    Adversarial contract design for private data commercialization

    The proliferation of data collection and machine learning techniques has created an opportunity for commercialization of private data by data aggregators. In this paper, we study this data monetization problem using a contract-theoretic approach. Our proposed adversarial contract design framework accounts for the heterogeneity in honest buyers' demands for data, as well as the presence of adversarial buyers who may purchase data to compromise its privacy. We propose the notion of Price of Adversary (PoAdv) to quantify the effects of adversarial users on the data seller's revenue, and provide bounds on the PoAdv for various classes of adversary utility. We also provide a fast approximate technique to compute contracts in the presence of adversaries

    Lost in the cacophony surrounding the debate about high drug prices is the fundamental principle that pharmaceutical innovation will not occur without the prospect of outsized returns enabled through market exclusivity. Biopharmaceutical patents are currently under siege, subject to challenge both in inter partes review (“IPR”) proceedings and in Hatch-Waxman actions. These twin assaults threaten to eliminate the incentives necessary for biotechnological innovation—particularly for discoveries made upstream in the innovation pipeline—thus imperiling the development of new drug therapies. But a fascinating solution has emerged: invoking tribal immunity to shield pharmaceutical patents from IPR before the Patent Trial and Appeal Board (“PTAB”). This serves two critically important objectives: promoting tribal self-sufficiency, and encouraging investment in life-saving and life-improving new drugs. Contractual partnerships between Native American tribes and pharmaceutical companies not only provide the tribes with a steady stream of royalty revenue, but also insulate biopharmaceutical patents from challenge in IPR proceedings through the invocation of long-established principles of tribal sovereign immunity. This Note is the first piece of scholarship to comprehensively analyze, and advocate for, the right to invoke tribal sovereign immunity in IPR proceedings

    Budgetary processes: a political economy perspective

    The response to macro shocks, given the electoral structure, built in perverse incentives that influenced India's development process. The chapter selectively surveys political economic theory, Indian and other country experience to bring out the systemic incentives that affect political behaviour, government budgets, and expenditure. Conceptual categories developed are found useful in interpreting Indian experience. Overtime, conflicts between groups were handled in a way that lowered incentives for expansion of the cake, and led to a short-term focus. Price controls bred inefficiencies, especially after the oil shocks. But there are leverage points for change. Well-coordinated macro policy, including infrastructure spending, with some restraints on political-bureaucratic choices, could create incentives for rapid growth. The latter eases political adjustments. Vidare visas Ă€ven att slankare tvĂ€rsnitt resulterar i aningen högre armeringsmĂ€ngd. Dock pĂ„verkas betongkostnaden i större utstrĂ€ckning av slankare tvĂ€rsnitt och sĂ€rskilt större spĂ€nnvidder. Även om större spĂ€nnvidd och slankare tvĂ€rsnitt föranleder ett större armeringsbehov, fĂ„s en lĂ€gre totalkostnad. Det bör noteras att priset pĂ„ betong och stĂ„l Ă€r starkt beroende av konjunktur och tillgĂ„ng till material.     This Essay explores the concept of medical necessity as it has evolved in the judicial and administrative oversight of managed care. The goals of the Essay are to illustrate the range of plausible rationales for establishing administrative procedures to govern medical necessity disputes, and to demonstrate the difficulty of incorporating into those procedures the most important professional and social responsibilities of managed care in today’s health care system. Part I of the Essay explains the ideological and practical significance of medical necessity as managed care has evolved. Part II examines medical necessity as a legal problem, and questions whether current independent review programs match social needs. Part III offers an alternative perspective on oversight of decisionmaking in managed care that emphasizes therapeutic effect rather than contractual enforcement. Part IV describes improvements in both independent review and overall medical necessity policy that would better serve therapeutic objectives. Among other things, the Essay suggests that independent review procedures should be different for insured individuals who are severely or chronically ill than for those who are only occasional users of health care services

    As we head into the 21st century, there has been a significant, on-going paradigm shift occuring in the space industry. The once secretive and often adversarial Cold-War relationships that have turned into Post Cold-War cooperation and partnerships have paved the way for market driven opportunities in Space Commerce. The space industry is slowly shifting away from governmental domination, fueled by Cold-War politics and national security fears, to one of open commercial markets most notably in the areas of launch services as well as telecommunications and navigation satellites. In addition, futuristic commercialization opportunities are possible in remote sensing, microgravity research, vacuum based material processing, space derived energy, and space tourism. This paper will focus on current hardware development programs, the commercial trends and future outlook in each of these areas. Private companies are exploiting these various markets by relying less on the government and more on competitive business models supported by market demand or partnerships to share cost, technology and risk

    Value-Driven Analysis of New Paradigms in Space Architectures: An Ilities-Based Approach

    Current commercial, civil, and military space architecture designs perform exquisitely and reliably. However, today’s architecture paradigms are also characterized by expensive launches, large and expensive high-performance spacecraft, long development cycles, and wide variations in ground architectures. While current assets provide high-quality services, and future assets are slated to improve performance within the same design frameworks, proposed future architectures may not be capitalizing on technology improvements, system innovations, or policy alternatives explored during the last two decades. This paper identifies five “trends” along which space architectures may develop, aimed at granting systems several “ilities,” such as resiliency, robustness, flexibility, scalability, and affordability. The trends examined include: commercialization of space, significant reductions in launch costs and the development of hybrid or reusable launch systems, development of on-orbit infrastructure and servicing, aggregation or disaggregation of orbital assets, and the automation and standardization of ground architectures. Further refinement of these key technological and system trends could result in major paradigm shifts in the development and fielding of space operations as well as lead to space architecture designs in the future that are radically different from those today. Within the framework of systems engineering ilities and risk management, this paper reviews current literature surrounding these new change trends and justifies their potential to cause significant paradigm shifts. By examining the work and research conducted so far through an ilities-based approach, systems engineers can more fully appreciate the value being offered by these trends
