    Lawful Hacking: Using Existing Vulnerabilities for Wiretapping on the Internet

    For years, legal wiretapping was straightforward: the officer doing the intercept connected a tape recorder or the like to a single pair of wires. By the 1990s, however, the changing structure of telecommunications—there was no longer just “Ma Bell” to talk to—and new technologies such as ISDN and cellular telephony made executing a wiretap more complicated for law enforcement. Simple technologies would no longer suffice. In response, Congress passed the Communications Assistance for Law Enforcement Act (CALEA) which mandated a standardized lawful intercept interface on all local phone switches. Since its passage, technology has continued to progress, and in the face of new forms of communication—Skype, voice chat during multiplayer online games, instant messaging, etc.—law enforcement is again experiencing problems. The FBI has called this “Going Dark”: their loss of access to suspects’ communication. According to news reports, law enforcement wants changes to the wiretap laws to require a CALEA-like interface in Internet software. CALEA, though, has its own issues: it is complex software specifically intended to create a security hole—eavesdropping capability—in the already-complex environment of a phone switch. It has unfortunately made wiretapping easier for everyone, not just law enforcement. Congress failed to heed experts’ warnings of the danger posed by this mandated vulnerability, and time has proven the experts right. The so-called “Athens Affair,” where someone used the built-in lawful intercept mechanism to listen to the cell phone calls of high Greek officials, including the Prime Minister, is but one example. In an earlier work, we showed why extending CALEA to the Internet would create very serious problems, including the security problems it has visited on the phone system. In this paper, we explore the viability and implications of an alternative method for addressing law enforcements need to access communications: legalized hacking of target devices through existing vulnerabilities in end-user software and platforms. The FBI already uses this approach on a small scale; we expect that its use will increase, especially as centralized wiretapping capabilities become less viable. Relying on vulnerabilities and hacking poses a large set of legal and policy questions, some practical and some normative. Among these are: (1) Will it create disincentives to patching? (2) Will there be a negative effect on innovation? (Lessons from the so-called “Crypto Wars” of the 1990s, and in particular the debate over export controls on cryptography, are instructive here.) (3) Will law enforcement’s participation in vulnerabilities purchasing skew the market? (4) Do local and even state law enforcement agencies have the technical sophistication to develop and use exploits? If not, how should this be handled? A larger FBI role? (5) Should law enforcement even be participating in a market where many of the sellers and other buyers are themselves criminals? (6) What happens if these tools are captured and repurposed by miscreants? (7) Should we sanction otherwise illegal network activity to aid law enforcement? (8) Is the probability of success from such an approach too low for it to be useful? As we will show, these issues are indeed challenging. We regard the issues raised by using vulnerabilities as, on balance, preferable to adding more complexity and insecurity to online systems

    On Security and Privacy for Networked Information Society : Observations and Solutions for Security Engineering and Trust Building in Advanced Societal Processes

