    Tinjauan Hukum Atas Frasa “Tanpa Persetujuan” Pada Permendikbudristek Nomor 30 Tahun 2021 Terkait Tindak Seksual di Lingkungan Perguruan Tinggi

    Kekerasan seksual di perguruan tinggi menjadi urgensi yang digiatkan berbagai pihak, khususnya mahasiswa. Menanggapi hal ini, Menteri Pendidikan Indonesia mengeluarkan Peraturan Menteri Pendidikan, Kebudayaan, Riset dan Teknologi Nomor 30 Tahun 2021 tentang Pencegahan dan Penanganan Kekerasan Seksual di Perguruan Tinggi. Namun, timbul penolakan dari sekelompok masyarakat terhadap frasa “tanpa persetujuan” tentang apa saja yang termasuk sebagai kekerasan seksual dalam Permendikbud, karena dianggap melegalkan tindakan asusila yang dilarang dalam norma agama. Penelitian ini mengkaji apa arti dari frasa “tanpa persetujuan” menurut konteks Permendikbud, serta analisa perlindungan hukum yang diberikan. Metode penelitian yang dipakai dalam penelitian adalah metode penelitian hukum normative. Hasil penelitian menunjukkan bahwa frasa “tanpa persetujuan” dalamm hal ini berarti ketika kekerasan seksual terjadi karena adanya paksaan dan bukan atas keinginan korban. Dan ketika hal ini terjadi, Permendikbud memberikan perlindungan yang cukup signifikan kepada korban. Frasa “tanpa persetujuan” memberikan parameter yang jelas untuk kasus bisa ditindaklanjuti, serta pembentukan satuan tugas sebagai pihak yang bertanggung jawab untuk mekanisme penanganan kekerasan seksual dari penerimaan laporan, penyelesaian kasus, hingga ke penyediaan fasilitas pemulihan untuk korban

    PT. Telekomunikasi, Tbk (PT. Telkom) merupakan salah satu perusahaan yang telah menerapkan knowledge management system. Dengan diimplemantasikannya knowledge management system di PT. Telkom perlu dilakukan pengukuran untuk mengetahui kinerja dari knowledge management system. Dalam penelitian ini dilakukan pengukuran kinerja knowledge management system PT. Telkom dengan metode knowledge management balanced scorecard dengan fokus penelitian pada perspektif human capital.Perspektif human capital diturunkan ke dalam tiga dimensi yaitu leadership, staffing, dan empowering. Ketiga dimensi tersebut diturunkan menjadi indikator keberhasilan berdasarkan kategori MAKE (Most Admired Knowledge Entreprise). Terdapat 29 indikator yang digunakan untuk mengukur knowledge management system PT. Telkom. Metode AHP (Anaytical Hierarchy Process) digunakan untuk mendapatkan bobot tingkat kepentingan terhadap dimensi dan indikator keberhasilan. Sementara untuk pengukuran kinerja dengan memberikan skor pada setiap dimensi dan indikator keberhasilan menggunakan metode knowledge management balanced scorecard.Berdasarkan pembobotan dengan metode AHP, didapatkan urutan bobot dimensi dari perspektif human capital adalah dimensi leadership, empowering dan staffing. Hasil pengukuran kinerja knowledge management system PT. Telkom berdasarkan perspektif human capital adalah sebesar 4,5877 dengan kriteria Sangat Baik artinya realisasi dari tiap indikator keberhasilan sesuai atau mendekati target perusahaan.Rekomendasi untuk PT. Telkom dalam meningkatkan knowledge management system adalah memotivasi karyawan untuk berkontribusi dalam CoP dan Kampiun dengan memberikan reward dan memfasilitasi kegiatan tersebut. Penelitian lebih lanjut dapat dilakukan dengan mencari dimensi lain pada perspektif yang sama atau menurunkan indikator yang berbeda dari dimensi yang sama.     ABSTRACT   Health in the modern era is now an inseparable necessity from the development of healthy and smart Indonesian people. Hospitals as one of the health facilities that provide health services to the community have a very strategic role in accelerating the improvement of community health status. Therefore, hospitals are required to provide quality services in accordance with established standards and can reach all levels of society. For this reason, the need for synergy between leaders and employees. Employees still complain about the way leaders handle each employee's complaints, such as complaints of discrepancies between salaries and work performed, employees still feel discriminated in the sense of being discriminated according to social status, the length of the process of determining to become permanent employees, and so forth. From the factors mentioned above that the role of the leader in leading must be wise and fair both for the organization and employees in the organization. This study aims to obtain empirical evidence of whether or not the influence of transformational leadership on job satisfaction is mediated by organizational justice. This study used a correlational quantitative method and the data processing was assisted with SPSS 22. The population of this study was all employees of RSIA Cahaya Bunda including permanent employees and contract employees while the study sample was only 127 permanent employees. Determination of samples using Slovin formula. The results of this study indicate that transformational leadership has a direct positive effect on job satisfaction, organizational justice has a positive effect on job satisfaction, transformational leadership has a positive effect on organizational justice and organizational justice is able to mediate the relationship between transformational leadership and job satisfaction.   Keywords: transformational leadership, job satisfaction, organizational justice, hospital.ABSTRACT   Health in the modern era is now an inseparable necessity from the development of healthy and smart Indonesian people.     MARKET REACTION TOWARDS MERGERS AND ACQUISITIONS ANNOUNCEMENT IN TELECOMMUNICATION FIRMS LISTED IN ASIA-PACIFIC STOCK MARKETS

