MULHER NEGRA E O ACESSO À JUSTIÇA: UMA ANÁLISE DAS LEIS EFICAZES EM GARANTIR SEUS DIREITOS

Abstract

First, the advancement of access to justice for the Brazilian population will be addressed, especially for black women, who are at an intersection of marginalized groups and suffer from both machismo and the structural racism of society. The guarantee of access to justice, although formally provided for since the 1946 Constitution, sometimes does not reach the whole of society, either due to socioeconomic inequality or lack of legislative initiatives to resolve such inequalities. In this article, we studied the legislative advances approved since the Federal Constitution of 88, namely: Consumer Protection Code, the Special Courts Law, the Civil Procedure Code of 2015 and the Maria da Penha Law (Law nº 11.340 /2006); and how these laws changed women\u27s lives. The interviews with black and white women, the latter as a control, sought to extract from the concrete experience how the black female population accesses their rights.Primeiramente, será abordado o avanço do acesso à justiça da população brasileira, em especial da mulher negra a qual se encontra em uma interseção de grupos marginalizados e sofre tanto com o machismo quanto o racismo estrutural da sociedade. A garantia do acesso à justiça, ainda que prevista formalmente desde a Constituição de 1946, por vezes não alcança toda a sociedade, seja pela desigualdade socioeconômica ou por falta de iniciativas legislativas para dirimir tais desigualdades. No presente artigo, estudou-se dos avanços legislativos aprovados desde a Constituição Federal de 88, a saber: Código de Defesa do Consumidor, a Lei dos Juizados Especiais, o Código de Processo Civil de 2015 e a Lei Maria da Penha (Lei nº 11.340/2006); e como essas leis mudaram a vida das mulheres.
