Sulla circolarità "antropologia filosofica" - "filosofia del diritto": prolegomeni per un'antropologia filosofico-giuridica

Abstract

The essay focuses on the anthropological dimension of law and, hence, of philosophy and theory of law as a whole. By defining the limits of the anthropological perspective, also in the light but beyond the Italian philosophies of “existence” developed within the last century (i.e. Piovani, Cotta), main goals and some methodological-theoretical profiles of this proposal are put in question. Starting from these premises, and also with the paradigmatic reference to some problematic aspects of the western communitarian tradition (especially the Greek experience based on koinonia and the proto-Christian period grounded in the primitive communities), it is possible to trace at least the conceptual lines of the complex relation between law and anthropology: in other words, a philosophical-legal anthropology
