    Praktik Sewa Perlengkapan Pernikahan di Wedding Organizer "Mutiara Cinta" Surabaya Perspektif Ijarah

    Abstract: This research aims to answer problems regarding the practice of renting wedding equipment at Mutiara Cinta Wedding Organizer Benowo Krajan Surabaya, as well as Ijarah analysis of this practice. This research is classified as field research conducted in Benowo Krajan Village, Surabaya. Research data was collected using interview, observation and documentation techniques. The research results concluded that the rental practice carried out by Mutiara Cinta Wedding Organizer can be done online or offline by determining the type of wedding equipment you want to rent and accompanied by a rental price agreed upon by both parties. In practice, obstacles in the field must be addressed, such as incomplete rental objects, inappropriate or defective decorations size and shape, and delayed payment deadlines. Second, renting wedding equipment at Mutiara Cinta Wedding Organizer has fulfilled the pillars and requirements of the ijarah contract, so the rental practice carried out is legal and follows Islamic law. Even though there are several obstacles in the rental course, both parties have mutually agreed and are willing to change and postpone the payment of wages according to the agreement. Thus, renting wedding equipment at Mutiara Cinta Wedding Organizer Benowo Krajan Surabaya is by and in line with Islamic law. Keywords: Rental Practice, ijarah, Wedding Organizer Abstrak: Penelitian ini bertujuan untuk menjawab permasalahan mengenai praktik sewa-menyewa perlengkapan pernikahan di Mutiara Cinta Wedding Organizer Benowo Krajan Surabaya serta analisis Ijarah tentang praktik tersebut. Penelitian ini tergolong pada jenis penelitian lapangan yang dilakukan di Desa Benowo Krajan, Surabaya. Data penelitian dikumpulkan dengan menggunakan teknik wawancara, observasi dan dokumentasi. Hasil penelitian menyimpulkan bahwa pertama, praktik sewa-menyewa yang dilakukan Mutiara Cinta Wedding Organizer dapat dilakukan baik secara online atau offline dengan menentukan jenis perlengkapan pernikahan yang ingin disewa dan disertai dengan harga sewa yang disepakati kedua belah pihak. Dalam praktiknya, kendala dilapangan tidak dapat terlewatkan, seperti objek sewa yang kurang lengkap, ukuran dan wujud dekorasi yang tidak sesuai atau cacat dan batas waktu pembayaran yang ditunda-tunda. Kedua, praktik sewa-menyewa perlengkapan pernikahan di Mutiara Cinta Wedding Organizer telah memenuhi rukun dan syarat dari akad ijarah, sehingga praktik sewa-menyewa yang dilakukan sudah sah dan sesuai dengan hukum Islam. Meskipun terdapat beberapa kendala dalam praktik sewa yang dilakukan, namun kedua belah pihak telah sama-sama sepakat dan rela untuk mengganti dan menunda waktu pembayaran upah sesuai dengan   kesepakatan.  Sehingga, praktik sewa-menyewa perlengkapan pernikahan di Mutiara Cinta Wedding Organizer Benowo Krajan Surabaya sesuai dan sejalan dengan hukum Islam.     For the Sake of Protecting Physcal Needs: Maqasid Sharia Perspective Toward Judges Consideration on Child Custody

    In Islamic law, for a child who has not been mumayyiz, their custody falls in the hands of the mother. If the child has been mumayyiz, then the child is given the right to choose and determine who has the right to care for him. However, the judge of Panyabungan Religious Court decides the custody of a child who has not been mumayyiz to the father. This study aims to analyze the judge’s considerations in determining the custody of a child who has not been mumayyiz to the father. Using a normative and philosophical approach by using Maqasid Sharia theory, this study employs a qualitative methodology to examine the judge’s consideration. As for the results of this study, firstly, in consideration of the judge stipulating the custody of the child who has not been mumayyiz to the father is to maintain the child’s physical growth. Second, the author believes that a judge who determines to whom child custody is granted should prioritize the existence of religion over the existence of the soul. It means that child custody is given priority to one of the parents with better religion, behavior, and association than prioritizing the child's physical needs