    Our society has developed into a networked information society, in which all aspects of human life are interconnected via the Internet — the backbone through which a significant part of communications traffic is routed. This makes the Internet arguably the most important piece of critical infrastructure in the world. Securing Internet communications for everyone using it is extremely important, as the continuing growth of the networked information society relies upon fast, reliable and secure communications. A prominent threat to the security and privacy of Internet users is mass surveillance of Internet communications. The methods and tools used to implement mass surveillance capabilities on the Internet pose a danger to the security of all communications, not just the intended targets. When we continue to further build the networked information upon the unreliable foundation of the Internet we encounter increasingly complex problems,which are the main focus of this dissertation. As the reliance on communication technology grows in a society, so does the importance of information security. At this stage, information security issues become separated from the purely technological domain and begin to affect everyone in society. The approach taken in this thesis is therefore both technical and socio-technical. The research presented in this PhD thesis builds security in to the networked information society and provides parameters for further development of a safe and secure networked information society. This is achieved by proposing improvements on a multitude of layers. In the technical domain we present an efficient design flow for secure embedded devices that use cryptographic primitives in a resource-constrained environment, examine and analyze threats to biometric passport and electronic voting systems, observe techniques used to conduct mass Internet surveillance, and analyze the security of Finnish web user passwords. In the socio-technical domain we examine surveillance and how it affects the citizens of a networked information society, study methods for delivering efficient security education, examine what is essential security knowledge for citizens, advocate mastery over surveillance data by the targeted citizens in the networked information society, and examine the concept of forced trust that permeates all topics examined in this work.Yhteiskunta, jossa elämme, on muovautunut teknologian kehityksen myötä todelliseksi tietoyhteiskunnaksi. Monet verkottuneen tietoyhteiskunnan osa-alueet ovat kokeneet muutoksen tämän kehityksen seurauksena. Tämän muutoksen keskiössä on Internet: maailmanlaajuinen tietoverkko, joka mahdollistaa verkottuneiden laitteiden keskenäisen viestinnän ennennäkemättömässä mittakaavassa. Internet on muovautunut ehkä keskeisimmäksi osaksi globaalia viestintäinfrastruktuuria, ja siksi myös globaalin viestinnän turvaaminen korostuu tulevaisuudessa yhä enemmän. Verkottuneen tietoyhteiskunnan kasvu ja kehitys edellyttävät vakaan, turvallisen ja nopean viestintäjärjestelmän olemassaoloa. Laajamittainen tietoverkkojen joukkovalvonta muodostaa merkittävän uhan tämän järjestelmän vakaudelle ja turvallisuudelle. Verkkovalvonnan toteuttamiseen käytetyt menetelmät ja työkalut eivät vain anna mahdollisuutta tarkastella valvonnan kohteena olevaa viestiliikennettä, vaan myös vaarantavat kaiken Internet-liikenteen ja siitä riippuvaisen toiminnan turvallisuuden. Kun verkottunutta tietoyhteiskuntaa rakennetaan tämän kaltaisia valuvikoja ja haavoittuvuuksia sisältävän järjestelmän varaan, keskeinen uhkatekijä on, että yhteiskunnan ydintoiminnot ovat alttiina ulkopuoliselle vaikuttamiselle. Näiden uhkatekijöiden ja niiden taustalla vaikuttavien mekanismien tarkastelu on tämän väitöskirjatyön keskiössä. Koska työssä on teknisen sisällön lisäksi vahva yhteiskunnallinen elementti, tarkastellaan tiukan teknisen tarkastelun sijaan aihepiirä laajemmin myös yhteiskunnallisesta näkökulmasta. Tässä väitöskirjassa pyritään rakentamaan kokonaiskuvaa verkottuneen tietoyhteiskunnan turvallisuuteen, toimintaan ja vakauteen vaikuttavista tekijöistä, sekä tuomaan esiin uusia ratkaisuja ja avauksia eri näkökulmista. Työn tavoitteena on osaltaan mahdollistaa entistä turvallisemman verkottuneen tietoyhteiskunnan rakentaminen tulevaisuudessa. Teknisestä näkökulmasta työssä esitetään suunnitteluvuo kryptografisia primitiivejä tehokkaasti hyödyntäville rajallisen laskentatehon sulautetuviiille järjestelmille, analysoidaan biometrisiin passeihin, kansainväliseen passijärjestelmään, sekä sähköiseen äänestykseen kohdistuvia uhkia, tarkastellaan joukkovalvontaan käytettyjen tekniikoiden toimintaperiaatteita ja niiden aiheuttamia uhkia, sekä tutkitaan suomalaisten Internet-käyttäjien salasanatottumuksia verkkosovelluksissa. Teknis-yhteiskunnallisesta näkökulmasta työssä tarkastellaan valvonnan teoriaa ja perehdytään siihen, miten valvonta vaikuttaa verkottuneen tietoyhteiskunnan kansalaisiin. Lisäksi kehitetään menetelmiä parempaan tietoturvaopetukseen kaikilla koulutusasteilla, määritellään keskeiset tietoturvatietouden käsitteet, tarkastellaan mahdollisuutta soveltaa tiedon herruuden periaatetta verkottuneen tietoyhteiskunnan kansalaisistaan keräämän tiedon hallintaan ja käyttöön, sekä tutkitaan luottamuksen merkitystä yhteiskunnan ydintoimintojen turvallisuudelle ja toiminnalle, keskittyen erityisesti pakotetun luottamuksen vaikutuksiin

