The hidden matrix of modern law: a critic to the contemporary constitutionalism

Nesse artigo tento exibir a matriz oculta do Direito: o estado de exceção emque vivemos – e sua correspondente vida nua – discutindo as relações entre Direito e poder.Para provar isso, pretendo mostrar como a tradição liberal – matriz da recente teoriaconstitucional – oculta esse fenômeno, tornando-se incapaz de explicar como exatamenteaqueles que sentem mais profundamente a violência estatal – miseráveis, imigrantes,etc. – estão evidentemente fora do suposto contrato.In this paper I try to exhibit Law’s hidden matrix: the state of exception inwhich we live – and the correspondent bare life – discussing relations between Lawand power. To prove it, I aim to show how the liberal tradition – matrix of the recentconstitutional theory – hides this phenomenon, being incapable to explain how exactly those who feels more deeply the violence of State – poor people, immigrants, etc. – are evidently out of the supposed contract
