The Hell-or-High-Water Clause in Aircraft Leasing Contract: UNIDROIT Principles and the Indonesian Civil Code
This research analyses the hell-or-high-water clause in aircraft leasing contracts in the context of the principle of freedom of contract. Focusing on the review of the principle of freedom of contract based on UNIDROIT Principles of International Commercial Contract (UPICC) 2016 and Indonesian Civil Code, this research uses normative juridical method with analytical descriptive approach. The findings show that the hell-or-high-water clause has a high binding force, providing legal certainty, especially for the lessor. However, its application must be in line with the principle of freedom of contract regulated in UPICC 2016 and the Civil Code. The application of this clause is suggested to consider three limitations stipulated by the UPICC 2016: first, the principle of freedom of contract that allows businesses to choose partners and transaction terms; second, the exclusion of certain sectors in the public interest by the state; and third, mandatory rules that limit the content of the contract. Therefore, the hell-or-high-water clause should be applied with due regard to the implementation of the principle of freedom of contract as well as national law or the existence of compelling national regulations.This research analyses the hell-or-high-water clause in aircraft leasing contracts in the context of the principle of freedom of contract. Pendampingan Pemilihan Studi Lanjut Melalui Analisis Bakat dan Minat Siswa SMKN 8 Merangin
Choosing further studies is an important step in the educational journey of SMKN 8 Merangin students to achieve success in the future. However, many students face difficulties in understanding their talents and interests as well as limited access to information about appropriate further study options. Therefore, this training aims to increase students' understanding of their talents and interests and provide adequate information about further study options that suit their potential. The results of this training show that students increasingly have insight into their own potential. And the training participants have been recommended to continue their education according to their talents and interests.
Abstrak. Pemilihan studi lanjut merupakan langkah penting dalam perjalanan pendidikan siswa SMKN 8 Merangin untuk mencapai kesuksesan di masa depan. Namun, banyak siswa menghadapi kesulitan dalam memahami bakat dan minat mereka serta keterbatasan akses terhadap informasi tentang pilihan studi lanjut yang sesuai. Oleh karena itu, pelatihan ini bertujuan untuk meningkatkan pemahaman siswa tentang bakat dan minat diri mereka serta menyediakan informasi yang memadai tentang pilihan studi lanjut yang sesuai dengan potensi mereka. Hasil pelatihan ini menunjukkan bahwa para siswa semakin memiliki wawasan mengenai potensi yang ada pada diri mereka. Dan para peserta pelatihan telah direkomendasikan melanjutkan pendidikan sesuai dengan bakat dan minat mereka
THE BENEFITS OF COGNITIVE BEHAVIOR THERAPY COUNSELING TO INCREASE STUDENT RESILIENCE IN THE ERA OF SOCIETY 5.0
This article aims to provide in-depth information about the usefulness of cognitive behavior therapy counseling to increase student resilience. In providing services to students in the era of society 5.0, guidance and counseling teachers/counselors need to pay attention to the use and procedures for implementing services using certain approaches that have proven to be effective in overcoming KES-T so that they are able to develop students' KES. The usefulness of cognitive behavior therapy counseling in increasing student resilience will be discussed in this article. This research method is a literature review where data is obtained from various reference sources such as articles, source books and other supporting documents. The research results show that cognitive behavior therapy counseling can increase student resilience and bring many benefits in developing students' KES
DEVELOPMENT AND IMPLEMENTATION OF A FIVE-TIER DIAGNOSTIC TEST TO IDENTIFY STUDENT MISCONCEPTIONS ON FRACTIONS: A SIGNIFICANT STEP TOWARDS IMPROVING MATHEMATICS EDUCATION
Misconceptions in fractions, a significant challenge in mathematics education, occur when students' conceptions do not align with scientific conceptions, yet they firmly believe in the correctness of their conceptions. These deeply rooted misconceptions are difficult to eliminate and not easily identified with conventional instruments. Therefore, this study aims to develop a valid and reliable five-tier diagnostic test instrument to identify students' misconceptions about fractions effectively. The design of this development research involves qualitative and quantitative methods using the 4D model (define, design, develop, disseminate). Sixty-eight seventh-grade students were involved in quantitative instrument quality testing; data were analyzed using SPSS. The final result of the development of this instrument was 12 questions declared valid and reliable. Furthermore, the instrument was applied to 30 seventh-grade students in different schools to identify their misconceptions about fractions. Based on the analysis of the combination of students' answers, it was obtained that 36.4% of students understood the concept, 8.9% were in the false positive category, 7.2% were false negative, 9.7% lacked knowledge, and 37.8% had misconceptions. It was found that the most dominant description of misconceptions (33%), namely, students assume that the smaller the denominator of a fraction, the smaller the value of the fraction. Then, it was also found that students' thinking, in general, causes misconceptions to occur. The practical implication of the results of this study is that teachers can use the instrument and identify misconceptions to develop more effective teaching methods, thereby improving mathematics education by helping students avoid and anticipate misconceptions