    Mergers and Acquisitions contributed a crucial role in leading the companies to grow in Asia-Pacific member countries. Especially, most of the countries in this region are still developing countries. The M&A activities are also conducted to achieve operating synergy and financial synergy in the telecommunication industries in Asia-Pacific countries. The announcement of M&A activities could affect the market’s reaction such as share returns and share price volatility. These activities are also often expected to give a positive abnormal return that will increase the shareholder value. Hence, the object of this research was to measure the announcement effect on share return, trading volume and share price volatility by conducting event study. The market model has been used in this research to know the return on the days in the window period during 10 days before (t-10) until 10 days after (t+10) the announcements of acquirer companies that conducted M&A. While to analyze the return of CARs (Cumulative Abnormal Returns) during the event window is computed, AVARit (Average Volatility Abnormal Return) is calculated to know the share price volatility. The firm’s characteristics such as profitability, leverage, and firm’s age were also analyzed in this study to know whether those characteristics has an impact on share return, trading volume and share price volatility besides the M&A announcements. The data collection gathered are secondary data taken from finance.yahoo.com, Redwood Capital, Bloomberg database, and id.investing.com. The data analysis technique is using normality test which is Shapiro-Wilk and Kolmogorov-Smirnov. While Paired t-test and Wilcoxon test were used for hypothesis testing. Furthermore, the Multiple Linear Regression test were also performed to see the significant correlation between specific firms’ characteristics (age, profitability, and leverage), CAR, and AVAR. The result shows that there is no significant different between the abnormal return before and after announcements. The same results are also shown in both trading volume and volatility (AVAR) before and after announcements. Furthermore, the firms’ characteristics have no significant impact on both CAR and AVAR with the total impact of 26.6% and 9.12% respectively; meanwhile, the remaining 73.4% and 90.88% are contributed by another variable that is not included in this research

    Lembar Kegiatan Siswa yang berfungsi sebagai penguat konsep peserta didik dan sebagai media peningkatan tingkat kritis pembelajar sangat jarang ditemukan di pasaran. Pelajaran yang dapat dikaitkan dengan kemampuan berpikir kritis dan model guided discovery adalah materi fotosintesis, dimana materi ini memiliki salah satu karakteristik yakni merancang / melakukan sebuah eksperimen. Penelitian ini bertujuan untuk menghasilkan, mendeskripsikan validitas, kepraktisan dan keefektifan LKS berbasis guided discovery pada materi Fotosintesis untuk melatih keterampilan berpikir kritis kelas XII SMAN 14 Surabaya. Penelitian ini menggunakan metode pengembangan Four D Models yaitu define, design, develop tanpa disseminate. LKS diuji cobakan pada 20 peserta didik kelas XII SMAN 14 Surabaya. Metode pengumpulan data yang digunakan adalah metode telaah, metode observasi keterlaksanaan, metode angket, dan metode tes. Metode analisis data berupa deskriptif, kualitatif, dan kuantitatif. Hasil penelitian menunjukkan bahwa LKS yang dikembangkan valid dengan modus sebesar 3,5 dan reliabel 98,2%, dinyatakan praktis dengan nilai sebesar 96,66%, LKS dinyatakan efektif ditinjau dari penilaian keterampilan berpikir kritis sebesar 75%, hasil belajar sebesar 100%, dan sensitivitas butir soal sebesar >0,30 yakni Antara 0,90-1,00. Berdasarkan hal tersebut, LKS dinyatakan valid, efektif, dan praktis. Kata Kunci: LKS, Guided Discovery, Berpikir Kritis, Fotosintesi

