    \u27MODERN ARBITRATION LEGISLATION\u27: A COMPARISON BETWEEN AUSTRALIAN AND INDONESIAN LAWS.

    This research analyzes Law No. 30 of 1999 of Indonesia to ascertain whether this Indonesian law constitutes modern arbitration legislation in the context of international commercial arbitration. Law No. 30 of 1999 will be compared with the International Arbitration Act 1974 (Cth) and the International Arbitration Amendment Act 2010 (Cth) of Australia. In this research, the author finds the Model Law should be adopted by Indonesia to modernize the country s arbitration law in order for it to more acceptable in the practices of international commersial arbitration to day. Furthermore, the adaption of the Model Law also assists to clarity the Indonesian approach to the appircation of public policy principle which can be used to resest arbitral awards in Indonesia.     Socio-Legal Approaches To The Problems of Troubled Indonesian Overseas Workers In Tanjung Pinang City

    Tanjung Pinang City is one of the transit areas for the Troubled Indo- nesian Overseas Workers (TKIB) who are deported from Malaysia and Singa- pore. As a transit area, a number of problems and challenges faced by TKIB and relevant stakeholders in Tanjung Pinang City. This research aims to investigate the problems of TKIB and relevant stakeholders in Tanjung Pinang City.  This research adopts a socio-legal/empirical research method and all data was analyzed based on its content (a content analysis) by using the qualitative approach. The research found that the main hardship in tack- ling TKIB was related to the lack of funds to carry out the tasks and functions of the Task Force. This research argued that the House of Representative of Tanjung Pinang City (DPRD) did not have legal grounds to reject the alloca- tion funds from the City Budget for the Task Force. This research concluded that the House of Representative of Tanjung Pinang city was not familiar Arti- cle 16 (6) of Presidential Regulation No.45 of 2013 regarding Coordination of Returning Indonesian Workers which permits the allocation of funds from the City Budget to fund all expenses carry out tasks of the Task Force.KeywordsPresidential Regulation No.45 of 2013; Troubled Indonesian Overseas Workers; Tanjung Pinang.

    Galangan kapal yang aman menjadi kesukaan bagi Investor,  aman untuk keselamatan jiwa, termasuk kapal harta benda yang ada di dalam lokasi galangan kapal. Agar terjaminnya pelaksanaan sebuah sistim keamanan di galangan kapal maka pemerintah menerbitkan instrumen melalui peraturan menteri perhubungan tentang pemberlakuan penerapan International Ship and Port Sekurity Code (ISPS Code) yang harus dilaksanakan oleh galangan kapal. Tujuan penelitian ini meromendasikan agar ISPS Code dapat diterapkan oleh seluruh galangan kapal yang ada di Kota Batam. Penerapan ISPS Code bertujuan untuk menciptakan rasa aman digalangan kapal. Observasi untuk penelitian ini dilakukan pada salah satu galangan kapal di Batam yang telah menerapkan ISPS Code. Metode yang digunakan dalam penelitian ini adalah penelitian secara empiris yang menghasilkan data dari lapangan berupa hasil penelitian langsung di sebuah galangan kapal.  Implementasi ISPS Code sangat bermafaat bagi pengguna jasa pelabuhan galangan yaitu meningkatkan kepercayaan investor untuk berinvestasi dalam pembuatan kapal baru khususnya di galangan kapal di Kota Batam. Investor semakin percaya pada keamanan yang tersedia di galangan meski nampak birokratis prosedural bagi perusahaan galangan kapal tetapi dampaknya sangat mempercepat pertumbuhan ekonomi

