A REGULAÇÃO PELA ÉTICA E A PROPOSTA DE MARCO LEGAL PARA A INTELIGÊNCIA ARTIFICIAL NO BRASIL

Abstract

This paper aims to address a pair of questions: (i) is ethics, on and by itself, sufficient to regulate artificial intelligence - AI or should it be addressed by a formal legal framework?; and (ii) what are the ideal features for this legal framework and how the legislative AI proposal, as approved in the Brazilian House of Representatives, reflect these features? Drawing from the so called Technical Constitution, the article examines the main traits of ethics in regulating AI, its merits and setbacks, verifying its shortcomings as a tool for AI systems development and applications. Furthermore, after identifying the essential regulatory elements for an effective AI governance, we concluded that the Brazilian Parliament proposal for AI enjoys a robust level of adequacy to these essential regulatory elements. For this goal, the methodology we used included bibliographic review and state of the art literature related to artificial intelligence and data protection. Keywords: artificial intelligence; ethics; regulation.Este artigo tem o objetivo de responder a duas perguntas: (i) a ética, por si só, é suficiente para regulação da inteligência artificial - IA ou deve ser complementada por um marco legal?; e (ii) quais as características ideais desse marco legal e de que modo a proposta de regulação da IA no Parlamento Brasileiro¸ consolidada no texto do Projeto de Lei nº 21/2020, aprovado pela Câmara dos Deputados, atende a essas características? Com origem na Constituição da Técnica, o trabalho aprofunda o exame das características da regulação pela ética no campo de IA, seus méritos e contratempos, observando a sua insuficiência como instrumento único de governança para o desenvolvimento e aplicação de sistemas de IA. Em seguida, a partir da identificação de elementos regulatórios essenciais para uma governança de IA efetiva, verificamos o grau de adequação da proposta legislativa de IA, concluindo pela robusta aderência da proposta a esses elementos regulatórios essenciais. Para esse objetivo, foram utilizamos metodologias de revisão bibliográfica e o estado da arte de temáticas relacionadas à inteligência artificial e proteção de dados pessoais.
