    THE DEATH PENALTY AS A MODEL TO PROVIDE A DETERRENT EFFECT AGAINST PERPETRATORS OF PREMEDITATED MURDER

    The execution of the death penalty in cases of premeditated murder is, in fact, not easy. The old Criminal Code did not define the terms and conditions for premeditation elements. The purpose of this research is to analyze Death Penalty in Indonesia and The Urgency of Death Penalty in Creating A Deterrent Effect in Premeditated Murder. The method used in this legal research is normative juridical. Normative juridical research is research that is focused on examining the application of rules or norms in positive law. Indonesia is one of the countries that still maintain death penalty because death penalty is a criminal sanction that is still relevant in preventing and eradicating serious crimes. This can be seen in Constitutional Court Decision Number 2-3/PUU-V/2007. The provisions on death penalty for perpetrators of premeditated murder in the Law of the Republic of Indonesia Number 1 of 2023 concerning the Criminal Code have made it difficult for death penalty to be imposed on perpetrators of premeditated murder

    The perpetrator of assisting bribery in a succession of criminal acts holds a significant role, which has legal implications that necessitate thorough and conclusive investigations into those who assist in bribery. In looking at the position of perpetrators of assisting bribery, the ambiguity of Article 15 of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Criminal Acts of Corruption has had a major impact on the rechtsvacuum in the criminal conviction system in bribery criminal policies. Through a normative method, this article's investigation reveals that convictions in bribery cases extend beyond only the active and passive perpetrators. Evidently, individuals who abet on bribery cannot be disregarded. Moreover, the ambiguity of the rules regarding assisting bribery, Article 15 of Law Number 20 of 2001 concerning Amendments to Law Number 31 of 1999 concerning the Eradication of Corruption Crimes, has created a rechtsvacuum in terms of convicting those involved in bribery cases. This scenario unequivocally leads to ambiguity in enforcing criminal penalties for bribery assistance perpetrators

    Notaries have an important role in resolving legal problems in society, the evidence used by notaries is written. Notaries are responsible for maintaining public trust and upholding legal ethics and dignity in carrying out their profession. On the other hand, notaries must be proper and comply with the Code of Ethics which is based on Notary Position Law No. 2 of 2014, as amended by Law No. 30 of 2004, hereinafter referred to as UUJN. Notaries are required to comply with statutory regulations. If the notary does not comply with applicable statutory regulations, he will receive sanctions in accordance with the violations he has committed. Notaries who are proven to have violated the obligations and prohibitions of Notaries as regulated in Article 16 paragraph (1) letter a, Article 16 paragraph (1) letter d, Article 16 paragraph (1) letter e, and Article 16 paragraph (1) letter m UUJN, can be subject to sanctions in the form of civil sanctions, administrative sanctions, code of ethics sanctions and even criminal sanctions. Notaries who commit violations are not immediately punished, Article 7 paragraph 2 states that "Notaries who violate the provisions may be subject to sanctions in the form of: written warning; temporary dismissal; honorable dismissal; or dishonorable dismissal." Notaries who violate these provisions will be given the opportunity, if the notary who violates continues to repeat the same violation, the Honorary Board and the Supervisory Council each have the right to carry out their own examination if there are individual notaries who commit violations. Notaries who knowingly violate the code of ethics can be subject to sanctions and can harm the parties and the notary himself

    Abstrak : Undang-Undang No. 31 Tahun 1999 jo Undang-Undang No. 20 Tahun 2001 tentang Pemberantasan Tindak Pidana Korupsi dalam praktiknya telah menimbulkan beberapa permasalahan, diantaranya adalah berkaitan dengan penerapan penjatuhan pemidanaan yang dirasa masih kurang adil, contohnya seseorang swasta dalam perkara tindak pidana korupsi hanya merugikan keuangan negara sejumlah Rp.50.000.000.00 di pidana dengan pidana penjara minimal 4 tahun untuk Pasal 2 dan seseorang yang mempunyai jabatan dan merugikan keuangan negara Rp.500.000.000.00 di nyatakan bersalah melakukan tindak pidana korupsi sebagaimana yang dimaksud dalam Pasal 3 dan di pidana dengan pidana selama 1 tahun, serta dalam praktiknya terdakwa yang tidak menikmati hasil korupsi dan hanya sebagai seseorang yang turut serta membantu kejahatan juga di pidana penjara sama dengan pelaku utama tindak pidana korupsi, hal tersebut dilakukan oleh hakim karena belum adanya aturan atau pedoman penjatuhan ancaman pidana minimal khusus dalam undang-undang tindak pidana korupsi.Undang-undang No. 31 tahun 1999 jo Undang-undang No. 20 tahun 200 tentang pemberantasan tindak pidana korupsi hanya mengatur tentang ancaman pidana maksimal dan minimal, sedangkan untuk tahap aplikasi, ancaman pidana minimal khusus dalam Undang-undang Undang-undang No. 31 tahun 1999 Jo Undang-undang No. 20 Tahun 2001 tentang pemberantasan tindak pidana korupsi tidak ada karena tidak adanya pedoman atau aturan dalam penjatuhan pidana minimal khusus  sehingga hakim tidak dapat menjatuhkan pidana dibawah batas  minimal ancaman pidana yang ditentukan oleh undang-undang. Kata Kunci: Kebijakan Formulasi, Ancaman Pidana Minimal Khusus.