    This research is motivated by the author's anxiety about phenomena that occur in society, namely related to fulfilling the obligation to provide an 'iddah post-divorce carried out outside the Religious Courts, primarily through the Tuan Guru's decision in Labuapi District. This research aims to analyze the distribution of 'iddah maintenance outside the court in the Labuapi District. It also tries to analyze the factors that influence the level of legal awareness of giving 'iddah maintenance to the community. Furthermore, this article tries to analyze the form and role of Tuan Guru in socializing the fulfilment of 'iddah maintenance obligations. The authors' results indicate that the distribution of 'iddah income in Labuapi District needs to be carried out correctly. This is based on the lack of public knowledge, prevailing traditions, and conflict between husband and wife, which is the cause of divorce. In addition, in this study, the authors found two active roles of Tuan Guru in the community: to provide understanding to the community and as a mediator and family law consultant

    Tinjauan Undang-Undang Nomor 1 Tahun 1974 dan KHI Terhadap Praktik Peminangan Adat Minangkabau

    This paper aims to find out how Law No. 1 of 1974 and KHI view the Minangkabau Traditional Engagement Practice.  This is based on the behavior and opinions of some people who are pro and contra to this engagement practice. The author finds that these two attitudes seem to contradict each other and are sometimes in line with the applicable law. Where the pro opinion tends to the order of community life based on applicable customary law, while the contra opinion tends to the UUP and KHI whose regulations are sometimes not in line with Minangkabau customary rules. This research is expected to provide an understanding of the legal dualism of Minangkabau customary engagement practices. This research uses a literature study with the object of research is the application of Minangkabau customary marriage practices. From this research it can be concluded that, the Minangkabau customary engagement practice uses a matrilineal system whose customary rules are not in line with KHI. However, this does not cause a decline in its existence, there are still many young people who still uphold their original culture and are not eroded by the times

    Equity Crowdfunding: Financing Instruments MSMEs Compilation of Perspective Sharia Economic Law

    This study aims to analyze financing instruments for micro, small and medium enterprises (MSMEs) through equity crowdfunding and examine equity crowdfunding in the perspective of compilation of Sharia economic law (KHES). This type of research is descriptive qualitative research, namely research that seeks to describe and explain the data obtained with secondary data. This study uses a literature research approach, where the data sources are obtained from literature studies and various kinds of literature that are worthy of discussion, including the study of OJK Regulation No. 37/POJK.04/2018 and DSN MUI Fatwa No. 117 /DSN-MUI/II/2018. The results of this study indicate that the financing instrument carried out contains business actors, investors and fund distribution institutions. While the review of Islamic economic law regarding equity crowdfunding leads to 2 types of contracts, namely mudharabah and musyarakah contracts that can be used as references.

    This article discusses the criminal aspects in the procession of traditional ceremonies (merariq) of the Central Lombok community (Case Study in Gerantung Village, Central Praya, Central Lombok, NTB). The main challenge of this research is to identify the criminal elements in the procession of merariq customs of the Central Lombok community. For this reason, using an empirical study approach, this researcher collected data through interviews with traditional leaders, community leaders, and authorities. This study concludes that the custom of merariq for the people of Gerantung Village does not conflict with existing customs, even in practice the community will commit criminal acts if they violate customs and state regulations, one of which is Articles 330 and 332 of the merariq custom which have rules that are in line with the practice and enforcement of law in the Merariq tradition