    REVIEWING THE CONSTITUTIONAL RIGHTS ON DEMOCRATIC ELECTION PRACTICES IN INDONESIA AND THE PHILIPPINES

    One form of democracy's embodiment is through general elections. The Philippines and Indonesia are two countries in the Southeast Asian region that are currently still developing their democratic practices through general elections. This study aims to compare how the general elections have been enforced in the two countries to obtain input on the implementation of democracy in Indonesia. The normative legal research design was used in this study, and data collection was carried out through a literature study. The functional comparative approach compares the implementation of general elections in the two countries. The data collected by literature searches were analyzed using a qualitative juridical analysis method. The analysis shows that although the two countries have declared themselves democracies and the general election is the form of their implementation in the constitution, general elections have been used to perpetuate power in both countries. The two countries have differences in implementing general elections due to historical differences and national problems. The most distinguishing matter that can be learned is how the Philippines implemented the general election through the existence of a plebiscite that makes the people more involved in the state process. In addition, information technology in the Philippines' general election has also made the process of conducting the general elections effective and efficient. This study is still limited to analyzing general elections at the national level, especially the presidential and vice-presidential elections. Further research on the general elections of legislature members and regional heads can add to our understanding of the comparative implementation of the two countries

    Problematika Ratifikasi Konvensi Konvensi Organisasi Perburuhan Internasional (ILO) C188 Sebagai Perlindungan Hukum Bagi Pekerja Migran Indonesia

    Indonesian Migrant Workers (PMI) who work in the domestic sector generally have received a lot of attention and attention from the public, as crew members of fishing boats owned by foreign companies receive less attention both regarding safety and the protection of their rights. Therefore, this research aims to emphasize the importance of Indonesia to ratify the convention as a form of effort to provide protection for workers on foreign ships, as well as provide a sense of security and legal certainty in the future. The Indonesian government has not taken serious steps to accommodate the interests of Indonesian crew members working on foreign fishing vessels. The research used in this research is juridical-normative legal research. The state has an obligation to provide human rights protection without having to be asked. Therefore, it is important for the Indonesian government to ratify ILO Convention 188 of 2007 in overcoming legal replacements left by national regulations, guaranteeing workers' rights, and creating legal certainty. The need for harmonization of existing and applicable laws and regulations regarding the protection of fishery workers in Indonesia should be taken into consideration when the government decides to ratify ILO Convention 188 of 2007.Pekerja Migran Indonesia (PMI) yang bekerja di sector domestic umumnya telah banyak mendapatkan sorotan dan perhatian publik, sebagai ABK kapal nelayan milik perusahaan asing kurang mendapatkan perhatian baik menyangkut keselamatan maupun perlindungan terhadap hak-hak mereka. Oleh karena itu, penelitian ini bertujuan dapat memberikan penekanan pada pentingnya untuk Indonesia agar meratifikasi konvensi tersebut sebagai bentuk upaya memberikan perlindungan bagi para pekerja di kapal asing, serta memberikan rasa aman dan kepastian hukum di masa yang akan datang. Pemerintah Indonesia belum mengambil langkah serius untuk mengakomodasi kepentingan ABK Indonesia yang bekerja di kapal penangkap ikan asing. Penelitian yang digunakan dalam penelitian ini adalah penelitian hukum yuridis-normatif. Negara memiliki kewajiban untuk memberikan perlindungan HAM tanpa harus diminta. Oleh karena itu, penting bagi pemerintah Indonesia untuk meratifikasi Konvensi ILO 188 tahun 2007 dalam mengatasi ketidakpastian hukum yang ditinggalkan oleh peraturan nasional, menjamin hak-hak pekerja, dan menciptakan kepastian hukum. Perlunya penyelarasan peraturan perundang-undangan yang ada dan berlaku tentang perlindungan pekerja perikanan di Indonesia harus menjadi pertimbangan pada saat pemerintah memutuskan untuk meratifikasi Konvensi ILO 188 tahun 2007

