    Transactional concurrency control for resource constrained applications

    PhD ThesisTransactions have long been used as a mechanism for ensuring the consistency of databases. Databases, and associated transactional approaches, have always been an active area of research as different application domains and computing architectures have placed ever more elaborate requirements on shared data access. As transactions typically provide consistency at the expense of timeliness (abort/retry) and resource (duplicate shared data and locking), there has been substantial efforts to limit these two aspects of transactions while still satisfying application requirements. In environments where clients are geographically distant from a database the consistency/performance trade-off becomes acute as any retrieval of data over a network is not only expensive, but relatively slow compared to co-located client/database systems. Furthermore, for battery powered clients the increased overhead of transactions can also be viewed as a significant power overhead. However, for all their drawbacks transactions do provide the data consistency that is a requirement for many application types. In this Thesis we explore the solution space related to timely transactional systems for remote clients and centralised databases with a focus on providing a solution, that, when compared to other's work in this domain: (a) maintains consistency; (b) lowers latency; (c) improves throughput. To achieve this we revisit a technique first developed to decrease disk access times via local caching of state (for aborted transactions) to tackle the problems prevalent in real-time databases. We demonstrate that such a technique (rerun) allows a significant change in the typical structure of a transaction (one never before considered, even in rerun systems). Such a change itself brings significant performance success not only in the traditional rerun local database solution space, but also in the distributed solution space. A byproduct of our improvements also, one can argue, brings about a "greener" solution as less time coupled with improved throughput affords improved battery life for mobile devices

    Designing a Framework for Maintaining Good Moral Character when Providing Accounting Services to the Legal Cannabis Industry

    Cannabis, once delegated to transactions in the shadows and the constant threat of criminal prosecution, has emerged as a booming industry as states continue to legalize it for medical and recreational use. Federal lawmakers have yet to bless the use of cannabis through legislation, so the threat of criminal penalties looms for both cannabis businesses and the businesses that support them, such as CPA firms. State legalization has brought forth an industry that once operated under the radar into the light of legitimacy. With legitimacy comes the obligation to both report and pay taxes at the federal, state, and local levels. Yet, CPAs, conservative by nature, have reasonable objections to offering these services. Both national and state CPA associations require CPAs have good moral character, but providing services to a federally-illegal business has always stood as a violation of that mandate. This qualitative, multi-case research study using semi-structured interviews of CPAs serving the cannabis industry and CPAs that have elected not to serve the industry provides insights into the concerns regarding engaging legal cannabis clients and a framework to protect good moral character when serving the cannabis industry. The framework consists of two parallel paths, due diligence and due care. Due diligence is the processes undertaken to ensure a thorough understanding of the client.     A contractor-driven stakeholder relationship management framework for Botswana's construction industry

Poor stakeholder management has been identified as a salient contributor to this challenge. To this end, various stakeholder management (SM) frameworks, models and methodologies have been developed. Nevertheless, the increasing incidence of project failure and abandonment in the Botswana construction industry indicates significant underperformance of these SM methodologies. A cursory appraisal of SM models highlights the linearity of the stakeholder relationship management (SRM) curve, i.e. between the client, consultants and contractors, with SRM responsibilities being domiciled with the client or their representative in most cases. Also, the dynamics associated with changes in stakeholder attributes during project delivery are not catered for by extant SM and relationship management models. In addition, extant SM models focus on the relationship between the project stakeholders on the one hand and the external stakeholders on the other, and others cater for project stakeholders alone. This implies that the models currently deployed for SM in the Botswana construction context remain defective. Contracting organisations (contractors) have been blamed for their inability to manage relationships with projects and external stakeholders during project delivery. Yet, these entities are not at the epicentre of SRM on construction projects. This study provides answers to the gaps highlighted. As its central objective, this study set out to develop and validate a contractor-driven stakeholder relationship management framework (CSRMF) for the Botswana construction industry. The emergent framework which leverages on the attributes of the customer relationship model (CRM) overcomes the shortcomings mentioned previously. An interpretivist philosophical paradigm was adopted in this qualitative case study research study based on pre-determined case selection criteria. Owing to the need to attain analytic generalisation through adherence to replication logic, a multi-case study research design was utilised. Six contractor organisations categorised according to scale and operating within Gaborone were selected. The unit of analysis centred on the relationship between the contracting organisations and other project stakeholders on selected projects being procured and delivered under a diverse range of contracting strategies. Data was collected through a sequential multi-method approach in which semi-structured interviews were conducted with project managers representing these construction contracting organisations on the selected projects. To enable replication, care was taken to select two contracting organisations per level – large, medium and small according to prevalent grades. Samples across the different sizes of the contractors allowed for better generalisability. Relevant projects and organisational documents were reviewed. Furthermore, data from the various stages was analysed using the qualitative content analysis technique. The findings of the study show that most of the contractors in Botswana related to their project stakeholders without a model or framework when handling relationship management with project stakeholders. These findings are a reflection of the small, medium and large construction contractors in the Botswana construction industry. There was further indication that the small, medium and large contractors had a way of managing stakeholder relationships and resolving conflicts, and thus the level of experience and knowledge within the contracting firm had a significant influence on how they managed their project stakeholder relationships in the course of project procurement and delivery. In addition, the study findings demonstrate that the nature of contracting strategy had a significant influence on how various categories of contractors related to their stakeholders on construction projects. The traditional method was found to be the main procurement strategy used in the Botswana construction industry, and this approach was fairly rigid to implement effective contractor-driven stakeholder relationship management. Other procurement strategies, such as design-and-build, and construction management are used in Botswana with their positive and negative impacts on contractors’ capability to manage their project stakeholder relationships and related matters effectively. Further evaluation of the findings led to the identification of key success factors for CSRMF development to foster effective contractor-stakeholder relationship management. These key success factors are effective communication, collaboration, engagement and cooperation among clients and contractors and consultants’ commitment; employee (stakeholder) engagement and satisfaction and capacity building; in-depth understanding of all project stakeholders and their importance and influence; and strategies to manage their relationship effectively in the course of project design, procurement and delivery. Based on the evaluation of formulated propositions and analysis of empirical data and results tested in this study, the findings also support the following analytical generalisations: the construction contracting organisations in Botswana do not have any SRM frameworks in place for engaging with stakeholders in their different projects; contractors in Botswana recognise the need to do better in managing their project stakeholder relationships; and there is an apparent gap in technical skills and limited ability of contractors to manage relationships with project stakeholders. Premised on the findings, a contractor-driven stakeholder relationship management framework was developed. The CSRMF was validated by two focus groups, namely sampled project managers from the semi-structured interviews, and relevant professionals and other academics in the industry. The validation was done to assess the relevance of the CSRMF in their management of relations. The CSRMF will provide guidance for bridging the gaps identified. It will be adopted and utilised by contractors to achieve efficiencies in the management of relationships with stakeholders, thus saving time and costs and securing improved quality and, most of all, client satisfaction.Volgens die literatuur misluk die meeste projekte in Botswana.     Occupational hazards

