    Legal Transitions: Some Welfarist Remarks

    This essay offers a sympathetic, utilitarian critique of Louis Kaplow\u27s famous argument for legal retroactivity in his 1986 article, An Economic Analysis of Legal Transitions. The argument, very roughly, is that the prospect of retroactivity is desirable if citizens are rational because it gives them a desirable incentive to anticipate legal change. My central claim is that this argument trades upon a dubious, objective view of probability that assumes rational citizens assign the same probabilities to states as rational governmental officials. But it is subjective, not objective probabilities that bear on rational choice, and the subjective probabilities of rational citizens can diverge from rational officials\u27. I imagine a simple case in which a single Social Planner structures both transition policy and substantive law in some domain. The legal change that the Planner anticipates she would enact in response to a given set of events, and the legal change that the Planner believes one or another citizen believes she (the Planner) will enact in response to those events, can differ. And this means, in turn, that there can be incentive costs to a retroactivity regime as well as a prospectivity regime, even if all actors are fully rational. The utilitarian case for retroactivity is more contingent than Kaplow thinks

    Technology as an observing system : a 2nd order cybernetics approach

    The role of technology in modern society is becoming fundamental to society itself as the boundary between technological utilization and technological interference narrows. Technology penetrates the core of an ever-increasing number of application domains. It exerts considerable influence over institutions, often in subtle ways that cannot be fully understood, and the effects of which, cannot be easily demarcated. Also, the ever-expanding ecosystem of Information and Communication Technologies (ICTs) results in an emergent complexity with unpredictable consequences. Over the past decades this has created a tension that has led to a heated debate concerning the relationship between the technical and the social. Some theorists subsume the technical into the social, others proclaim its domination, others its autonomy, while yet others suggest that it is a derivative of the social. Starting with Luhmann’s remark that technology determines what we observe and what we do not observe, this paper takes the approach that infers there are multiple benefits by looking into how Systems Theory can provide a coherent theoretical platform upon which these interactions can be further explored. It provides a theoretical treatise that examines the conditions through which the systemic nature of technology can be inspected. Also, the paper raises a series of questions that probe the nature of technological interference in other ‘function-systems’ of society (such as the economy, science, politics, etc). To achieve this goal, a 2nd order cybernetics approach is employed (mostly influenced by the works of Niklas Luhmann), in order to both investigate and delineate the impact of technology as system. Toward that end, a variety of influences of Information Systems (IS) are used as examples, opening the door to a complexity that emerges out of the interaction of technology with its socio-economic and political context. The paper describes technology as an observing system within the context of 2nd order cybernetics, and looks into what could be the different possibilities for a binary code for that system. Finally, the paper presents a framework that synthesizes relevant systems theoretical concepts in the context of the systemic character of technology

Rather, we focus on how management can benefit from knowing of the sciences of complexity.     Verification of Agent-Based Artifact Systems

    Artifact systems are a novel paradigm for specifying and implementing business processes described in terms of interacting modules called artifacts. Artifacts consist of data and lifecycles, accounting respectively for the relational structure of the artifacts' states and their possible evolutions over time. In this paper we put forward artifact-centric multi-agent systems, a novel formalisation of artifact systems in the context of multi-agent systems operating on them. Differently from the usual process-based models of services, the semantics we give explicitly accounts for the data structures on which artifact systems are defined. We study the model checking problem for artifact-centric multi-agent systems against specifications written in a quantified version of temporal-epistemic logic expressing the knowledge of the agents in the exchange. We begin by noting that the problem is undecidable in general. We then identify two noteworthy restrictions, one syntactical and one semantical, that enable us to find bisimilar finite abstractions and therefore reduce the model checking problem to the instance on finite models. Under these assumptions we show that the model checking problem for these systems is EXPSPACE-complete. We then introduce artifact-centric programs, compact and declarative representations of the programs governing both the artifact system and the agents. We show that, while these in principle generate infinite-state systems, under natural conditions their verification problem can be solved on finite abstractions that can be effectively computed from the programs. Finally we exemplify the theoretical results of the paper through a mainstream procurement scenario from the artifact systems literature