    This study aims to analyze and describe the harmonization of labour law in the ASEAN region, especially Indonesia, Singapore and Vietnam in support of the ASEAN Mutual Recognition Arrangement. This research was conducted by using a normative juridical research method, with a statute approach. The study found that in welcoming the ASEAN Economic Community 2025 as a follow-up to the 2015 ASEAN Economic Community which has ended, the ASEAN member states have agreed to create a regional free market that aims to improve the living standards of the ASEAN community which has implications for the moral awareness of ASEAN member states that must unite in their territory in a free market. The reality of the implementation of the ASEAN Economic Community 2025, specifically regarding the free market for professional services in the region, the ASEAN member states have not moved seriously to implement it, each of the ASEAN member states is still using its country's positive regulations/laws which may lead to a free labour market process in the territory of their respective countries. The harmonization of regulations relating to foreign workers in each positive law of the ASEAN member states is very urgent and necessary, both formal and immaterial form in supporting ASEAN Mutual Recognition Arrangements. So that the vision and purpose of the establishment of the 2015 ASEAN Economic Community which is then followed by the 2025 ASEAN Economic Community are to create a free market and improve the competitiveness of human resources and the quality of human resources so that the creation of an integrated economic area can be achieved.Penelitian ini bertujuan untuk menganalisis dan memaparkan diperlukannya harmonisasi hukum ketenagakerjaan di kawasan ASEAN dalam mendukung ASEAN Mutual Recognition Arrangement. Penelitian ini dilakukan dengan metode penelitian yuridis-normatif, dengan pendekatan perundang-undangan (statute approach). Dalam menyongsong Masyarakat Ekonomi ASEAN 2025 sebagai tindak lanjut dari masyarakat ekonomi ASEAN 2015 yang telah usai, masyarakat negara anggota ASEAN telah menyepakati untuk menciptakan pasar bebas kawasan yang bertujuan untuk meningkatkan standar hidup masyarakat ASEAN yang berimplikasi terhadap kesadaran moral negara anggota ASEAN yang harus bersatu dalam wilayah teritori dalam sebuah pasar bebas. Realitas pelaksanaan masyarakat ekonomi ASEAN 2025, secara khusus mengenai pasar bebas jasa professional dikawasan negara anggota ASEAN belum bergerak secara sungguh-sungguh untuk melaksanakannya, masing-masing negara anggota ASEAN masih tetap menggunakan regulasi/hukum positif negaranya yang berpotensi menghambat proses pasar bebas ketenagakerjaan di wilayah negaranya masing-masing. Pengharmonisasian regulasi yang berkaitan tentang tenaga kerja asing ditiap-tiap hukum positif negara anggota ASEAN ini sangat mendesak dan mutlak diperlukan, baik yang bersifat formil maupun bentuk materil dalam mendukung ASEAN Mutual Recognition Arrangement. Sehingga visi dan tujuan dibentuknya masyarakat ekonomi ASEAN 2015 yang kemudian dilanjutkan dengan masyarakat ekonomi ASEAN 2025 untuk menciptakan pasar bebas dan meningkatkan daya saing SDM serta mutu kualitas SDM sehingga terciptanya kawasan ekonomi yang terintegritas bisa tercapai

    ANALISIS YURIDIS PENGATURAN ABORTUS PROVOKATUS TERHADAP KORBAN PEMERKOSAAN DI INDONESIA

    Abortion or abortus provokatus constitutes a termination of pregnancy before the time of delivery. The objective of the study is to ascertain if the Abortion-related Health Law is a realistic rule based on the health aspects, as well as to analyze how long it should be allowed by the Health Law to perform an abortion according to medical criteria. The study uses a method of normative legal research. It concludes that the Health Law pertaining abortion is a realistic rule based on health aspects. Yet, it  is necessary to revise the abortion rules due to rape incidents. The rules permits the abortion if the gestational age is 6 (six) weeks or 40 (forty) days. It is calculated from the first day of the last period. It suggests that the gestational age should be 12 (twelve) weeks or 3 (three) months from the first day of the last period.   Keywords: Abortus Provocatus, Legal Protection, Rape Victim

    Potensi Terjadinya Persaingan Usaha Tidak Sehat pada Penggunaan Aplikasi Perdagangan Elektronik di Era Revolusi Industri 4.0

