whereas rights have robust conceptualizations and have been the topic of many scholarly discussions, scholarship on P4C still has a lot to unpack for a more expansive understanding, especially when scaled up to the level of rights. This work asks whether or not the rhetoric of ā€œrightsā€ can be used to discuss if P4C has a rightful place to be a mandatory part of school curriculum. Thus the article explores how P4C is positioned between children education and rights discourses. The range of views on P4C is broad enough to prevent the concentration of discursive power in a single source or authority in terms of scale of discussion. P4C is therefore subject to both scrutiny and praise in the same way that other human rights ideologies have been. In conclusion, this work hopes to speak and contribute to the literature on P4C by problematizing childrenā€™s discursive positions as learners and citizens with rights

    Pyramidal Democracy

    We consider a decentralized, multilayered representative democracy, where citizens participate in deliberative policy formation after self-organizing into a pyramidal hierarchy of small groups. Each group elects a delegate, who expresses the deliberative consensus of that group at the next tier of the pyramid. The pyramid thus acts as a communications network which efficiently aggregates useful information and policy ideas. It is also a powerful meritocratic device, which channels legislative responsibility towards the most committed and competent citizens. This yields a practical implementation of deliberative democracy in a large polity.deliberative democracy
