Mediation in Healthcare

Abstract

Diplomsko delo je osredotočeno na mediacijo v zdravstvu kot alternativo, s katero bi lahko reševali konflikte, ki nastanejo v zdravstvu na več ravneh. Poleg temeljnih značilnosti mediacije v zdravstvu, mediacijskih načel in prednosti in slabosti mediacije v zdravstvu, sta posebej izpostavljena dva temeljna odnosa, to je odnos med zdravstvenim osebjem in pacienti ter znotraj delovnega tima. Konflikti najbolj pogosto nastajajo zaradi različnih dejavnikov, ki pa niso zgolj povezani s tema dvema razmerjema, ampak je potrebno gledati širše – globalno. Predstavljena je sprejeta slovenska zakonodaja na tem področju in vloga mediacije v zdravstvu. Opisani so primeri dobrih praks iz Slovenije in tujine, po kateri se lahko v prihodnje jemlje zgled, prav tako je podan Osnutek modela upravljanja s spori in Predlog ureditve mediacijskih pisarn v zdravstvu v Sloveniji.This thesis focuses on mediation in health care as an alternative, which could resolve the conflicts that arise in the health sector at various levels. In addition to the basic features of mediation in the health sector, the principles of mediation and the advantages and disadvantages of mediation in health care, two fundamental relationships are researched, the first being the relationship between medical staff and patients and the second the relationship within the working team. Conflicts most often occur due to various factors, which are not only connected with these two relationships, but it is necessary to also look wider - global. Presented is the Slovenian legislation in this area and the role of mediation in the health sector. Described are several cases of good practice from Slovenia and abroad, which are good examples for the dispute resolutions in the future, as well as a Draft model of dispute governance and Mediation proposal for a regulation of the offices of health care in Slovenia
