Evropeizace práva v právně teoretickém kontextu

Předložená publikace se zabývá vymezením evropského práva v procesu Evropeizace práva z hlediska právní teorie. Současná proměna práva, spočívající zejména v multicentrismu tvorby a pramenů práva, je důsledkem procesu evropeizace práva. Z externích faktorů k ní přispívá i proces globalizace práva a z interních faktorů sociální a ideová heterogenita a rostoucí komplexity pozdně moderní společnosti. Důsledkem jsou měnící se přístupy k interpretaci právních textů a aplikaci národního práva v souvislosti s implementací norem evropského práva. Proces evropeizace mění pohled na Evropskou unii a evropské právo a přispívá k evropeizaci právní doktríny.Předložená publikace se zabývá vymezením evropského práva v procesu Evropeizace práva z hlediska právní teorie. The recent change of law regards to the multicentrism of law making and pluralism of sources of law as the result of the process of the Europeanization of law. From more important external sources There is also more important external source regarding to globalisation of law. We can recognize same internal sources for the concept of legal multicentrism too, social and ideal heterogeneity and increasing complexity in a late modern society. Implementation of European law brings about the changes in approaches to interpreting legislative texts and application of national law. Process of the Europeanization is changing the vision of the European Union and European law and contributes to the Europeanization of legal doctrine

Filantropie a sociální výzkum: poněkud opomíjená součást dějin sociálníhc věd

Tato studie je recenzní statí ke knize: Christian FLECK, A Transatlantic History of the Social Sciences: Robber Barons, the Third Reich and the Invention of Empirical Social Research. London: Bloomsbury Academic 2011. Z témat, jež rozvíjí Fleckova kniha, sleduje především otázku, jak velké americké nadace formovaly a profilovaly výzkumnou agendu sociálních věd. Je zde předvedeno, jak definice vědy prosazovaná ve dvacátých letech minulého století velkými americkými nadacemi zcela zásadně proměnila samotnou ideu výzkumu a přinesla mnohé institucionální inovace. Vztah filantropie a sociálněvědního výzkumu je sledován jak v obecném smyslu, z hlediska formativních idejí ovlivňujících vývoj sociální věd a reálnou vědeckou praxi, tak i ve vztahu k různým národním tradicím, roli jednotlivých nadací a jejich aktivitám směřujícím k prosazení specifické koncepce vědeckého výzkumu. Pozornost je zde věnována zejména Rockefellerově nadaci, jejíž koncept „realistického" výzkumu významně ovlivnil institucionální dějiny sociálních věd. Studie se rovněž zaměřuje na styl psaní, jenž se uplatňuje v současných textech o dějinách nadací, zejména ve srovnání s dosud převažujícím důrazem na studium intelektuálních dějin sociálních věd

Konstrukce reality - systém - médium

The text discusses the concepts of reality and sense of design in pairs: construction of reality and reality construction (according to the concept and theory of Niklas Luhmann – see bibliography), also presents problems of media in relation to the media and the mass media in terms of philosophy and thinking, media, sociology, communications and information studies, with a specific case of film, in comparison with the medium of photography from the perspective of different imaging techniques. The medium of film and photography is yet perceived as two information systems. This issue is closely related to the concept and issues of time, space, movement. Finally, the text is comparing concept of difference with differentiation. This is the most important idea of the Luhmann´s system theory. Text is used for basic knowledge of a foreign production, but also to strengthen the concepts and the ability to distinguish both within individual disciplines and terminology

Nejasné loajality: způsoby přináležitosti a nepatření migrantů v transnacionálních sociálních polích

Koncepty inkluze a exkluze jsou v dnešní době běžnou součástí nejen akademického, ale i politického diskurzu o migraci. Tyto normativní koncepty a jejich užívání jsou zakořeněny v obrazu migrace jako permanentního jednosměrného pohybu mezi teritoriálně vymezenými národně státními společnostmi. Transnacionální perspektiva poukazuje na rozmanitost migranty obývaných sociálních světů překračujících hranice národních států a na mnohost přináležitostí migrantů. Nastoluje tak otázku re-konceptualizace procesu inkluze/exkluze migrujících jedinců a skupin. Cílem textu je jednak shrnout kritickou debatu, která se rozvinula okolo konceptu integrace pod vlivem transnacionálního paradigmatu, jednak diskutovat některé sociologické otázky spojené s tématem začleňování migrantů, které transnacionální perspektiva otevírá

Regionální diferenciace současného socioekonomického vývoje v České republice

The social transformation in post- totalitarian countries is characterized by extraordinarily dynamic differentiation tendencies. With respect to social groups & territorial communities, these tendencies differ or are even contradictory, resulting in an internal social & territorial polarization in the national systems concerned. These polarization processes are, on the one hand, a reaction to the equalizing tendencies in communist countries, and, on the other hand, are the result of the need for qualitative changes to social structures. One such structure is the regional organization of society, which owing to the heterogeneous nature of the conditions it exists in has very specific features. Essentially it is the environmental organization of society, where the effects of social & natural factors are combined. Consequently, there is typically a higher level of territorial inequality in the distribution of economic activities than in social distribution, and, by contrast, less variability of geographical differentiation than social differentiation. These features are demonstrated in an empirical analysis of the current development in the Czech Republic, wherein a distinction is made between two ways of assessing regional distribution. First, there is the assessment of differentiation of the territorial intensity of economic activities (economic aggregate/km2). Second, there is the assessment of relative economic & social development (economic aggregate/inhabitant). Despite the differences in the level & variability of the two types of regional differentiation, there are similar trends in their development, heading towards greater inequalities

