Penegakan Hukum Atas Kewajiban Menyalakan Lampu Pada Siang Hari Bagi Pengemudi Sepeda Motor Di Surabaya

Abstract

  Pasal 107 ayat (2) Undang-undang Nomor 22 Tahun 2009 tentang Lalu Lintas dan Angkutan Jalan (selanjutnya disebut UULLAJ) mengatur tentang menyalakan lampu utama bagi pengemudi sepeda motor pada siang hari. Ketentuan ini diharapkan dapat mengatasi permasalahan pelanggaran dan tingkat kecelakaan yang sering terjadi khususnya yang sering menimpa sepeda motor. Tujuan Penelitian ini adalah untuk mengetahui penegakan hukum atas kewajiban untuk menyalakan lampu utama bagi pengemudi sepeda motor pada siang hari di Kota Surabaya, untuk mengetahui kendala yang dihadapi oleh pihak Kepolisian serta upayanya dalam menerapkan Pasal 107 Ayat 2 UULLAJ. Penelitian ini merupakan penelitian yang berjenis yuridis sosiologis. Lokasi penelitian ini dilakukan di Polrestabes Surabaya. Informan dalam penelitian ini yaitu Kasatlantas Polrestabes Surabaya dan pengemudi sepeda motor. Kesimpulan dari pembahasan ini adalah penegakan hukum yang dilakukan pihak kepolisian resort kota besar Surabaya yaitu berupa teguran baik itu tertulis maupun tidak tertulis. Kendala yang dihadapi pihak kepolisian ,yakni kurangnya pengetahuan dan kesadaran dari masyarakat untuk mematuhi ketentuan pada Pasal 107 ayat (2), serta kurangnya personel dari pihak kepolisian yang bertugas di pos penjagaan. Upaya yang dilakukan pihak Kepolisian yaitu memberikan sosialisasi dan penyuluhan kepada masyarakat dan menambah anggota personel polisi satlantas yang berjaga di jalan raya. Kata Kunci: Lampu Utama, Siang Hari, Sepeda Motor, Tilang, Pengetahuan dan Kesadaran.   Abstract Article 107 paragraph (2) of Act No. 22 of 2009 about traffic and Road Transport (hereinafter UULLAJ) set about turning on the lights for the driver of the motorcycle during the day. This provision is expected to address the violation and the degree of an accident often happens particularly often override the motorcycles.The purpose of this research is to find out law enforcement over the obligation to turn on the lights for the driver of the motorcycle during the day in the city of Surabaya, to know the obstacles faced by the police as well as its efforts in applying Article 107 paragraph 2 UULLAJ. This research is a juridical sociological research. The location of this research was conducted in Surabaya Polrestabes. Informants in this study i.e. Kasatlantas Polrestabes Surabaya and the driver of the motorcycle. The conclusion of the discussion of this is law enforcement conducted police resort big city Surabaya, namely in the form of strikes are either written or unwritten. Constraints faced by the police, namely the lack of knowledge and awareness of the public to comply with the provisions in section 107 subsection (2), as well as the lack of personnel from the police who are on duty at checkpoints. The efforts made the police providing socialization and outreach to the community and increase the police personnel Member satlantas who kept vigil on the highway.
