    Legal form and the end of law : Pashukanis' legacy

    Following the 100th anniversary of Pashukanis’ 'General Theory of Law and Marxism' (1924), this volume aims to breathe new life into the main category of Pashukanian legacy, the concept of legal form. This book offers new, deeper and more general, ways in which the concept of legal form can be used to push forward Marxist – post-Marxist or hauntingly Marxist – legal theory. Accordingly, this book does not pledge allegiance to reconstructing and reconsidering the official interpretative legacy of the legal form. Instead, it mobilises the revolutionary conceptual potentialities that this term contains. When investigated thoroughly, and in many dimensions, the legal form becomes a privileged vantage point not only into the greatest law-related riddles of Marxism (such as the relation between economy and the state or withering away of statal apparatuses), but the whole of modernity as the epoch determined by – if not overlapping with – capitalism. This book aims to think with the legal form rather than explain this concept. In so doing, it offers a panoply of theoretical perspectives that address legal subjectivity, abstraction, autonomy of the law and, last but not least, withering away of the law. This contemporary interrogation of the relevance of the concept of legal form will be of considerable interest to scholars and students of legal and political theory

    Wind energy in Poland : a successful restart or another false start?

    In recent months, the energy sectors of many European countries, including Poland, have clearly been destabilised by, e.g., the aftermath of COVID-19 and the ongoing war in Ukraine. It should be emphasised that for many years intensive work has been underway towards decarbonisation as Poland currently obtains its energy mainly from coal-fired power plants. Certainly, the development of the wind energy sector, which already provides almost 10 per cent of Poland’s electricity needs, is a great opportunity for the transition of the Polish energy sector. Unfortunately, stagnation caused mainly by unfavourable legal solutions (the 10H rule) has been noticeable in the last few years. As a result, the development of onshore wind energy was halted, which slowed down the energy transition. In July 2022, the Polish government decided to relax the law on onshore wind energy, but this raises several doubts: Will the change in legal regulations actually stimulate dynamic investment in onshore wind farms, or will the changes only be superficial, thus removing the possibility of another wind boom? The chapter analyses the wind energy sector in Poland from the point of view of the latest legal changes

    Conspiracist tropes in Rodrigo Duterte's populistic rhetoric

    The chapter examines links between populism and conspiracy theories in the rhetoric of Rodrigo Duterte, the former president of the Philippines. In the first part, populist traditions and tendencies in the Philippines are outlined and the sources of their popularity are examined. Subsequently, Dutertismo, or Duterte’s rhetoric, is discussed as “hybrid populism,” which blends various anti-elitist ideas and cannot be classified as simply right- or left-wing populism. Further, the chapter explores conspiracist tropes in Rodrigo Duterte’s populist rhetoric. The analysis allows us to identify elements of globally well-known conspiracist motives that are modified to fit a specific Philippine context. In conclusion, three main functions of Duterte’s conspiracist populist rhetoric are identified: mobilization, securitization, and dismantling of criticism

    Management, conflict resolution and strategy : coping with stress at work

    Managers are key people in building the success of any organization. Business results depend on their efficiency in the implementation of the power entrusted to them. This efficiency, on the other hand, largely depends on psychosocial competences and personality predispositions. One of the main factors affecting destructively on managers is stress, destroying the level of their motivation to work, the level of commitment and ultimately resulting in premature professional burnout and a significant reduction in the level of efficiency. Ultimately, instead of efficient and motivated specialists, companies are struggling with employees suffering from depression. Exploration of the issue of identifying the sources of stress draws attention to conflict as one of the main research categories that are closely related to the category of stress. It is worth emphasizing that this relationship is two-way: conflict determines the level of stress, stress may determine the scale of conflict situations. This recommended monograph provides the latest knowledge on what contemporary managers use conflict resolution styles and what strategies they choose to deal with in stressful situations. A particular advantage of the study is the presentation of the links between both research categories, which are so paramount nowadays
