    An Intersystemic View of Intellectual Property and Free Speech

    Intellectual property regimes operate in the shadow of the First Amendment. By deeming a particular activity as infringing, the law of copyright, trademark, and the right of publicity all limit communication. As a result, judges and lawmakers must delicately balance intellectual property rights with expressive freedoms. Interestingly, each intellectual property regime strikes the balance between ownership rights and free speech in a dramatically different way. Despite a large volume of scholarship on intellectual property rights and free speech considerations, this Article represents the first systematic effort to detail, analyze, and explain the divergent evolution of expression-based defenses in copyright, trademark, and right of publicity jurisprudence. The first part of this Article carefully details the disparate treatment of First Amendment defenses in the three intellectual property regimes. On one side of the spectrum is copyright law. An increasingly broad interpretation of commercial use, a narrow construction of transformative use, and a myopic focus on market harm, combined with a refusal to engage in any sort of independent First Amendment review, have rendered copyright law a feeble protector of free expression. On the other side of the spectrum is recent right of publicity jurisprudence, which routinely invokes the First Amendment and features robust defenses based on “transformativeness” and “newsworthiness.” Somewhere in the middle stands trademark law, offering its own judge-made defenses to immunize expressive conduct but simultaneously closing off those defenses for defendants engaging in commercial or potentially confusing activity. The next part tries to explain why these three regimes accommodate the First Amendment in such different ways. We conclude that the divergence is not the result of careful deliberation, but rather the inadvertent product of different methods and histories of lawmaking. If the divergence does not represent a logical or deliberate choice, reforms are needed. By bringing these different approaches to the First Amendment into relief, we hope to demonstrate how some free speech interests are being shortchanged and we aim to place all three regimes on a stronger theoretical footing

    The construction and application of brand value evaluation model for China's pharmaceutical industry

    In today's information age, strong brands can prolong the life cycle of products and enhance the competitiveness and overall value of pharmaceutical enterprises. Therefore, this study hopes to build a set of brand value evaluation system suitable for Chinese pharmaceutical industry, and dig deep into the connotation of brand value of Chinese pharmaceutical industry. Through a brief analysis of the advantages and limitations of the current mainstream brand value assessment methods at home and abroad, this study selects the relatively authoritative Interbrand model to optimize and improve. The improvement of Interbrand model mainly involves the following three aspects: First, for the determination of the brand function index, the analytic hierarchy process is used instead of the expert scoring method to determine the excess return that the brand brings to the enterprise. The second is to introduce consumer strength and socio-cultural strength when calculating brand strength. Thirdly, the weight of each factor of brand strength is adjusted, and the fuzzy comprehensive evaluation method is used to calculate the evaluation index. Finally, Y Company is taken as an example to apply the adjusted Interbrand model, and the rationality of the results of this study is expounded. This study modifies the Interbrand model as the basic model, and preliminarily constructs the brand value evaluation system of Chinese pharmaceutical industry, hoping to enrich the research of brand value of Chinese pharmaceutical enterprises with a certain reference significance.Atualmente, na era da informação, marcas fortes podem prolongar o ciclo de vida dos seus produtos e melhorar a competitividade e valor global das empresas na indústria farmacêutica. Neste sentido, este estudo espera contribuir para a construção de um sistema de avaliação de valor da marca ajustado à industria farmacêutica na China, procurando aprofundar, igualmente, a noção de valor de marca para esta indústria. Através de uma análise das vantagens e desvantagens dos principais métodos de avaliação de marca, nacional e internacionalmente, este estudo selecionou o modelo Interbrand para o optimizar e melhorar neste contexto. A tentativa de melhoria do Modelo Interbrand envolve 3 aspetos: primeiro, para a determinação do índice de função de marca, o processo de hierarquia analítica é usado em vez do método de pontuação de especialistas para determinar o retorno que a marca traz à empresa. O segundo procura apresentar a força do consumidor e a força sociocultural ao calcular a força da marca. Finalmente, o peso de cada fator de força da marca é ajustado, e o método de avaliação abrangente "fuzzy" é usado para calcular o índice de avaliação.     Legal Forms and the Common Law of Patents