    Penelitian ini bertujuan untuk mengetahui pengaruh financial distress, management changes, audit delay, dan opini audit going concern terhadap auditor switching pada perusahaan sektor financial yang terdaftar di BEI tahun 2018 - 2021. Penelitian ini dilakukan dengan menggunakan metode purposive sampling yang melibatkan 62 perusahaan sektor finansial yang terdaftar di BEI. Analisis data yang digunakan dalam penelitian ini menggunakan analisis regresi logistik dengan alat uji SPSS versi 26. Hasil penelitian ini menunjukkan bahwa management changes berpengaruh terhadap auditor switching, sedangkan financial distress, audit delay, dan opini audit going concern tidak berpengaruh terhadap auditor switching

Penjualan online memungkinkan untuk menjual barang ataupun jasa kepada konsumen dengan media internet, sehingga konsumen tidak perlu berhubungan langsung dengan penyedia barang atau jasa.Factory Outlet Jejak adalah toko yang menjual berbagai jenis pakaian serta assesoris khususnya untuk kawula muda. Factory Outlet ini terletak di jalan Dipatiukur no 66 D Bandung. Sehingga, dalam menjalankan usahanya diperlukan suatu aplikasi yang memudahkan pegawai dalam melayani setiap transaksi pembelian langsung maupun online, dan memudahkan calon pembeli untuk mengakses informasi secara online. Melihat kebutuhan itu, maka dibangunlah Aplikasi Penjualan Factory Outlet Jejak Dipatiukur Berbasis Web.Aplikasi Penjualan Factory Outlet Jejak Dipatiukur Berbasis Web ini berfungsi untuk memudahkan pegawai dalam menangani pengelolaan dan penyimpanan data barang, data penjualan, data pemesanan, data pengiriman, serta data kepegawaian. This application also gives a new alternative for customer to order product by online.     The Development of Two Stay-Two Stray Cooperative Learning Instrument on Respiratory System to Improve Scientific Literacy Skills

    Science literacy is an ability to understand, communicate science through oral or written, apply and analyze the current scientific issues in society.  This study aims to produce a valid, practical, and effective learning tool, and has been carried out using the 4D (Define, Design, Development, and Disseminate) method; however, the Disseminate one wasn’t carried out. The examination was limited in using one group pretest-post test design. The study was conducted within two meetings with 16 who were doing online learning. The data retrieval used a validated instrument. RPP tools with very decent results, LKPD tools (Student Worksheets) with very decent results, and test kits (Pre-test and post-test) with very decent results. As the result, the learning method shows to be very decent, effective, and practical, while the items of the method used are included in the sensitive category ≥0.30

    THE INFLUENCE OF SUSTAINABILITY REPORT DISCLOSURE AND OWNERSHIP CONCENTRATION TO THE COMPANY'S PERFORMANCE

    This research attempts to examine the influence of sustainability report disclosure and ownership concentration towards the company's performance. Our sample consists of 86 listed companies in Indonesian Stock Exchange during 2009 - 2011. We use two models in this research. The first model examined the influence of sustainability report disclosure in aggregate level and ownership concentration towards company's performance. The second model examined the sustainability report disclosure in individual level, measured by disclosure of economic performance, disclosure of environmental performance, and disclosure of social performance, towards the company's performance. This study used the return on asset as a proxy of company's performance. Our result found evidence that sustainability report disclosure whether in aggregate or individual level and ownership concentration have influence towards the company's performance

    The Influence of Advertising Effectiveness on Consumer Purchase Decisions in Wardah Medan Instagram social media Cosmetic Advertising

    This study aims to identify the effectiveness of wardah advertisements through Instagram social media on active @wardahbeauty followers on Instagram. Consumers who use social media Instagram @wardah beauty are active with a total of 92 followers. The data analysis technique used in this study is a validity test, reliability using SPP version 20.0 Based on the results of the study, the validity and reliability test of the questionnaire for each statement item was declared valid and the results obtained were that the independent variable, namely advertising effectiveness (X) had a positive and significant influence on the dependent variable, namely purchase decision (Y), this is indicated by the tcount value = 5.603 and ttable = 2.01537 then tcount > ttable, so Ho is rejected and Ha is accepted. Based on simple linear regression calculations, the regression equation Y = 25.982 + 0.531X + e means that every time there is an increase in the purchasing decision variable by 0.531, it will affect the effectiveness of advertising. The coefficient of determination (R2) is 0.416 (41.6%). So it can be said that 41.6% of the dependent variable, namely advertising effectiveness in this study, can explain purchasing decisions while the remaining 58.4% is influenced by other variables outside the variables studied
