Vertaisverkkoteknologian menestys kiinteissä verkoissa on johtanut vertaisverkkototeutuksiin myös mobiileissa verkoissa. Mobiilin vertaisverkkoteknologian tulevaisuuden suhteen on tosin vielä paljon epävarmuutta, koska operaattorit ja muut sidosryhmän jäsenet, jotka kärsivät laittoman tiedostonvaihdon seurauksista kiinteän verkon puolella, pelkäävät saman tapahtuvan myös mobiileissa verkoissa. Täten he saattavat yrittää estää mobiilin vertaisverkkoteknologian kehittymistä. Systeemidynamiikka on toteuttamiskelpoinen vaihtoehto tavallisemmille mallinnustekniikoille, kuten taulukkolaskentamallinnukselle, jonka etuna on järjestelmän takaisinkytkentäsilmukkojen mallintaminen. Kun mobiili vertaisverkkoteknologia kehittyy, enemmän dataa tulee saataville ja vaihtoehtoisten systeemidynamiikkamallien rakentaminen on suositeltavaa. The success of peer-to-peer technology in the fixed networks has led to peer-to-peer implementations in the mobile networks as well. There is, however, a lot of uncertainty regarding the future of mobile peer-to-peer technology as the operators and other stakeholders that were affected negatively by illegal peer-to-peer file sharing in the fixed networks are afraid that it might happen in the mobile domain as well. Thus they might try to prevent mobile peer-to-peer technology from emerging. There is also the question whether there really is a need for peer-to-peer technology in the mobile domain from the end users' perspective, especially as the mobile device capabilities are considerably lower compared to the fixed ones. This thesis concentrates on mobile peer-to-peer content distribution. Content distribution is divided to file exchange, content streaming and commercial content systems. The thesis provides insight to the most relevant scenarios, stakeholders and their incentives related to mobile peer-to-peer content distribution. The uncertainty regarding mobile peer-to-peer content distribution will be bounded using scenario analysis and modeled using system dynamics. The most relevant scenarios regarding mobile peer-to-peer content distribution are constructed using Schoemaker's method and modeling of these scenarios is attempted with system dynamics. As a result four different scenarios are developed based on the key trends and uncertainties discovered during the literature review and brainstorming sessions. Instead of modeling the scenarios quantitatively, the dynamic behavior of a mobile peer-to-peer content distribution system based on the scenarios is modeled with system dynamics. Although there are some mobile peer-to-peer content distribution applications already developed and used, and the topic is considerably researched, it is still uncertain what the outcome of the technology will be. This thesis presents possible outcomes for the technology and provides a starting point for further quantitative modeling of mobile peer-to-peer content distribution systems. System dynamics provides a viable alternative to more common modeling techniques such as spreadsheet modeling, with a distinctive benefit of modeling the feedback loops in a system when used proficiently. As the mobile peer-to-peer technology evolves, more data becomes available and the construction of alternative system dynamics models is encouraged

Fairness concerns in digital right management models

International audienceDigital piracy is threatening the global multimedia content industry and blindly applied coercive Digital Right Management (DRM) policies do nothing but legitimise this piracy. This paper presents new software and hardware infrastructure aimed at reconciling the content providers' and consumers' points of view by giving the ability to develop fair business models (i.e., that preserve the interest of both parties). The solution is based on the use of tamper-resistant devices (smart cards) to securely store sensitive data (e.g., personal consumer data or data expressing the terms of a B2C contract or licence) and to perform the computation required by a contract/licence activation. In other words, smart cards can be seen as tamper-resistant Service Level Agreement (SLA) enablers

Mobile Music Distribution: A Multichannel Approach

    Get PDF
In contrast to what is happening in the Internet-based scenario, the music market in the mobile scenario is far from beingconsidered a large success. Several studies state that excessive downloading time and high cost are the main burdens.Motivated by the growth of social and mobile applications, in this paper we propose an approach that aims at reducing both the downloadingtime and the cost to get digital music when acquired in the mobile scenario. The proposed architecture exploits the usage ofpersonal communication technologies embedded in cellphones (e.g., Bluetooth and Wi-Fi) to couple the current distributionmodel (mainly based on 3G networks), so as to provide a multichannel distribution model where users are free to redistributedigitalmusic. The architecture includes a license-based securitymechanism that prevents unauthorized usage of digitalmusic, and makes use of an incentive mechanism to stimulate and reward the music distribution among customers. By analyzing pros and cons of the music distribution chain, results show that the proposed architecture might help in reducing both the downloading time and the cost to get digital music when acquired in the mobile scenario. Therefore, it might be helpful to the success of the mobile music scenario

