COMPARISMENT BETWEEN SLOVENIAN AND ENGLISH- MEDIATION PROCESS

Abstract

Mediacija, kot alternativno reševanje sporov je v Sloveniji dokaj nov institut, medtem, ko je v anglosaškem pravnem sistemu že uveljavljen in dodobra izpeljan način reševanja sporov med strankama. Ker se je sodobna mediacija razvila v angleškem in ameriškem pravnem sistemu, avtorica v svojem delu razpravlja in primerja ureditev mediacije v angleškem in slovenskem prostoru. Avtorica skuša oceniti vpliv mediacije na samo racionalizacijo in pospešitev sodnih postopkov. V prvem delu avtorica opisuje ureditvev mediacije tako v angleškem kot v slovenskem pravnem redu in hrati nakratko opiše komediacijo. Glavno vodilo pri pisanju diplomske naloge je analiziranje in ugotavljanje uspešnosti procesa mediacije v obeh državah ter razvoja mediacije skozi različna časovna obdobja. V drugem delu diplomske naloge avtorica opiše sodno prakso in zakonsko ureditev obeh dražav, ter povdarja pozitivne lastnosti mediacije in vpliv le te na sodne zaostanke. Pri razvoju alternativnega reševanja sporov so prav tako pomembna evropska stališča o alternativnem reševanju sporov, predvsem o mediaciji. Z namenom upeljave mediacije v pravni sistem vsake države članice, je Evropska skupnost izdala Kodeks vedenja in ravnanja za mediatorje in predlagala direktivo o mediaciji. Avtorica osrednjo temo sistematično in analitično opredeljuje skozi celotno diplomsko nalogo in zaključi svoje delo z primerjavo glavnih karakteristik ureditve mediacije v obeh državah, ter predstavi svoje videnje izboljšanja procesa mediacije v Sloveniji.Mediation, as an alternative dispute resolution, is in Slovenia a relatively new institution, while in Anglo-Saxon legal system is already firmly established and implemented institut for resolution of disputes between the parties. Author discusses and compares the organization of mediation in English and Slovenian territory, manly because modern mediation was developed in English and American legal system. The author tries to evaluate the impact of mediation on judical process and how mediatio accelerate judicial procedures. In the first part the author describes mediation in both, English and in Slovenian law and also briefly describes co-mediation. The main guide in writing author’s written work is the analys and comparisment of mediation in both countries and moreover development of mediation through different time periods. In the second part of the paper the author describes the case law and the regulation of both Countrys and emphasizes the positive features of mediation and its impact on court delays. European Community has the mayor role in development of alternative despute resolution, manly and primarly in mediation. In order of introduction of mediation in the legal system of each Member States, the European Community issued a code of behavior and conduct for mediators and proposed a directive on mediation. Author introduces her central theme systematically and analytically through entire essey and concludes its work by comparing the principal characteristics of mediation organization in both countries. Author also presents her vision for improving the mediation process in Slovenia