    Uang sebagai alat tukar didalam kegiatan ekonomi telah mengalami banyak perubahan. Keberadaan uang yang semula terbuat dari hal-hal sederhana telah sampai kepada saat ini dimana uang hanya berupa kode digital didalam dunia virtual. Bitcoin sebagai cryptocurrency merupakan jenis uang revolusioner yang mempunyai nilai tukar yang tinggi. Keberadaan cryptocurrency sampai saat ini masih diperdebatkan penggunaannya di dunia baik dari segi kebijakan ekonomi keuangan ataupun segi syariat Islam. Metode penelitian yang digunakan dalam penelitian ini adalah metode studi kepustakaan (Library Research), dengan menggunakan pendekatan hukum normatif dengan mengkaji dokumen-dokumen yang ada dengan cara deskriptif kualitatif. Data dikelola menggunakan teknik pengumpulan data bahan sekunder dan bahan tersier. Hasil dari penelitian ini menjelaskan bahwa cryptocurrency adalah mata uang digital yang terlepas dari otoritas pemerintah pusat. Fungsi cryptocurrency dapat berjalan dengan ditopang oleh sistem ledger Blockchain yang berbasis peer to peer oleh para miners yang mampu menyelesaikan masalah besar dalam keuangan digital yaitu double spending problem dan byzantine general problem. cryptocurrency yang memiliki proteksi serta privasi yang tinggi, mengakibatkannya banyak disalahgunakan untuk kegiatan ilegal. Indonesia demi menjaga kedaulatan Pancasila melarang penggunaan cryptocurrency sebagai alat tukar, tetapi mengakuinya sebagai aset kripto yang dapat diperjualbelikan sebagai komoditi. Penelitian ini bertujuan untuk menjelaskan hukum transaksi pembayaran cryptocurrency dalam prespektif Majelis Ulama Indonesia dan Nahdlatul Ulama, menjelaskan Dasar Hukum Transaksi Pembayaran Melalui Cryptocurrency, cara transaksi pembayaran melalui cryptocurrency, cryptocurrency dalam perspektif hukum islam, menjelaskan jual beli mata uang kriptografi sebagai komoditi aset digital dan perbedaannya dengan jual beli komoditi syariah di Indonesia, menjelaskan pandangan fiqh mengenai jual beli mata uang kriptografi sebagai komoditi aset digital. Penelitian ini dilakukan dengan kerangka berpikir bahwa sebagai bentuk pengamalan teori seorang muslim, harus melaksanakan hukum Islam sebagai konsekuensi logis dari pengakuannya. Pemahaman yang jelas tentang kehalalan penggunaan cryptocurrency baik sebagai mata uang, maupun sebagai komoditi sangat dibutuhkan sebagai penunjuk arah bagi seorang muslim. Aset kripto ditemukan mempunyai karakteristik layaknya komoditi nyata pada umumnya sehingga boleh diperjualbelikan untuk investasi selama menjauhi kegiatan spekulatif  tidak mengandung gharar, dharar dan tidak bertentangan dengan Undang-Undang nomor 7 tahun 2011 dan Peraturan Bank Indonesia nomor 17 tahun 2015.  serta memenuhi kaidah-kaidah syara yang dalam hal ini ditentukan oleh Majelis Ulama Indonesia dan Nahdlatul Ulama.     Pandangan Tokoh Masyarakat dan Pedagang Wonocolo terhadap Penggunaan Uang Rusak atau Cacat pada Transaksi Jual Beli dalam Perspektif UU No. 7 Tahun 2011

    Abstract: Buying and selling transactions using damaged/defective money is a topic of concern in the Islamic view. Because of this, this research was made to discuss the use of damaged/defective money in buying and selling transactions from the point of view of community leaders and traders in Wonocolo District which will then be analyzed by Law Number 7 of 2011. This research was conducted through a qualitative approach using interviews and participatory observation as method of collecting data. The results of the study show that there are differences of opinion between community leaders and traders regarding the use of damaged/defective money in buying and selling transactions. Some community leaders and traders are of the opinion that the use of damaged/defective money in buying and selling transactions is not in accordance with the legal perspective stipulated in Law Number 7 of 2011. They are of the opinion that the money used in transactions must meet the criteria of validity, not be defective, and have stable exchange rate. They also stated that the use of damaged/defective money could violate the principles of fairness and reduce trust in buying and selling transactions. However, different views also emerge, especially among traders. Keywords: Buy and Sell; Broken Money; Disabled Money; Wonocolo District. Abstrak: Transaksi jual beli menggunakan uang rusak/cacat adalah suatu topik yang menjadi perhatian dalam pandangan Islam. Karena itu penelitian ini dibuat guna membahas penggunaan uang rusak/cacat dalam transaksi jual beli dari sudut pandang tokoh masyarakat dan pedagang di Kecamatan Wonocolo yang kemudian akan dianalisis dengan UU Nomor 7 Tahun 2011. Penelitian ini dilakukan melalui pendekatan kualitatif dengan menggunakan wawancara dan observasi partisipatif sebagai metode pengumpulan data. Hasil penelitian menunjukkan adanya perbedaan pandangan diantara tokoh masyarakat dan pedagang terkait dengan penggunaan uang rusak/cacat dalam transaksi jual beli. Beberapa tokoh masyarakat dan pedagang berpendapat bahwa penggunaan uang rusak/cacat dalam transaksi jual beli tidak sesuai dengan perspektif hukum yang diatur dalam Undang-Undang Nomor 7 Tahun 2011. Mereka berpendapat bahwa uang yang digunakan dalam transaksi harus memenuhi kriteria keabsahan, tidak cacat, dan memiliki nilai tukar yang stabil. Mereka juga menyatakan bahwa penggunaan uang rusak/cacat dapat melanggar prinsip keadilan dan mengurangi kepercayaan dalam transaksi jual beli.     Between Work and Family: Multiple Role Strategies of Career Women in Sultan Agung Islamic University