Pirates and Samaritans: A Decade of Measurements on Peer Production and their Implications for Net Neutrality and Copyright

This study traces the evolution of commons-based peer production by a measurementbased analysis of case studies and disusses the impact of peer production on net neutrality and copyright law. The measurements include websites such asSuprnova. org, Youtube.com, and Facebook.com, and the Peer-to-Peer (P2P) systems Kazaa, Bittorrent, and Tribler. The measurements show the two sides of peer production, the pirate side with free availability of Hollywood movies on these P2P systems and the samaritan side exhibited by the quick joining of 400,000+ people in a community to organize protests against events in Burma. The telecommunications and content industry are disrupted by this way of peer production. As a consequence, revenues of both industries are likely to suffer in the coming years. On the other hand, innovative P2P systems could win the battle on merit over classical distribution technologies. As a result, a continuation is expected of both legal actions against P2P and possible blocking actions of P2P traffic, violating net neutrality. It is argued that this hinders innovation and causes a large discrepancy between legal and user perspectives. A reform of copyright laws are clearly needed, otherwise they will be unenforceable around 2010. Key words: P2P, collaboration, commons-based peer production, copyright

Legal challenges to future information businesses

The thesis studies new legal challenges to future information businesses: it presents an applicable research method, lists central legal challenges, and discusses the implications of those challenges. I have developed a scenario-based method that produces lists of legal challenges and helps to analyze them. The method highlights information products and services from commercial entity's viewpoint: other business aspects are paid less attention. Also, some specific characteristics of particular companies cannot be considered in a general method like this. Therefore challenges in legal areas such as tax law or competition law do not appear although in practice they can be relevant. The method is still able to point out numerous relevant legal challenges. The study focuses on the future: the time span is about two to ten years from now. The focus is on the business-to-consumer (B2C) market. The emphasis is on strategic product and service development. I have listed, analyzed, and discussed the future legal challenges that the method has found. I conclude that the most important legal challenges to future information businesses are within the areas of privacy and data protection; intellectual property rights; and contracts. I have also discussed the major distinguishers of businesses implying legal challenges. They help to point out the specific legal challenges related to a certain information product or service. Legal rules can affect businesses in many ways. At their best, they enable businesses, but too often they also harm useful activities. I conclude business drivers and hurdles that are important from the legal point of view.reviewe

Toward An Optimal DRM Regulatory Model in China: An Analysis of the U.S, Europe and China

In the scramble for an adjustable and effective copyright law mechanism that can successfully tackle the impediments created by the internet and other new technologies, China began exploring various legal reform models that are in alignment with international conventions and treaties and that is desirably relevant to the mounting demands of the developing Chinese socio cultural and economic setting. In the frantic search for an unassailable solution, China simply borrowed legislative approaches from developed societies, such as the U.S and the EU; China enacted a set of statutes, regulations, and judicial interpretations for the DRM regulatory model mainly through the domestic implementation of international obligations and legal transplant. The transplantation of the DRM model to advance the struggle of copyright protection in China seems somewhat futile owing to the daunting challenge of implementation which has been rather unsatisfactory. The unanticipated technological expansion that is marked by the advent and growth of internet and other groundbreaking innovations caught the legal system largely unprepared and has had many unintended ramifications on copyright laws creating many complications that jeopardizes the efficacy of the most comprehensive international copyright regulatory model. The transplantation and implementation of international copyright regulatory framework by China has been rendered leading to escalating concerns about borrowed laws from other jurisdictions. More than ever, there is an overwhelming need for careful evaluation and scrutiny of foreign regulatory model against the extent of its applicability and relevance in local context. Based on the comparative analysis and the research outcomes, This thesis tries to figure out Direct and indirect strategies for predicament in which China’s legal system has been trapped and also explores to sketch the outline of tentative DRM regulatory model in China to consider