    From machine ethics to computational ethics

    Abstract: Research into the ethics of artificial intelligence is often categorized into two subareas – robot ethics and machine ethics. Many of the definitions and classifications of the subject matter of these subfields, as found in the literature, are conflated, which I seek to rectify. In this essay, I infer that using the term ‘machine ethics’ is too broad and glosses over issues that the term computational ethics best describes. I show that the subject of inquiry of computational ethics is of great value and indeed is an important frontier in developing ethical artificial intelligence systems (AIS). I also show that computational is a distinct, often neglected field in the ethics of AI. In contrast to much of the literature, I argue that the appellation ‘machine ethics’ does not sufficiently capture the entire project of embedding ethics into AI/S and hence the need for computational ethics. This essay is unique for two reasons; first, it offers a philosophical analysis of the subject of computational ethics that is not found in the literature. Second, it offers a finely grained analysis that shows the thematic distinction among robot ethics, machine ethics and computational ethics

    Design Ltd.: Renovated Myths for the Development of Socially Embedded Technologies

    This paper argues that traditional and mainstream mythologies, which have been continually told within the Information Technology domain among designers and advocators of conceptual modelling since the 1960s in different fields of computing sciences, could now be renovated or substituted in the mould of more recent discourses about performativity, complexity and end-user creativity that have been constructed across different fields in the meanwhile. In the paper, it is submitted that these discourses could motivate IT professionals in undertaking alternative approaches toward the co-construction of socio-technical systems, i.e., social settings where humans cooperate to reach common goals by means of mediating computational tools. The authors advocate further discussion about and consolidation of some concepts in design research, design practice and more generally Information Technology (IT) development, like those of: task-artifact entanglement, universatility (sic) of End-User Development (EUD) environments, bricolant/bricoleur end-user, logic of bricolage, maieuta-designers (sic), and laissez-faire method to socio-technical construction.     Embracing complexity in design is one of the critical issues and challenges of the 21st century. As the realization grows that design activities and artefacts display properties associated with complex adaptive systems, so grows the need to use complexity concepts and methods to understand these properties and inform the design of better artifacts. It is a great challenge because complexity science represents an epistemological and methodological swift that promises a holistic approach in the understanding and operational support of design. But design is also a major contributor in complexity research. Design science is concerned with problems that are fundamental in the sciences in general and complexity sciences in particular. For instance, design has been perceived and studied as a ubiquitous activity inherent in every human activity, as the art of generating hypotheses, as a type of experiment, or as a creative co-evolutionary process. Design science and its established approaches and practices can be a great source for advancement and innovation in complexity science. These proceedings are the result of a workshop organized as part of the activities of a UK government AHRB/EPSRC funded research cluster called Embracing Complexity in Design (www.complexityanddesign.net) and the European Conference in Complex Systems (complexsystems.lri.fr).     Multi Agent Systems in Logistics: A Literature and State-of-the-art Review

    Based on a literature survey, we aim to answer our main question: “How should we plan and execute logistics in supply chains that aim to meet today’s requirements, and how can we support such planning and execution using IT?†Today’s requirements in supply chains include inter-organizational collaboration and more responsive and tailored supply to meet specific demand. Enterprise systems fall short in meeting these requirements The focus of planning and execution systems should move towards an inter-enterprise and event-driven mode. Inter-organizational systems may support planning going from supporting information exchange and henceforth enable synchronized planning within the organizations towards the capability to do network planning based on available information throughout the network. We provide a framework for planning systems, constituting a rich landscape of possible configurations, where the centralized and fully decentralized approaches are two extremes. We define and discuss agent based systems and in particular multi agent systems (MAS). We emphasize the issue of the role of MAS coordination architectures, and then explain that transportation is, next to production, an important domain in which MAS can and actually are applied. However, implementation is not widespread and some implementation issues are explored. In this manner, we conclude that planning problems in transportation have characteristics that comply with the specific capabilities of agent systems. In particular, these systems are capable to deal with inter-organizational and event-driven planning settings, hence meeting today’s requirements in supply chain planning and execution.supply chain;MAS;multi agent systems