MEASUREMENT OF READING SKILLS AND INTERPERSONAL RELATIONS OF HIGH SCHOOL STUDENTS
Keterampilan membaca dan hubungan interpersonal memainkan peranan yang cukup penting dalam proses pembelajaran di semua mata pelajaran, serta pengembangan sosial dan emosional siswa. Isi dari artikel mencakup proses pengukuran, perolehan, dan penyajian informasi yang penting mengenai keterampilan membaca siswa dan korelasi dengan kualitas hubungan interpersonal mereka. Metode yang dipakai mengarah pada jenis penelitian dekriptif-kuantitatif menggunakan pengisian instrumen melalui Google Form, dengan tujuan untuk mengukurketerampilan membaca dan hubungan interpersonal siswa di sekolah menengah atas. Penelitian ini diharapkan dapat menambah pemahaman bagi para pendidik dan pengambil keputusan yang tepat dalam merancang strategi pembelajaran yang lebih efektif dan mendukung perkembangan siswa secara keseluruhan
Pendampingan Pembuatan Perangkat Pembelajaran Berbasis Case Study Bagi Guru-Guru di Mandrasah Aliyah Al-Kausar Dendang
The ability to think critically is one of the competencies that is really needed in 21st century learning. In order for students to be trained to think critically, teachers as educators must be able to design learning tools that can improve their students' critical thinking skills. Based on facts in the field and interviews with several teachers, they have difficulty designing learning tools that can train students' critical thinking skills. Referring to this problem, teachers at Madrasah Aliyah Al-Kausar Dendang need training and assistance in making these learning tools. The service method is made in the form of workshops/training, and assistance in making case study-based learning tools. The results of training activities and assistance in making case study-based learning tools received a positive response from teachers. It is hoped that with this mentoring activity, teachers at Madrasah Aliyah Al-Kausar Dendang can develop learning tools well and be able to overcome the problems they have faced so far.
Abstrak. Kemampuan berpikir kritis merupakan salah satu kompetensi yang sangat dibutuhkan pada pembelajaran abad 21. Agar peserta didik terlatih untuk berpikir kritis maka guru sebagai pendidik harus mampu merancang perangkat pembelajaran yang dapat meningkatkan melatih kemampuan berpikir kritis peserta didiknya. Berdasarkan fakta di lapangan dan wawancara beberapa orang guru, mereka kesulitan dalam merancang perangkat pembelajaran yang dapat melatih kemampuan berpikir kritis peserta didik. Mengacu kepada permasalahan ini maka guru-guru di Madrasah Aliyah Al-Kausar Dendang butuh pelatihan dan pendampingan pembuatan perangkat pembelajaran tersebut. Metode pengabdian dibuat dalam bentuk workshop/pelatihan, dan pendampingan dalam pembuatan perangkat pembelajaran berbasis case study. Hasil kegiatan pelatihan dan pendampingan pembuatan perangkat pembelajaran berbasis case study mendapat respon positif bagi guru-guru. Diharapkan dengan adanya kegiatan pendampingan ini, guru-guru di Madrasah Aliyah Al-Kausar Dendang dapat mengembangkan perangkat pembelajaran dengan baik dan dapat mengatasi permasalahan yang dihadapi selama ini
IMPELEMENTASI PEMBELAJARAN BERBASIS MASALAH DALAM MENINGKATKAN KETERAMPILAN BERPIKIR KRITIS MAHASISWA PADA MATA KULIAH PSIKOLOGI ANAK BERKEBUTUHAN KHUSUS: IMPLEMENTATION PROBLEM BASED LEARNING IN ENHANCING THE ABILITY OF CRITICAL THINKING OF PSYCOLOGY STUDENT WITH SPECIAL NEEDS
Introduction Problem-based learning as an effort to improve students' critical thinking skills in the Psychology of Children with Special Needs course at the Jambi University Psychology Study Programme. The findings of focus group discussions (FGDs) with alumni who work in public and special schools, experience obstacles when dealing with children with special needs, especially in observing and analysing the behaviour of developmental and learning problems in children with special needs at school. Therefore, this study aims to determine whether the implementation of problem-based learning can improve students' critical thinking skills.
Method This research method uses class action with the Lewin model, the steps are: 1) Planning, 2) Action, 3) Observation, and 4) Reflection. The respondents of this study were active students of Psychology Jambi University in the Psychology of Children with Special Needs course in the academic year of the odd semester 2023/2024. The implementation lasted for one semester from August to November 2023.
Results Students of Psychology in Jambi University, who contract the Psychology of Children with Special Needs course in the 2023/2024 academic year can show active behaviour and be able to provide alternative solutions to developmental and learning problems in children with special needs based on scientific studies with problem-based learning.
Conclusion Problem-based learning in the psychology of children with special needs course is considered effective in improving the critical thinking skills of students of the Psychology Study Programme, Jambi University.