    The question of institutional choice is important in all areas of the law, but particularly in the context of patent law with its divergent stakeholders, decentralized variance among industries regarding how the patent system is viewed and relied upon, and a persistent focus on reform in recent years. For over two hundred years, the courts have been the dominant force in the development of patent law. It should therefore come as no surprise to learn that a significant portion of American patent law, including some of the most important and controversial patent law doctrines, is either built upon judicial interpretation of elliptical statutory phrases or is devoid of any statutory basis. Thus, while Congress and the courts each have a hand in constructing the latticework of patent law, judges - not the authors of lex scripta - are the principal architects. The common law process - in the Hayekian sense - situates the judge within a given technological community, where norm identification can be more easily recognized and representative legal frameworks constructed that are more closely tethered to relevant social context. Such a pronounced common law role offers an opportunity to exercise significant discretion. How this judicial discretion has been managed can be gleaned from the common law’s willingness to construct legal forms, most notably the choice and balance between the creation of a rule-based (or rule-like) jurisprudence and a more standard-oriented approach. The evolution of the common law of patents has been interstitial and nuanced, displaying an understanding that a body of law devoted to promoting technological innovation - a decentralized enterprise with attendant norms unique to each innovative community - more often than not requires a less dichotomous approach, constructing analytical frameworks that are situated somewhere between a spotless rule and a pure standard. Through the lens of comparative advantage, therefore, this experience provides a strong case for judicial primacy in the context of substantive reform, and an important, yet modest, Congressional role, one limited to (1) bringing about procedural change or altering patent law’s judicial architecture; and (2) engaging in substantive corrective action by addressing a common law gone awry

    "Pemilihan supplier merupakan permasalahan yang komplek pada era Industri 4.0 sekarang ini. Banyaknya jumlah supplier dengan kualitas performansi yang berbeda-beda menyebabkan sulitnya pihak internal perusahaan untuk memilih supplier yang sesuai. Di sisi lain macam-macam bahan baku yang dibutuhkan untuk membuat produk jadi, sangat beragam. Kesesuaian supplier berkualitas yang diperlukan untuk memasok bahan baku yang dibutuhkan oleh industri menjadi hal yang penting untuk diselesaikan. Begitupun halnya dengan industri perakitan traktor tangan, industri kecil menengah ini juga sangat tergantung pada ketersediaan bahan pasokan, dan sudah pasti tergantung pula dengan pemilihan supplier itu sendiri. Penelitian disertasi ini bertujuan untuk memperoleh metode terbaru untuk memilih supplier pada industri manufaktur dengan studi kasus pada perakitan industri kecil traktor tangan. Penelitian disertasi ini diawali dengan kegiatan studi literatur melalui FGD, dan studi pustaka, kemudian diikuti dengan pembuatan desain prototipe aplikasi. Dimana untuk menyusun database bahan baku disusun menggunakan struktur produk pada Bill of Material, penentuan bobot kriteria optimal menggunakan Genetic Algorythms dan pemilihan supplier menggunakan metode multi criteria decision making. Studi kasus penelitian ini di sentra Industri Logam Ceper Klaten Solo, yaitu di Politeknik Manufaktur Ceper. Sedangkan pelaksanaan penelitiannya di Lab Komputasional dan Sistem Informasi serta Laboratorium Rekayasa Sistem Informasi Politeknik Negeri Jember. Uji coba aplikasi diimplementasikan pada studi kasus sesungguhnya, dengan data supplier 153, data bahan baku 70 bahan baku dengan variabel kriteria pemilihan supplier sebanyak 10 variabel. Pada tahap akhir diverifikasi menggunakan kuesioner online Google Form, dengan data responden sebanyak 101, banyaknya responden yg memilih “Sangat mudah” dan “Mudah” atau “Sangat lengkap” dan “Lengkap” atau “Sangat tepat” dan “Tepat” > 80 %, ini menunjukkan bahwa aplikasi / web yang dihasilkan dalam penelitian ini sesuai dengan harapan IKM pengguna (Verified).     System Qualities Ontology, Tradespace and Affordability (SQOTA) Project – Phase 4

    This task was proposed and established as a result of a pair of 2012 workshops sponsored by the DoD Engineered Resilient Systems technology priority area and by the SERC. The workshops focused on how best to strengthen DoD’s capabilities in dealing with its systems’ non-functional requirements, often also called system qualities, properties, levels of service, and –ilities. The term –ilities was often used during the workshops, and became the title of the resulting SERC research task: “ilities Tradespace and Affordability Project (iTAP).” As the project progressed, the term “ilities” often became a source of confusion, as in “Do your results include considerations of safety, security, resilience, etc., which don’t have “ility” in their names?” Also, as our ontology, methods, processes, and tools became of interest across the DoD and across international and standards communities, we found that the term “System Qualities” was most often used.