    Career women have their own challenges to manage interests between work and family. However, not all career women are able to answer the demands to execute these two interests optimally. This paper aims to see what is behind the dual role of career women at Sultan Agung Islamic University and how they negotiate these two interests. This study is an empirical study using a gender approach. This paper finds that the dominant factors that place them in a dual role are economics and self-existence. Therefore, the negotiation process by establishing communication and cooperation in the household is the main thing. This strategy has an important impact on how the power of mutual trust and an attitude of responsibility is built in husband and wife relationships. In this position, the dual role chosen by career women does not further corner her position as a woman, but instead strengthens her position as the key holder of harmonious and stable relationships in the household

    Abstract: Violence against women in Indonesia has been recognized as a serious problem. Violence against women can be found everywhere such as in family, workplace, community and state, in the form of physic, psychology, sexual and economy. Perpetrators of violence against women can occur in various ways, ranging from individual, groups in society, and in a state institution with the main target toward women; children, adults, and including women with disabilities. It can be due to lack of knowledge and understanding of women to Undang-Undang No. 23 tahun 2004. Consequently, those who become the victim of violence are still trying to survive because of their fear to husband’s retaliation, the lack of shelter, their fear to the people’s negative assumption, their low self-confidence, and the reason of the children’s interest. In these difficult conditions, most wives still love their husband and defend their marriage. The awareness enhancement of law for women which is continually made might reduce the violence against women as mandated by Undang-Undang No. 23 tahun 2004.Abstrak: Kekerasan terhadap perempuan di Indonesia telah diakui sebagai permasalahan yang serius. Kekerasan terhadap perempuan ini dapat ditemukan di mana-mana, baik di lingkungan keluarga, tempat kerja, masyarakat dan negara, dalam bentuk kekerasan fisik, psikis, seksual dan ekonomi. Pelaku  kekerasan terhadap perempuan dapat terjadi secara beragam, mulai dari perorangan, kelompok-kelompok yang ada di masyarakat, maupun institusi-institusi negara dengan sasaran perempuan, baik anak, dewasa maupun usia lanjut, termasuk kaum perempuan penyandang cacat. Hal ini dapat disebabkan karena rendahnya pengetahuan dan pemahaman perempuan terhadap UU No. 23 tahun 2004, sehingga mengakibatkan perempuan menjadi korban kekerasan tetap berusaha mencoba bertahan. Hal ini karena adanya rasa takut pembalasan suami, tidak adanya tempat berlindung, takut dicerca masyarakat, rasa percaya diri yang rendah, alasan kepentingan anak, dan sebagian isteri tetap mencintai suami mereka serta mempertahankan perkawinan. Peningkatan kesadaran hukum bagi perempuan yang terus menerus dilakukan diharapkan angka kekerasan terhadap perempuan dapat ditekan sesuai dengan amanah Undang-Undang No. 23 tahun 2004