COMPETENCE OF VILLAGE APPARATUS: IS IT TRAINING MATERS?
The training that has been attended by village officials so far has not yielded optimal results. Meanwhile, training from various overseeing organizations is conducted annually. This study aims to investigate the role of motivation and perceived organizational support in mediating and moderating the impact of training on competence. The unit of analysis for this research is the village officials serving in all villages in Central Java Province, with a sample of 468 village officials determined using the Slovin method. Questionnaires were distributed based on the area random sampling method, and the data collected were analyzed using the SEM-PLS method with the WARP-PLS model. The results of the study show that both motivation and perceived organizational support mediate and moderate the impact of training on competence. Relevant organizations, including village governments, village empowerment services, and the Ministry of Villages, need to develop sustainable training policies and programs for village officials that are evaluated periodically
Faktor-Faktor yang Mempengaruhi Belum Optimalnya Pelaksanaan Restorative Justice di Polres Muaro Jambi
This study aims to evaluate the implementation of restorative justice in Polres Muaro Jambi, identify factors that influence its effectiveness, and provide recommendations for improvement. The research method used is a qualitative approach with a case study design. Data were collected through in-depth interviews with police officers, officers, and victims and perpetrators; participant observation in the field; and documentation from reports and case notes. Data analysis was conducted using thematic analysis techniques to identify key themes related to the successes, challenges, and recommendations for the implementation of restorative justice. The results of the study indicate that the implementation of restorative justice in Polres Muaro Jambi experienced several obstacles, such as lack of training, minimal resource support, and barriers to communication between related parties. Although there were some successes in resolving cases, these challenges reduced the effectiveness of the program. This study recommends increased training, adequate resource allocation, and improvements in communication mechanisms to improve the effectiveness of restorative justice implementation.

Penelitian ini bertujuan untuk mengevaluasi pelaksanaan restorative justice di Polres Muaro Jambi, mengidentifikasi faktor-faktor yang mempengaruhi efektivitasnya, dan memberikan rekomendasi untuk perbaikan. Metode penelitian yang digunakan adalah pendekatan kualitatif dengan desain studi kasus. Data dikumpulkan melalui wawancara mendalam dengan pejabat kepolisian, petugas, serta korban dan pelaku; observasi partisipatif di lapangan; dan dokumentasi dari laporan serta catatan kasus. Analisis data dilakukan menggunakan teknik analisis tematik untuk mengidentifikasi tema-tema utama terkait keberhasilan, tantangan, dan rekomendasi pelaksanaan restorative justice. Hasil penelitian menunjukkan bahwa implementasi restorative justice di Polres Muaro Jambi mengalami beberapa kendala, seperti kurangnya pelatihan, minimnya dukungan sumber daya, dan hambatan dalam komunikasi antara pihak-pihak terkait. Meskipun terdapat beberapa keberhasilan dalam penyelesaian kasus, tantangan-tantangan tersebut mengurangi efektivitas program. Penelitian ini merekomendasikan peningkatan pelatihan, alokasi sumber daya yang memadai, dan perbaikan dalam mekanisme komunikasi untuk meningkatkan efektivitas pelaksanaan restorative justice
Wakil Kepala Daerah Dalam Penyelenggaraan Pemerintahan Daerah
Kedudukan Wakil Kepala Daerah dalam penyelenggaraan Pemerintahan Daerah acap kali dipertanyakan karena dianggap sebagai badan yang membantu Kepala Daerah akan tetapi tidak memiliki kewengan dan keduudkan yang didasari dengan dasar hukum yang kuat, banyak anggapan yang di ungkapkan perihal penting atau tidaknya Wakil Kepala Daerah dalam penyelenggaraan pemerintahan daerah. Pertanyaan perihal urgensi keududukan Wakil Kepala Daerah merupakan hasil atas tidak disebutkan kedudukan Wakil Kepala daerah secara eksplisit didalam Undag-Undang Dasar Negara Republik Indonesia tahun 1945 baik itu didalam kedudukan Kepala Daerah maupun didalam pasal perihal pemilihan Kepala Daerah. Akan tetapi harus diketahui bahwa kedudukan Wakil Kepala Daerah sangat penting untuk stabilitas Pemerintahan Daerah dan juga menjaga agar Pemerintahan Daerah dapat berjalan dengan baik melalui pengawasan dari Wakil Kepala Daerah meskipun anatar Kepala Daerah dan Wakil Kepala Daerah terhitung sering mengalami konflik pada saat menjabat. Selain itu untuk tetap menjaga efektivitas dan efisiensi Pemerintahan Daerah maka setiap daerah diberikan hak untuk menentukan keperluan mereka untuk mengisi ataupun mengosongkan kedudukan Wakil Kepala Daerah di Pemerintahan Daerah karena setiap daerah memiliki kebutuhan yang berbeda-beda