    A Critical Assessment on the Extraterritorial Application of Human Rights Treaties to Transnational Cyber Surveillance

    In this essay, I question the appropriateness of applying the substantive requirements of lawful domestic surveillance developed from international human rights treaties and relevant case law to transnational cyber surveillance. And I argue in the negative. Therefore, for the purpose of this essay, I would not delve into the highly debatable issue of what counts as ‘‘control” in cyber surveillance and which standard of control triggers a state’s jurisdiction. Instead, this essay assumes that a control test was established. In the following section, I shall examine the substantive requirements for states restricting fundamental freedoms drawn on from current human rights case law. And I shall demonstrate why these tests, which are designed for internal surveillance, will be problematic if applied to foreign cyber surveillance. My approach is territorial. And the core of the problems, I argue, is that the legal and political implications of territory and border, as currently understood, cannot provide a satisfying theoretical basis for expanding states’ regulatory power extraterritorially. I understand that my territorial approach may be considered very conservative, or Westphalian, and therefore, I would address some potential responses to my arguments in the conclusion

    Jonesing for a Privacy Mandate, Getting a Technology Fix - Doctrine to Follow

    While the Jones Court held unanimously that the Government’s use of a GPS device to track Antoine Jones’s vehicle for twenty-eight days was a Fourth Amendment search, the Justices disagreed on the facts and rationale supporting the holding. Beyond the very narrow trespass-based search theory regulating the Government’s attachment of a GPS device to Jones’s vehicle with the intent to gather information, the majority opinion does nothing to constrain government use of other tracking technologies, including cell phones, which merely involve the transmission of electronic signals without physical trespass. While the concurring opinions endorse application of the Katz reasonable expectation of privacy test to instances of government use of tracking technologies that do not depend on physical trespass, they offer little in the way of clear, concrete guidance to lower courts that would seek to apply Katz in such cases. Taken as a whole, then, the Jones opinions leave us still “Jonesing” for a privacy mandate

Dans cette étude, les plateformes les plus importantes de réseau mobile 4G ont été étudiées, configurées et testées dans deux zones différentes : un tunnel de mine souterrain et un couloir intérieur étroit.     In June 2013, Edward Snowden revealed a secret US government program that collected records on every phone call made in the country. Further disclosures followed, detailing mass surveillance by the UK as well. Journalists and policymakers soon began discussing large-scale programs in other countries. Over two years before the Snowden leaks began, Cate and Dempsey had started researching systematic collection. Leading an initiative sponsored by The Privacy Projects, they commissioned a series of country reports, asking national experts to uncover what they could about government demands that telecommunications providers and other private-sector companies disclose information about their customers in bulk. Their initial research found disturbing indications of systematic access in countries around the world. These programs, often undertaken in the name of national security, were cloaked in secrecy and largely immune from oversight, posing serious threats to personal privacy. After the Snowden leaks, the project morphed into something more ambitious: an effort to explore what should be the rules for government access to data and how companies should respond to those demands within the framework of corporate responsibility. This volume concludes the nearly six-year project. It assembles 12 country reports, updated to reflect recent developments. One chapter presents both descriptive and normative frameworks for analyzing national surveillance laws. Others examine international law, human rights law, and oversight mechanisms. Still others explore the concept of accountability and the role of encryption in shaping the surveillance debate. In their conclusion, Cate and Dempsey offer recommendations for both government and industry
