    Ritualitas ibadah puasa ramadhan bukanlah sekedar ibadah yang berdimensi legal formalistik semata, seperti syarat, rukun, dan sah, batal atau tidaknya ibadah puasa tersebut. Namun demikian penting disadari bahwa pensyariatan ibadah puasa memiliki nilai-nilai falsafah hukum Islam yang termuat di dalamnya. Penelitian ini bermaksud untuk mengeksplorasi nilai-nilai maqasid shariah yang termuat dalam perintah kewajiban ritualitas ibadah puasa ramadhan. Jenis penelitian ini merupakan penelitian kualitatif berupa kajian pustaka (library research) dengan pendekatan normatif filosofis. Sumber  data  yang digunakan, yakni pelbagai literarur ilmiah, baik berupa buku (kitab) dan artikel jurnal ilmiah terkait pembahasan nilai-nilai falsafah ibadah puasa ramdhan. Sementara itu, teori analisis yang digunakan, yakni teori maqasid shariah yang dikembangkan oleh Jasser Auda. Hasil penelitian menyimpulkan terdapat tiga nilai maqasid shariah yang termuat dalam ibadah puasa ramadhan, antara lain (1) Peningkatan keimanan sebagai orientasi hifz din (2) Pendidikan karakter sebagai orientasi hifz nafs (3) Kepeduliaan sosial sebagai orientasi hifz mal

    This study aims to reveal social prophetic values ​​in the principles of political ethics in Indonesia. This research is a qualitative research in the form of literature review. This type of legal research is normative legal research with a philosophical approach. The primary data source of this research is the text of the code of ethics of politicians and political parties. Meanwhile, secondary data sources use various scientific studies that are relevant to the object of discussion. The analytical theory approach used is Kuntowijoyo's social prophetic paradigm theory. This study concludes that the various principles of political ethics in Indonesia are parallel with the values ​​of humanization, liberation and transcendence. First, the principle of public benefit is parallel to the teachings of ukhuwah insaniyah and ta'awun insani. Second, the principle of honesty is parallel to the nature of shiddiq. Third, the principles of integrity and professionalism are parallel to the teachings of the khaira ummah, justice, deliberation, ulul albab, Imamat, and tauhid which are liberating. Fourth, the principle of accountability parallel with amanah. Fifth, this principle of justice is parallel to the universal teaching of Islam in the form of al-adalah

    GENDER MAINSTREAMING IN THE HERMENEUTICS OF ISLAMIC FAMILY LAW

    The problem of gender discrimination for women can occur in all spaces, both public and private spaces as well as in family life. This problem is not only caused by biased socio-cultural construction but can also be caused by biased interpretation of Islamic teachings. Even Though in the Qur'an and the Hadith itself highly upholds the equality of existence between men and women. There are two main objectives in this study. First, to find gender mainstreaming in the construction of Amina Wadud's al-Qur'an hermeneutic method. Second, to understand the application of Amina Wadud's hermeneutic method in interpreting verses about the pattern of gender relations in the family. This research is qualitative in the form of a literature study with a philosophical normative approach. The primary source used is an explanation of Amina Wadud's hermeneutic method in her book entitled Qur'an and Woman Rereading the Sacred Text from a Woman's Perspective. Meanwhile, secondary sources used are various relevant studies. There are two big conclusions of this research. First, Amina Wadud's hermeneutic al-Qur'an method considers three aspects as the basis for the interpretation of a text (verse), among others, the context in which the text was written and interpreted, the grammatical text, and the weltansanschaung. By considering these three aspects, Wadud tried to reinterpret a theological basis (verses of the Qur'an) related to the pattern of gender relations that have been interpreted by many classical commentators. Secondly, Wadud better understood the verses of gender relations in the family as functionalist relations. The functional relationship in question is the cooperative relationship over the distribution of rights and responsibilities between men and women based on their potential.Keywords: Hermeneutics; Amina Wadud; Gender Relations; Family

    Penelitian ini bermaksud untuk mengeksplorasi sejarah perkembangan tugas maupun wewenang penghulu di Indonesia dalam tiga masa, yakni masa kerajaan Islam di Nusantara, pemerintahan kolonial Belanda, dan pasca kemerdekaan. Peneltian ini merupakan penelitian kualitatif yang berupa kajian pustaka. Jenis penelitian hukum dalam penelitian ini masuk dalam kategori penelitian hukum normatif empiris dengan pendekatan sejarah. Hasil penelitian menunjukan bahwa tugas dan wewenang penghulu di Indonesia dari masa ke masa semakin mengalami penyempitan. Hal tersebut disebabkan oleh faktor dinamika sosial politik pemerintahan yang ada. Pada masa kerajaan Islam Nusantara, tugas dan wewenang penghulu sangat kompleks dan multi fungsi, yakni persoalaan agama secara umum, penasehat spritual pengusa, bahkan politik. Kemudian, pada masa pemerintahan kolonial Belanda, peran dan tugas penghulu dibatasi pada persoalan perdata Islam. Selanjutnya, pada masa pasca kemerdekaan, tugas dan wewenang penghulu semakin mengalami penyempitan, yakni dibatasi pada persoalan pernikahan dan perceraian