    The purpose of this paper is to examine mediation as a way effective to reduce the divorce rate and the obstacles and challenges that create mediation as the means chosen to reduce the divorce rate in Indonesia. Suatu institusi pendidikan yang sejatinya merupakan tempat untuk tumbuh dan berkembangnya peserta didik dalam urusan literasi dan juga pengembangan soft skill harusnya menjadi suatu tempat atau ruang yang aman dan nyaman bagi mereka. Akan tetapi, nampaknya hal tersebut tidak berlaku bagi para penyitas kasus tindak pidana kekerasan terhadap perempuan. Kasus seperti ini benar-benar nyata dan banya terjadi, baik di sekolah maupun di lingkungan perguruan tinggi dan sudah menjadi rahasia umum yang sengaja di lupakan oleh sebagian besar pihak didalamnya. Upaya pencegahan dan penanganan kekerasan seksual yang kerap sekali terjadi di lingkungan perguruan tinggi tersebut yaitu Menteri Pendidikan, Kebudayaan, Riset, dan Teknologi (Permendikbudristek) mengeluarkan Peraturan Nomor 30 Tahun 2021 tentang Pencegahan dan Penanganan Kekerasan Seksual (PPKS) di lingkungan perguruan tinggi. Peran pihak kepolisian terkhusus pada Unit PPA (Pelayanan Perempuan dan Anak) ini juga dapat dioptimalkan membantu proses pelaporan/ aduan dari korban yang mengalami kekerasan seksual di lingkungan kampus setelah mendapatkan pendampingan dari pihak perguruan tinggi. Hal ini merupakan upaya yang dapat dilakukan pihak kepolisian melalui upaya pencegahan, penanggulangan, sehingga dapat mewujudkan keamanan bagi korban tindak pidana kekerasan seksual di lingkungan perguruan tinggi. Peran Unit PPA merupakan bagian dari kepolisian yang dibentuk untuk memberikan perlindungan kepada perempuan dan anak. Unit PPA diharapkan dapat memberikan konstribusi yang signifikan dalam menjalankan tugas fungsinya sebagai institusi yang bertanggung jawab dalam melindungi tindak pidana kekerasan seksual yang saat ini terjadi di lingkungan perguruan tinggi.Sexual harassment that occurs in the world of education has become a very highlighted thing lately, such as a case that has recently occurred in the college environment. An educational institution that is actually a place for the growth and development of students in matters of literacy and also the development of soft skills should be a place or space that is safe and comfortable for them. However, it seems that this does not apply to survivors of cases of violence against women. Cases like this are really real and many happen, both in schools and in college environments and have become an open secret that is deliberately forgotten by most parties in it. Efforts to prevent and handle sexual violence that often occurs in the university environment are the Minister of Education, Culture, Research, and Technology (Permendikbudristek) issued Regulation Number 30 of 2021 concerning the Prevention and Handling of Sexual Violence (PPKS) in the university environment. The role of the police, especially in the PPA (Women and Children Services) Unit, can also be optimized to help the process of reporting / complaints from victims who experience sexual violence in the campus environment after receiving assistance from the university. This is an effort that can be done by the police through prevention, countermeasures, so as to realize security for victims of sexual violence crimes in the university environment. The role of the PPA Unit is part of the police force formed to provide protection to women and children. The PPA unit is expected to make a significant contribution in carrying out its function duties as an institution responsible for protecting sexual violence crimes that currently occur in the university environment

    Ilmu Nahwu (gramatika bahasa Arab) merupakan salah satu cabang linguistik (ilmu lugah) dalam bahasa Arab yang mempelajari kaidah-kaidah dalam kebahasaan Arab. Diantara pembahasan dalam Ilmu nahwu yaitu Maf`ul Muthlaq dan Masdar, dimana pada kedua isim ini memiliki kesamaan dalam bentuknya, namun juga tidak dapat dikatakan sama. Maka dari itu, penulis menjadikan perbedaan dari kedua isim tadi sebagai pokok pembahasan dalam jurnal ini. Dalam penyusunan jurnal ini penulis menggunakan pendekatan kajian pustaka, yang mana penulis mengumpulkan berbagai sumber data baik dari artikel maupun buku yang terkait dengan tema jurnal ini. Selain itu, penulis juga menggunakan metode kualitatif komparatif, yaitu menganalisis data untuk dapat menemukan persamaan dan perbedaan dari tema yang kami angkat. Hasil penelitian dalam jurnal ini berupa penjelasan mengenai Maf`ul Muthlaq, Masdar, dan tentunya perbedaan antara keduanya berdasarkan prespektif Ahli Nahwu

    Education management in the new normal era: a literature study

    The objective of this article is to offer a general overview of how face-to-face learning can be utilized in the context of the new normal era and to identify potential learning models that teachers can employ in addressing educational challenges within this era. In the process of developing this article, a literature review method was employed. The data collection process included a comprehensive review of various references from national and international journals that are pertinent to the subject matter under discussion. Upon conducting thorough research, the author will then select, analyze, and present results in a systematic manner. The learning model represents a significant element within the context of learning. As an individual occupying a pivotal role in the learning process, the teacher is responsible for applying an optimal learning model to ensure the successful attainment of learning objectives. A selection of models that can be utilized for learning within the new normal era includes: Three learning models are worthy of mention: Blended Learning, Flipped Classroom, and Hybrid Learning. In applying any of the aforementioned models to the learning process, it is important to consider the specific characteristics of each learner and the abilities of the instructor