O samotné myšlence jednotné sociologie: Harvard a Columbia

Článek se zaměřuje na historický kontext vývoje americké sociologie v období mezi lety 1930-1965, jež je spojeno se specifickým projektem sjednocení oboru rozpracovaným na Harvardské a Kolumbijské univerzitě. Samotná myšlenka jednotné sociologie je neoddělitelně vpletena do celého projektu americké sociologie jako vědy a své „čisté" vyjádření nalezla v úsilí prokázat „objektivitu a koherenci" sociologického myšlení/vědění. Zcela zřetelně také formovala profesní identitu oboru. Prostředkem zajištění vědecké integrity bylo především zajištění kontinuity teorie a praxe, ježby založilo a o něž by se mohlo opírat pevné metodologické „sebevědomí". Historická kontextualizace tohoto formativního období si klade za cíl sledovat, nakolik myšlenka sjednocené sociologie ovlivnila teoretické a metodologické perspektivy v rámci oboru i vlastní představy o možnosti jeho integrované výzkumné agendy

Marketing Strategy Proposal for Organizational Ergonomics Counseling

Tato bakalářská práce je věnována podpoře rozvinutí oboru organizační ergonomie do podvědomí firem. V teoretické části bude vysvětleno, co znamená pojem organizační ergonomie a jaké druhy marketingových strategií se dají použít pro zviditelnění služeb ergonomického poradce. Závěrem jsou uvedeny návrhy na marketingovou strategii potřebnou k dosažení cíle této práce.This bachelor’s thesis is devoted to developing the field of organizational ergonomics into the subconscious companies. The theoretical part will explain what is meant by organizational ergonomics and what kinds of marketing strategies can be used to visualize services ergonomic consultant. Finally, suggestions are given on the marketing strategy needed to achieve the objectives of this work.

An Employee Education and Development Process in a Chosen Organization

Import 05/08/2014Cílem této bakalářské práce je na základě analýzy popsat systém vzdělávání a rozvoje zaměstnanců u významného železničního dopravce a doporučit návrhy na zlepšení tohoto systému. V teoretické části jsou na základě odborné literatury definovány lidské zdroje, lidský kapitál, řízení lidských zdrojů, systém vzdělávání a rozvoje zaměstnanců. Vymezeny jsou také metody vzdělávání a jejich přínos. V praktické části je na základě polostrukturovaného rozhovoru a poskytnutých interních informací provedena analýza systému vzdělávání a rozvoje zaměstnanců a pomocí této analýzy je systém popsán. Návrhy na zlepšení systému vzdělávání a rozvoje zaměstnanců jsou provedeny na základě vyhodnocení odpovědí z dotazníkového šetření, které následuje po provedení analýzy tohoto šetření.The aim of this thesis is on the basis of an analysis to describe the system of employee education and development at a major railway operator and to recommend proposals to improve the system. The theoretical part of the work based on a specialized literature defines human resources, human capital, human resource management, system of education and development of the employee. Methods of education and their benefits are defined too. In the practical part an analysis of the system of employee education and development is made, based on a semi-structured dialogue and a provided internal information. Using this analysis the system is described. Inovační aktéři a inovační prostředí v modernizační perspektivě

The aim of the paper is to discuss the issue of innovation from the perspective of relevant sociological interpretative frameworks. The discussion starts with an assessment of evolutionary and institutional economic studies of innovation, which have contributed to a better understanding of the role of institutional and social factors in the formation of innovation resources and the performance of (innovating) firms and (innovating) nation states. The concepts of a national innovation system (Nelson), the learning firm (Lundvall) and the social system of production (Hollingsworth) are discussed to explain this contribution in more detail. They indicate a set of socio-cultural factors and circumstances that can be identifi ed not only as implications of the techno-economic power of innovation but also as the autonomous factors that shape the performance of innovating actors. The EU Lisabon strategy is faced with a similar challenge: to balance the issue of competitiveness with environmental issues and social cohesion. The current debate over fulfilling its goals (the Kok report) offers good arguments as to how techno-economic and socio-cultural resources of innovation could be theorised and governed. In this article, selected methodological frameworks and databases (EIS 2005, EXIS) are applied in an analysis of the social forms and structures of national innovation systems. The final discussion refers both to the relevant concepts (the learning economy, knowledge societies, reflexive modernisation) and the analytical data in order to suggest a concept of innovation, which understands both economic and social factors to be productive resources of current innovation performance. The suggested interpretative framework is used to assess the structural dependencies and challenges of the innovation system in the Czech Republic
