    [Excerpt] “The increase in e-discovery, e-discovery‘s impact on litigation, and the courts‘ unavoidable role in defining the limits of discovery led to the author‘s decision to develop this article. The availability, accessibility, and the ease of requesting electronic data, resulting in increased e-discovery under the Federal Rules of Civil Procedure, is an important issue that will affect the legal profession and its constituents in many ways for years to come. Part II of this article is an overview of Federal Rule of Civil Procedure 26(f). This part stresses that in recognizing the herculean task involved in e-discovery, courts expect that litigants immediately begin the process of understanding what their cases require from an e-discovery standpoint. Part III highlights judges and cases that have had a clear hand in shaping the terrain of where electronic data discovery issues are heading. Part IV examines the ramifications of failing to comply with Federal Rule of Civil Procedure 26(f), illustrating the importance of Rule 26(f) in the litigation process. Abiding by the agreements that the parties reach under Rule 26(f) could avoid most, if not all, e-discovery problems. Part V examines problems associated with electronic data discovery. Part VI offers workable solutions to electronic data discovery concerns. Finally, Part VII concludes that even though the outer boundaries of e-discovery may be uncertain, judges, practitioners, and law schools must work together to ensure that exposure, training, and classes are available from the earliest possible time to ensure efficient and responsible adherence to the new requirements that the electronic age has brought to the litigation process.

    This article focuses on small claims arbitration and examines the impact of AT&T Mobility on the legitimacy of the process. Part II of the article describes the Supreme Court’s AT&T Mobility decision, which held that the FAA preempts a California rule that declared a class arbitration waiver in a consumer contract unconscionable. Part III describes the primary features of the two options remaining for the Concepcions—small claims court and small claims arbitration, as well as their perceived advantages and disadvantages. Part IV demonstrates that courts have endorsed simplified arbitration. Part V examines whether simplified arbitration is a fair method of resolving small arbitration claims. Part VI explores other dispute resolution models for resolving small dollar value commercial disputes, including on-line dispute resolution, telephonic arbitration, and a small claims arbitrator. Part VII concludes by urging dispute system designers to consider changing the default mechanism of arbitrating small claims cases from paper or “desk” arbitration to a live hearing before a small claims arbitrator

    Are We Insane? The Quest for Proportionality in the Discovery Rules of the Federal Rules of Civil Procedure

    Atrial fibrillation is a common heart arrhythmia which is characterized by a missing or irregular contraction of the atria. The disease is a risk factor for other more serious diseases and the total medical costs in society are extensive. Therefore it would be beneficial to improve and optimize the prevention and detection of the disease.   Pulse palpation and heart auscultation can facilitate the detection of atrial fibrillation clinically, but the diagnosis is generally confirmed by an ECG examination. Today there are several algorithms that detect atrial fibrillation by analysing an ECG. A common method is to study the heart rate variability (HRV) and by different types of statistical calculations find episodes of atrial fibrillation which deviates from normal sinus rhythm.   Two algorithms for detection of atrial fibrillation have been evaluated in Matlab. One is based on the coefficient of variation and the other uses a logistic regression model. Training and testing of the algorithms were done with data from the Physionet MIT database. Several steps of signal processing were used to remove different types of noise and artefacts before the data could be used.   When testing the algorithms, the CV algorithm performed with a sensitivity of 91,38%, a specificity of 93,93% and accuracy of 92,92%, and the results of the logistic regression algorithm was a sensitivity of 97,23%, specificity of 93,79% and accuracy of 95,39%. The logistic regression algorithm performed better and was chosen for implementation in Java, where it achieved a sensitivity of 97,31%, specificity of 93,47% and accuracy of 95,25%.Förmaksflimmer Àr en vanlig hjÀrtrytmrubbning som kÀnnetecknas av en avsaknad eller oregelbunden kontraktion av förmaken. Research suggests that even isolated and marginalised groups are using technology in their everyday lives.For some groups (e.g., young people), technology may be their preferred method of communication.There appears to be a difference between how people are using the Internet (regularly, from anywhere, connecting with social networks, investigating services) and how some organisations are engaging with it (infrequently, in one direction).Technology works best when used to augment or improve existing services for clients, or to offer innovative approaches to existing services.Technology can be used in diverse ways for organisational improvement (e.g., remote access, staff training, professional development) or client services (e.g., online counselling, SMS appointment reminders, access to resources).Using technology does not necessarily involve large monetary investments or reinventing the wheel in terms of policy and procedures. Often it is a matter of adapting and refining existing services and policies to better suit the online world.Incorporating technology into services takes time, and will need continued assessment and refinement to be successful