    This article provides an analysis and a critique of the law governing the employment relationship between Israeli employers and Palestinian employees in industries operating in the West Bank. Through an analysis of Israeli jurisprudence it highlights the intersection among different areas of law: choice of law, public international law (in particular the law of occupation), and labor law. The article explores the tensions that this intersection creates: first, between the importance that public international law ascribes to matters of sovereignty and territory, and the latter’s growing marginality in the labor field, which is increasingly becoming transnational; another tension is between the transience underlying the law of occupation and the exceptional duration of Israel’s occupation of the territories, which has led to an economic conundrum not predicted by the framers of the international legal structure, and with which the law of occupation can deal to a very limited extent. Through discussion of these tensions the article brings to the fore challenges to the role of meaning equality in transnational employment relationships, particularly in situations of structured power disparities deriving from political circumstances. While the challenges explored here are intimately linked to the phenomenon of occupation, the increased swiftness with which private companies worldwide are now able to cross borders and set up enterprises outside their state of origin makes the analysis highly relevant to businesses worldwide

This is in the light of a specific indicator that has been agreed by the UN as part of the Sustainable Development Goals (SDGs). The indicator concerned treats the safety of journalists as a benchmark for tracking progress on SDG target 16.10, which specifies “public access to information and fundamental freedoms” (UN Department of Economic and Social Affairs, n.d.) as a development aspiration. Inclusion of this indicator in the SDGs provides a universally legitimated framework with strong catalytic potential. All this holds a promise of improved, more comparative, and increased research output, as compared to the previous situation. The results of new research stimulated by this development, particularly at country level, could have real impact on the safety of journalists

    Developing and initial testing of pro-poor prenuptial agreements as a new land tenure tool to secure rights in urban State-Subsidized Housing

    Includes bibliographic references.This research develops a pro-poor prenuptial agreement as an innovative land tenure tool to secure rights in urban subsidized housing. The model tested is confined to prenuptial agreements under the Marriage Act, but is relevant to other cohabitation or marital agreements that could be used to secure social tenure arising from intimate relationships. The model aims at securing the tenure of the entire household, in particular the more vulnerable members of the household. The research focuses on urban State -subsidized housing, with an emphasis on the Western Cape, South Africa. This housing is transferred to beneficiaries by registration of individual or co-ownership at the Deeds Registry, with the title deeds public documents. While prenuptial agreements are not usually regarded as a land tenure tool, the fact that they are also public documents registered at the Deeds Office makes them pertinent. A limited dataset of recent academic writing is analysed to identify the social context of household conflict and tenure insecurity, and existing legal template clauses assessed. The prenuptial template design is predicated on current tenure approaches that regard informal practices as equally relevant for the poor's tenure security as the formal law. The template uses various strategies to manage tenure insecurity arising from the death of an owner, disputes, or threatened eviction of dependents. It also aims to ensure that diverse normative beliefs are respected, particularly African normative systems. A personal servitude is used to secure housing tenure as a real right burdening the land, making this a very secure right. In addition the template includes a succession agreement and dispute resolution mechanisms. The template model is tested on clients simulated by re-storying the facts of two seminal Constitutional Court cases and a recent case study of another researcher. Focus groups are held with housing beneficiaries and interviews with housing officials, as a preliminary test of the private and public reception of such agreements. The need for legal aid is discussed.