    It is undeniable that in the realm of praxis of religious and state life in Indonesia, there are still some people who clash Pancasila with religious teachings. Whereas as a state ideology, Pancasila actually contains the value of forming moderate religious understandings and attitudes for the benefit of life between religious people in Indonesia. This study intends to identify the dimensions of religious moderation values in the construction of Pancasila. This literature research uses a normative-philosophical approach. The results of the study concluded that there are dimensions of religious moderation values contained in the construction of Pancasila. First, the value of tolerance in the first precept is in the form of the value of forming paradigms and social attitudes of religion that prioritize pluralism in life between religious people. Second, the value of anti-radicalism in the second precept is in the form of the value of forming paradigms and social religious attitudes that prioritize the spirit of humanism. Third, the value of national commitment in the third precept is in the form of the value of forming paradigms and social attitudes of religion that uphold nationalism. Fourth, the accommodating value of local wisdom in the fourth and fifth precepts is in the form of the value of forming paradigms and social attitudes of diversity that prioritize the principle of deliberation and make the value of social justice in responding to various local wisdom. The theoretical implications of the findings of this study show that Pancasila contains universal values in the formation of a moderate social religious character in Indonesia. The limitation of this study is that it has not studied the role of the Indonesian government in disseminating the value of religious moderation contained in Pancasila in various lines of social life

    Opportunities for Women as Guardians of Marriage in Indonesia: an Overview in the Sociology of Islamic Law

    Whether we realize it or not, gender inequality is one of the social problems that we can easily find in people's lives. The problem of gender bias can occur in various aspects of life, including the aspect of legal rights, such as the right as guardian of marriage in Indonesia. This study aims to find a discourse analysis of the opportunities for women as marriage guardians in Indonesia. This study employs empirical normative legal method. The primary data sources are the Compilation of Islamic Law (KHI) and social observation. The secondary data sources used were various other relevant studies. Meanwhile, the theory used as a tool of analysis is the sociological theory of Islamic law from Ibn Qayyim al-Jauzi regarding changes in Islamic law. This study concludes that based on the pattern of equality of gender relations in Indonesian society, granting the right of authority as guardian of marriage to female relatives is a form of istihsan bi al-'urf, the change of law from general law (kulii) to special or casuistic law (juz'i) based on existing culture or custom. This is parallel with Ibn Qayyim's theory of change in Islamic law which makes conditions (ahwal) and culture ('adat) part of the factors of changing Islamic law

    This study aims to find the correlation of motivation, behavior and spiritual peak experience in the view of Islamic psychology. This type of research, namely qualitative research in the form of literature study. The primary data source of this research, namely the theory of hierarchy of human basic needs from Abraham Maslow. Meanwhile, secondary research data sources, namely various other relevant western motivational theories. The theory is used as a knife of analysis, namely the theory of motivation of the human soul from al-Ghazali which includes dimensions of heart, reason and lust. This study concludes that in the perspective of Islamic psychology there is a strong relationship between motivation and the behavior of every human being in the process of achieving spiritual peak experiences. The relationship of motivation and human behavior in the perspective of Islamic psychology that is more likely to emphasize religious motives (spiritual), both in psychological and physiological conditions of humans. motivation and behavior in Islam are very closely related to various stages in the process towards the ultimate spiritual human experience

    The phenomenon of liberalism on Islamic marriage law in Indonesia often creates social problems. Therefore, it is important to understand understanding and wise attitudes towards the phenomenon within the framework of the scientific paradigm. This research aims to understand various forms of liberalism on Islamic marriage law in Indonesia in the perspective of the philosophy of Science. This research is a qualitative research in the form of literature review. The type of legal research in this study is philosophical normative legal research. The research data used is various research on liberalism on the law of Islamic marriage in the Compilation of Islamic Law (KHI). Meanwhile, the theory used as a knife of analysis is the theory of the scientific revolution of Thomas Samuel Kuhn. This study concludes that liberalism on Islamic marriage law in Indonesia is a form of paradigm shift over the construction of legal thinking in various KHI articles that are considered to have experienced anomalies, which are not relevant to social development and do not answer the challenges of modernity, such as issues of gender equality, democracy, human rights Humans, and pluralism. Such conditions have encouraged contemporary Islamic law reviewers in Indonesia to voice a paradigm shift and even a scientific revolution by giving birth to the construction of new Islamic marriage law

    The Values of Social Education in the Qur’an and its Relevance to The Social Character Building For Children

    This study aims to find the values ​​of social educational contained in the Qur'an. This research is a qualitative research in the form of library research. The focus of the verse is the object and source of primary data of this study, namely various commentaries that explain Surah at-Taubah verses 71-72. While secondary data sources of research is various literatut that are relevant to the subject matter of discussion. To answer the discussion of the research, the writer uses the method of interpretation maudhu'i (thematic). This study concludes that the values ​​of humanistic social education contained in the letter at-Taubah verses 71-72 include attitudes of helping to help, an invitation to the good and preventing munkar, social solidarity, brotherhood. These values ​​can be a spirit of  social education in forming empathy, mutual care, protection, tolerance and high social solidarity. The four values ​​of social education can be actualized in the context of the planting of social education in children through various things, among others, the cultivation of a noble mentality in children can be realized in the planting of brotherly values ​​and help children. Furthermore, the cultivation of a spirit of attention to the rights of others and a commitment to social ethics can be realized through the inculcation of the value of social solidarity. Then, inculcation of critical and social supervision can be realized by instilling the value of amar makruf nahi munkar