    Perkembangan teknologi di era industri 4.0 begitu pesat dan mempengaruhi kebiasaan masyarakat. Perubahan yang paling jelas terlihat adalah semakin banyaknya pelaku usaha yang memanfaatkan aplikasi perdagangan elektronik untuk menjalankan kegiatan usahanya, hal itu juga diikuti dengan minat konsumen yang semakin banyak bertransaksi dengan aplikasi tersebut. Penelitian ini bertujuan untuk mengetahui potensi terjadinya praktik persaingan usaha tidak sehat pada penggunaan aplikasi perdagangan elektronik saat ini, mengingat Undang-Undang Nomor 5 Tahun 1999 tentang Larangan Praktek Monopoli dan Persaingan Usaha Tidak Sehat lahir sebelum revolusi industri 4.0 terjadi. Melalui penelitian hukum normatif diketahui bahwa terdapat beberapa tindakan yang dilarang dan berpotensi terjadi dalam aplikasi perdagangan elektronik seperti oligopoli, penetapan harga, pemboikotan, oligopsoni dan perjanjian tertutup.Perkembangan teknologi di era industri 4.0 begitu pesat dan mempengaruhi kebiasaan masyarakat.     Regulasi Keinsinyuran dalam Konteks ASEAN Mutual Recognition Agreement on Engineering Services

    Infrastructure development is a benchmark for a country's achievement. Indonesia as developing countries makes various acceleration efforts by increasing the quality and quantity of engineers as the main actor to produce quality development plans. In addition, considering the development of the ASEAN Economic Community (AEC), engineering practice is expected to contribute globally, especially in ASEAN countries. To answer this, the Government of Indonesia issued Act Number 11 of 2014 concerning Engineering and Act Number 2 of 2017 concerning Construction Services. These two Regulation serve as legal protection for the implementation of engineering practice. However, along with the dynamics of political interests, the implementation of these two regulations are actually contradictive and they inherent the ambiguity of the roles of several intersecting institutions related to the engineering profession certification process. Hence this study aims to analyzes the disharmonization of the regulations and to offer solutions. To achieve the aims, the study uses a sociological juridical method that examines the provisions of the two act and examines in depth the realities that exist in society. Beside that, the method use the secondary legal material such as Mutual Recognition Agreement (MRA) on Engineer Service in ASEAN. This article offers a critical approach obtained from the Focus Group Discussion as a public sphere for the gap in engineering practice certification.  In this study, it was found that there are gaps in the function and flow mechanism in obtaining competency certificates. This condition has led to a tendency for professional actors to choose an easiest requirement but provide a large access to participate in various government projects. The study concludes that basically the presence of these two acts are beneficial in regulating engineering practices, but they are not supported by massive information and consistency of the government as a regulator and the synergity of the institutions involved in implementing these regulations has not been optimal

    The issue of licensing agreements to improve the standard of living of people in Indonesia is very interesting to be studied in depth via intellectual discussions. Various problems should be taken as lessons for Indonesian people, for example: registration of the Toraja coffee trademark by the American businessmen, sambal uleg from Central Java and Gayo coffee by the Dutch and the song Sayang Sayange from Maluku and the legend of Garlic and Onion by Malaysia. The purpose of writing this article is to provide an explanation of the necessity to strengthen understanding of trademark law in the license agreement as an effort to improve the economic level of the Indonesian people. The problems focus on the government actions against the violations of Intellectual Property Rights (IPR) and as well as the roles of the government and society to improve the economic level of society through strengthening trademark law in license agreements. The research was conducted by using a normative legal research. The result of the research described in this article is that the economic level of the community can be increased by conducting a franchise business, providing opportunities for the franchisor to exploit economic rights in order to multiply and get the maximum profit at a low cost because it is borne by the franchisee.Keywords: Trademark, License Agreement, Economic Strat
