    L’article de cet auteur présente la remarquable continuité historique de la compétence législative de l’État central allemand en matière de sécurité sociale. Les assurances sociales sont une création de l’État central il y a plus d’un siècle. Cette attribution n’a pas changé malgré les différents régimes politiques et les nombreuses formes étatiques qui se sont succédé en Allemagne. La délégation de gestion de ces assurances sociales à des institutions autonomes mais sous tutelle de l’État central est le second trait remarquable du modèle allemand.This article stresses the remarkable historical continuity in the legal powers of the German central state in the domain of social security. The central state created the social insurance regimes more than a century ago and its responsibility for them has not changed, despite the different political regimes and state forms that have followed one after another in Germany. The assignment of the management of these regimes to autonomous institutions is the second distinguishing characteristic of the German social model

    The right to social security in the European constitutions

    In the Basic Law ("Grundgesetz") - the German Constitution - a special and coherent catalogue of social human rights is not foreseen. Only a few social rights' guarantees primarily as to women, mothers, children and handicapped persons are explicitly stipulated. Therefore, in the current German legal thought social human rights are regarded as neither fundamental, nor integral parts of human rights. As the full spectrum of human rights acknowledged in international law, among them above all the basic social human rights to work, education, health, accommodation, social security or social assistance (Articles 22-26 UDHR), does not correspond to the far more restricted catalogue of human rights explicitly figured out in the Basic Law as fundamental rights ("Grundrechte"), the doctrine argues even more that due to their very legal nature social human rights could not and never exist

    Το παρόν άρθρο υποστηρίζει ότι η διαδικασία της ευρωπαϊκής ενοποίησης έχει επηρεάσει τις αρμοδιότητες των κρατών μελών στον τομέα της κοινωνικής πολιτικής. Το στοιχείο αυτό είναι εμφανές τόσο στο πρωτογενές, όσο και στο δευτερογενές Δίκαιο της Ε.Ε., καθώς και μέσω του αυξανόμενου ρόλου των εργαλείων ήπιουσυντονισμού, όπως είναι η Ανοικτή Μέθοδος Συντονισμού (ΑΜΣ). Η επίδραση αυτή ωστόσο δεν αναμένεται να οδηγήσει στη διαμόρφωση ενός ευρωπαϊκού κοινωνικού κράτους, αλλά στην ενίσχυση της δράσης στα πλαίσια ενός υπερεθνικού οργανισμού.The present paper argues that the European integration process has eroded the competence of member states in the social policy field. This process is discerned both in primary and secondary legislation, as well as in growing impact of soft policy instruments, such as the open method of coordination (OMC). However, this influence will not result in the formation of a European welfare state, but will be based on strengthened action within a supranational organization
